A regular meeting of the City Council of Delray Beach was held in
the Council Chambers at 8=00 P.M., with Mayor J. L. Saunders in the
Chair, City Manager David M. Gatchel, City Attorney G. Robert Fellows,
and Councilmen John L. Pitts, III, James H. Scheifley, and O. F.
Youngblood being present.
1. An opening prayer was delivered by Father Timothy Hannon.
2. The Pledge of Allegiance to the Flag of the United States of
America was given.
3 The minutes of the regular Council meeting of March 24th, 1969,
were unanimously approved, on motion by Mr. Youngblood and seconded
by Mr. Pitts.
4. TheCity Clerk said that following the recent opening of the new
Chamber of Commerce building a "Thank You" card had been received from
that organization.
4. The City Clerk read the following letter from Rev. Carl E. Storey,
President of the Delray Beach Ministerial Association, dated April 8=
"In behalf of the Delray Beach Ministerial Association I
would like to convey our thanks to'the City of Delray for the
use of the ~ity Park and its facilities for the joint Easter
Sunrise Service·
Your excellent cooperation along with thecombined efforts
of the Churches of Delray enabled us to bring this special
service of Easter to many people in the area."
4. City Clerk Worthing read the following letter, dated April llth,
from the DelraY Beach Chamber of Commerce, signed by its President,
Roy M. Simon=
"The actions of City Manager, David Gatchel, and the many
city employees whO availed themselves during the recent 'Delray
Affair. were exemplary and the assistance~leadership provided
by them can simply be described as being above and beyond the

Church, dated April 8th , and signed by its Pastor, Rev. Carl E. Storey,
and by the Minister of Music, Mr. O. Guy Woodfin:

for the City of Delray Beach, Florida,

4. The following letter from the Board of Public Instruction of Palm
Beach CountY, dated April 8th, and signed by Superintendent of Schools,
Lloyd F. Early, was read:
"We are'most grateful for the fine cooperation and patience
you and your councilmen have shown during this time of deep
concern for everyone and for the help all'of you have been
willing to give us."

4. The City Clerk read a letter from Mr. Rudy Hoehn of Staten Island,
New York, complementing the Fire Department on the very fine service
rendered as a result of a fire on April 6th in their apartment at
65 Bronson Avenue, Delray Beach.
Mayor Saunders asked that the City Manager commend the men of the
Fire Department who were cited in this letter. The men mentioned
were Captain Wm. LaTour and Assistant Chief C. D. Cook.
5. Mr. Pitts mentioned that he and others observe, several times a
day, cars traveling in the wrong direction on East 5th and 6th Avenues,
and said he thinks the directional signs should be checked with the
thought in mind of making them larger or'placed in a better position
before a serious accident occurs. He asked that this item be referred
to the City Manager.
5. Mr. Scheifley referred to a Legislative Bill being sponsored by
the Palm Beach CoUnty Bar Association concerning municipal courts and
said he believes Council feels the Bill would be prejudicial to the
interests of Delray Beach. He then .moved that the 'City Manager be
authorized to notify the Palm Beach County Legislative Delegation,
also any other proper State officials and representatives, that the
Council and Administration of the City of Delray Beach are opposed
to said Bill. The motion was seconded by Mr. Youngblood and carried
unanimouslY.
5. Mayor Saunders read the PROCLAMATION proclaiming and appointing
the ARISERS, a singing group of the First Baptist Church;as Ambassa-
dors At Large of the City of Delray Beach, and then presented said
Proclamation to Mr. O. Guy Woodfin, Minister of Music'of the Church,
who announced that the Arisers would make a trip to New York this
summer where they would sing in different churches and various other
places.
5. Mayor Saunders read a' PROCLAMATION proclaiming Thursday, May 1,
1969, as LAW DAY USA, and that we acknowledge our duty as citizens
and recognize our responsibility to obey the lawo
5. Mayor Saunders reported he had attended a Chamber of Commerce
Directors meeting recently and that they had an opportunity to get
the National Shuffleboard Doubles Tournament in Delray Beach on
January 19, 20 and 21, 1970. He said this is'a highly prized tourna-
ment and would bring approximately 150 participants with their wives
and possibly several hundred spectators, and that they are cooperating
with the Shuffleboard Club in sponsoring this endeavor.
Mr. Cyril Rogers, President. of the Shuffleboard Club, said their
organization would like to have Councit'appr~val of' Chamberof Com-
merce action, as they believe this tournament will bring approximately
600 people to this area and it is probable that some of those people
will spend part, or maybe all of the season here. He said that Mr.
HerbertK. Smock, President of the National Shuffleboard Association,
Inc., of Miami, is very anxious that this tournament be held on the
southeast coast of Florida; further, that the Delray Beach facilities
are the best in this area.
Mr. Pitts moved that Council give approval of the Chamber of Com-
merce sponsorship of said event, and that a letter be written to Mr,
Smock, President of the National Shuffleboard Association, indicating
the willingness of the City to cooperate in every way. The motion
was secondedbyMr. Youngblood and carried unanimously.
6.do Concerning a survey of lands in violation of the City's nuisance
laws, presented by the City Manager, Mr. Youngblood moved that the
City Clerk be instructed to proceed with the enforcement of Chapter
15 of the City Code of Ordinances, the motion being seconded by Mr.
Pitts and unanimously carried.

~.b. The City Manager reported that based upon an offer of purchase,
submitted to Council March lOth by Mr. E. A. Traver, for a parcel of
City-owned land, being the North 25 feet of South SO feet of East 145
feet of Lot 9, Section 17, Township 46 South, Range 43 East, located
on the Northwest corner of S. W. 8th Avenue and 1st Street, an Auction,
as authorized by Council, was held on April 3rd in the City Hall~ fur-
ther, no other offer was received at the auction, and, it having been
determined that no City use of this parcel appears feasible, it is
reuommended that the offer of $200.00 for said 25 foot parcel of land
be accepted and an instrument of conveyance thereof, to Mr. Traver, be
authorized.
Mr. Scheifley.moved that Mr. Traver's bid of ~200.00 be accepted,
the motion being seconded by Mr. Youngblood and unanimously carried.
6.c. City Manager Gatchel informed Council that the Florida East Coast
Railway Company, through its Industrial Development Division Manager,
has indicated the possibility of providing the City of Delray Beach
with certain limited parking facility area along its right-of-way, be-
tween Atlantic Avenue and N. Ee 2nd Street, according to their letter
of March 19, 1969. He said it is recommended this matter be referred
to the Traffic and Parking Committee, together with the Administration,
for review.and recommendation to Council at its next regular meeting.
Mr. Scheifley moved that this item be referred to the Traffic and
Parking Committee for its recommendation, the motion being seconded by
Mr. Pitts and unanimously carried.
6.d. In consideration of terminating a lease, dated August 22, 1949,
with the Lake View Hospital Association, Inc,, which .provides for leas-
ing to said Association, for a period of 99 years, Lots i thru 6 and
Lots 19 thru 22, Block B, Westside Heights, the City Manager read the
following excerpt from said lease:
"IT IS FURTHER AGREED by and between the parties hereto that in
the event the above described property is not used by the Lessee
for hospital or other related purposes, within Two Years from
date, and the Lessor needs and wishes said property for a worthy
civic, public or charitable purpose, then this Lease may be de-
clared terminated by the Lessor by giving notice of '90 days' of
intention to terminate this Lease."
The City Manager said that no use has ever been made' of'this proper-
~y~and noW that nearly twenty years have passed since date of lease,
Should it be thedesire of Council to make said lands available for
some determined Public or charitable purpose, the administration should
be directed to take the necessary steps for effecting termination of
the lease inaccordance with provisions set forth therein.
Mr. Youngblood Said that since the said corporation has failed to
comply withthe lease agreement, and since a very needy organiZatiOn
known as The Community Child Care Center is interested in said piece
of land, he would move that the Administration take the necessary steps
for terminating the Lease, the motion being seconded by Mr. Pitts.
Mr. Youngblood asked the'City Clerk to read the purpose of the pro-
posed Community Child Care Center,' fgllowing which the motion carried'
unanimously.
6.e. Relative to proposed Charter changes, the City Manager informed
CoUncil that certain "Bills", prepared by the City Attorney, which re-
flect desired amendments to the City Charter, by the 1969 Florida
Legislature, as recently expressed by Council during W°rkshop session,
it is recommended that the City Clerk be authorized to arrange for pub-
lishing legal notice of a public hearing to be held on such proposed
amendments, in. compliance with Section 19'1 of the City Charter, such
public hearing to be scheduled to be held at the next regularmeeting
on. April 28th.
Mr. Scheifley moved that the City Clerk be authorized to arrange for
publishing legal notices of public hearing concerning the proposed
amendments to the City Charter, the motion being seconded by Mr.
?.a. City Clerk Worthing informed Council that a petition has been re-
ceived for permit to dispense beer and wine for consumption on the pre-
mises, in conjunction with the operation of Chacona's Restaurant,. lo-
cated at 25 S. E. 6thAvenue. Further, the petitioner has been in-
vestigated in the prescribed'manner by the City's.law enforcement divi-
sion, as well as the State Beverage Department, and having been approv-
ed by those agencies, and being in compliance with all regulations as
set forth in Section 4-24 of the City's Code of Ordinances, it is re-
commended that the petition be granted.
Said petition was unanimously granted, on motion by Mr. Youngblood
and seconded by Mr. Pitts.
7.b. The City Clerk informed Council that certain owners of properties
located in Block 10, Atlantic Gardens S/D have requested improvement
of that portion of S. W. 10th Avenue lying between 2nd and 3rd Streets,
and it is recommended that this petition be referred to the adminis-
tration for review and ultimate recommendation to Council at an early
date.
Mr. Scheifley moved that this petition be referred to the Adminis-
tration for review and recommendation to Council at an early date, the
motion being seconded by Mr. Youngblood and unanimously carried.
7.c. The City Clerk informed Council of a petition from the Delray
Beach National Little League to solicit funds within the City on April
19, 1969, and presented the following report from the Solicitations
Committee, dated April 9:
"The Solicitations Committee has reviewed the application to
solicit submitted by the Delray Beach National Little League and
recommends your approval of the same with endorsement.
They have agreed to delete from their request 'Street Station
Solicitation' at the suggest%on of the Committee."
Mr. Youngblood moved to approve the application as recommended, with
endorsement by Council, the motion being seconded by Mr. Pitts and
unanimously carried.
7.d. The Council was informed that the "Arisers"., nOted religious sing-
ing group within the First Baptist Church of Delray Beach, request the
use of the Community Center's Gymnasium on April 18th and 25th, from
7:00 P.M. to 10:00 P.M., for showing of feature length films. Further,
donations for attendance wi1.1 be accepted and such proceeds are for the
purpose of sharing the cost of sending the Arisers to Buffalo thissum-
met for their participation in a National Baptist Church crusade to be
held in that City. Council was also informed that such usage of the
gymnasium facilities has been determined not in conflict with any Cen-
ter programming and, with the approval of the Recreation Director, it
is recommended that the request be granted.
The request for use of the Community Center was unanimously granted,
on motion by Mr. Youngblood and seconded by Mro Pitts.
8~a. The City Clerk presented ORDINANCE NO. 17-69.

A public hearing having been legally advertised in compliance with
the laws of the State of Florida and the Charter cf..the City of Delray
Beach was held, and no one voiced an objection to Ordinance No. 17-69.
Mr. Youngblood then moved that Ordinance No. 17-69 be passed and
adopted on this second and final reading, the motion being seconded by
Mr. Scheifley. Upon call of roll, Mr. SCheifley, Mr. Youngblood and
Mayor Saunders voted in favor of the motion, and Mr. Pitts was opposed.

The City Clerk stated that prior to resubmission of this Ordinance
on final reading, comment from the Planning and Zoning Board as to the
satisfactory zoning classification will be forwarded to Council.
Mr. Scheifley asked if it is legal to vote on this ordinance at this
time with the zoning district of RM-1A being stipulated, and the City
Attorney said that it is legal.

EAST, WHICH LANDS ARE CONTIGUOUS TO EXISTING MUNICIPAL
LIMITS OF SAID CITY; REDEFINING THE BOUNDARIES OF SAID CITY

The City Clerk pointed out that the original request for the zoning
of said property was that the north 200 feet thereof be in C-1 District
and the balance of the tract in RM-2 District, but that had been changed
and they now request, after consultation with the Director of Planning,
Zoning and Inspection, that the north 535 feet of the west 906 feet of
said tract of land be classified in C-2 General Commercial Distr,ict,
and the remainder of the tract be placed in RM-2 Multiple Family Dwell-
ing District.
Ordinance No. 21-69 was unanimously placed on first reading, on
motion by Mr o Youngblood and seconded by Mr. Pitts.

9.ao The City Clerk read the following Planning and Zoning Board
port, dated April 10, 1969, concerning Site Plan Approval:
"On February 18th, 1969, a Public Hearing was held in the
City Hall at 4:00 P.M., to consider a petition .for Site Plan
Approval in an RM-1 Multiple Family Dwelling District, and to
consider an accompanying replat facilitating the proposed de-
velopment on the following described property:
TRACTS A & B, and LOTS 875 thru 884, TROPIC PALMS
The six Board members being present voted unanimously to
recommend the City Council grant approval to the Site Plan,
which is in compliance with Section 29-7.5% of the Delray
Beach Code of Ordinances, and grant approval to the accompany-
ing necessary replat.
No objections were raised at the Public Hearing."
The City Clerk said that should Council sustain the recommendation
of the Planning and Zoning Board in effecting Site Plan Approval of the
proposed development of the property, it is recommended that Council
also give approval of the Final Plat of the property described herein
and authorize its acceptance, through execution thereof by the proper
City officials, ONLY at such time as the City Engineer certifies that
all facilities relating, thereto, and shown on the Plat, have been pro-
vided and/or constructed.
Mr. Arthur Strock,-Engineer for the developer of said property,
showed sketches of said proposed development and explained their plans
and timing on Construction.
City Engineer Fleminginformed COuncil that there are certain utili-
ties that must be constructed in connection with this proposed develop-
ment, but that approval is requested of the Final Plat of this land,
subject to the certification of the City Engineer that all the facili-
ties have been constructed. Further, there is an agreement as to what
facilities need to be constructed, and.that he would make certification
at the time of their completion, and no further action of the Council
will be needed at that time.
Mr. Scheifley moved that Mr. Shapiro's Site Plan for this property
be approved, the motionbeing seconded by Mr. Pitts-and unanimously
carried.

Mr. youngblood then moved that approval be gl en for the Final Plat
of that property, subject to certification of the City Engineer' that
all facilities relating thereto have been provided or constructed, the
motion being seconded by Mr. Pitts and unanimously carried.
10.x. Mayor Saunders said that before recognition of public requests
from the floor he desired to read an item, and continued:
"As a result of the walk-out this morning 'in the City Garbage De-
partment, members of the City Council are concerned, not only with the
disruption of service in the Garbage Department, but the fact that there
are many men involved who have been with the City for a good many years.
Some have been with the City four years, some eight, some nine, some
twelve, and some thirteen years. We have a procedure outlined in our
procedures manual or manual of grievances which outlines the way these
things are handled and, in this particular instance, this procedure has
not been met. But in order for all concerned, all of the City personnel
and everyone connected with this, to know the consequences, the possi-
bilities, and the probabilities, we have instructed the City Manager to
have a meeting, at once, with the Garbage Department personnel for the
purpose of trying to work out whatever differences there may be. We
hope they can be resolved. I believe that it is the intention of the
City Manager to have this meeting sometime tomorrow, when he can get
in touch with all personnel."
10.a. Mr. Irwin W. Kresser, N. E. 17th Street, complained of the nui-
sances created on his property by dogs, and showed pictures that he
had taken recently of such nuisances. He asked if something could be
done about this problem, and said he did not approve of the recently
passed ordinance concerning dogs.

10.a. Mr. Jack Keating, 823 N. E. 3rd Street, asked Mayor Saunders if
he could give the public a little more information on the garbage pick-
up problem, and Mayor Saunders said that more information should' be
available after the meeting with the Garbage Department personnel.
10.b. City Manager Gatchel informed Council that the Florida City
Manager's.Association is having its annual short course in Daytona
Beach on April 27th .thru the 30th~ further, that he would like to
attend said short course which would necessitate his absence from the
next regular Council meeting on April 28th.
Council was agreeable that the City Manager should attend said short
course and be absent from the next regular Council meeting.
10.b. City Manager Gatchel read the following letter that he had re-
ceived from Governor Claude Kirk today:
"The National Rivers and Harbors Congress will hold their
fifty-sixth national convention at the Mayflower Hotel in
Washington, DOC., on May 13-16, 1969. Each state of the union
is invited to participate in the convention, and I have accepted
the invitation for Florida's participation in order to further
our program of water resources development. I hope you will
accept this opportunity of serving the State and assisting me
as a delegate to represent Florida's interest in this program.
Our success in developing and jointly supporting a unified
public works program may be attributed in part tosuch joint
meetings of local interests, state government,-and the members
of'our delegation in CongresS. A strong state d~legation is'
effective in furthering our program.
Randolph Hodges, Director of the Florida Board of Conserva-
tion, will assist me by serving as chairman of the Florida dele-
gation for the convention. After receiving your replY to my
request for your service at the convention, I will ask him to
furnish'you further details on the convention and its activities.
Please advise me at your earliest convenience of your avail-
ability for the appointment and the convention°"
City Manager Gatchel asked Council permission to accept the appoint-
ment and to at~end said Convention in Washington in May, and their con-
sent was given.
10.b. The City Manager informed Council that he had been contacted
Friday evening and again this evening by the local Jaycees, also by
Jaycees of the State and National levels, concerning their support and
sponsoring of fUnd raising drives for the Muscula~Dystrophy program.
Further, the President of the local Jaycee organization has asked for
permission for the Boy Scout Troop they sponsor to have a car stop or
highway hold-up last Saturday, but since that decision would have to be
made by Council they are now asking for permission for said Boy Scout
Troop, in uniform, to be allowed to contact the vehicular traffic at
the stop lights on East Atlantic Avenue at 5th and 6th Avenues, next
Saturday, April 19th, for about two hours, starting at 1:00 P.M., for
that fund raising drive.
Following discussion, approval was given to the request of the
Jaycees, subject to approval by the Solicitations Committee, on motion
by Mr, ScheifleY and seconded by Mr. Pitts.

Mr. Pitts mentioned the Murphy Construction Company bill and asked
if Council could be given a break-down on what work this bill covered
on the Beach Revetment.
From the detailed report attached to the bill, City Manager Gatchel
explained what work was covered in this bill.
The bills were unanimously approved for payment, on motion by Mr.
Youngblood and seconded by Mr. Scheifley.

CITY OF DELBAY BEACH, FLORIDA, REZONING
AND PLACING LOT 7 AND SOUTH 25 FEET OF
LOT 8, SEABREEZE PARK, DELRAY BEACH,
FLORIDA, IN "C-1 LIMITED COMMERCIAL DIS,
TRICT", AND AMENDING "ZONING MAP OF DELRAY
BEACH, FLORIDA, 1960".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA:
SECTION 1. That the following described property
in the City of Delray Beach, Florida, is hereby rezoned and
placed in the "C-1 Limited Commercial District" as defined
by Chapter 29 of the Code of Ordinances of the City of Delray
Beach, Florida, to-wit:

AN ORDINANCE OF THE CITY OF DELRAY BEACH,
FLORIDA, AMENDING SECTION 13-5 (b), CHAP-
TER 13, AND ORDINANCE NO. G-350, PERTAIN-
lNG TO THE ELECTRICAL CODE FOR THE CITY
OF DELRAY BEACH, FLORIDA, PERTAINING TO
ALL REGULATIONS RELATING THERETO, AND
CONFORMANCE WITH THE NATIONAL ELECTRICAL
SAFETY CODE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
S~ction 1. That Section 13-5 (b), Chapter 13 of the
Code of Ordinances, City of Delray Beach, Florida, be and is
hereby amended to read as follows:
"(b) SERVICE WIRES FROM THE OUTSIDE OF A BUILDING.
Overhead service entrance conductors must be install-
ed in rigid metal conduit. Direct buried service is
permitted for Florida Power and Light Company and
any approved utility company. The direct buried
service shall be installed and maintained at a mini-
mum depth of not closer than 24 inches to the surface
of the ground. Such service shall be restricted to
single family and duplex dwellings only. All such
service shall be installed, operated and maintained
by a public utility company or a communications com-
pany. No direct buried cable shall be installed
under any construction unless in transite or conduit
and in conformance with the National Electrical Safe-
ty Code."
Section 2. Whoever shall violate the provisions of
this section, upon conviction thereof, shall be punished in
accordance with Section 1-6, Code of Ordinances of the City of
Delray Beach, Florida.
