A regular meeting of. the City CounciI of Delray ~Beach was held in
the Council Chambers at 8:00 P.M., with Mayor J. L. Saunders in the
Chair, City Manager David M. Gatchel, City Attor*ney ~ohn Ross Adams,
and Councilmen LeRoy W. Merritt, James B. Wilson an.d O. F. Youngblood
being present.
1. An opening prayer was delivered by the Rev. Thomas Clayton.
2, The Pledge of Allegiance to the Flag of.th~ United States of'
America was given.
3. The minutes of the regular Council meeting of July 8th, 1968, were
unanimously approved~ on motion by Mr. Wilson and seconded by Mr.
Merritt.
5. Mr. Youngblood said he had received complaints relative to poor
police protection in, the western section of tow~ and reported that a
week ago Saturday ni~t, a teen-age group, in cars, had spent from
11:00 P.M. until 7:00~i'A.M. Sunday in front-of his house on N. W. 6th
Avenue, making a disturbance by drinking, dancing, shouting and use of
small musical instruments, and to test out a statement made by Mrs.
Earnestine Holltday of N. W. 9th Ayenue at the last Council meeting,
he had not.called the Police DePartment to* report this disturbance.
Mr. Youngblood reported complaints of poor police Protection from
Mr. Paul Jones, 620 N. W. 1st Street, whose store had been broken into
recently; from Rev. L. Lawrence of N. W. 10th Avenue of night-long,
very fast traffic on that Avenue; and from Mr. William Russell, 417
West Atlantic AVenue, whose place of business had been broken into
several times.
He said it is felt that something should be done by the City Council
relative to improving the police protection in the western area; fur-
ther, he reported that he had checked with the POlice Department and
believes that of the number of police cars and special police on duty
at night, more than one car should be all°tted to the western area.
He recommended that Council consider at least three police cars in
the western area, preferably with colored personnel, in the 1968-69
Budget.
Mayor Saunders said he believed something should be done about that
situation before the new budget time, and suggested the Police Depart-
ment be contacted in an effort to provide better Surveillance.
The City'Manager said this matter WOuld be worked out and a report
on same made to Council.
6.a. Concerning a survey of land in violation of the City's nuisance
laws, presented by the City Manager, Mr. Wilson moved that the City
Clerk be instructed to proceed with the enforcement of .Chapter 15 of
the City Code of Ordinances, the motion being seconded by Mr.~Merritt
and unanimously carried. (Copy of the survey is attached to the

6.b. City Ma~ager Gatchel informed Council that Mr.. Peter E. Shanley
of 1195 S. W. 24th Avenue~(GoZfView), Boynton Beach, a disabled war
veteran, has applied for a gratis license permitting him to clean,
shampoo and vacuum rugs, also refinish floors, and that Mr. Shanley
has complied with Section 16-4 of the City's Code of Ordinances in
submitting a Certificate of War Veteran's Service, properly executed.
Following discussion' d~inq which it was pointed out that this
individual did not live in Delray Beach and pa~ no City taxes, rent,
etc., the request was unanimously*g=anted, on motion by Mr. Youngblood
and seconded by Mr. wilson.

Consulting Engineers, commented-on the bids and said that afterana-
lyzing the bidsand discussions with the City Engineer, City Manager,
and Mr. Fred Hollingsworth, it is recommended that the award of the
contract be made to Murphy Construction Company- (Copy of july 18,
1968,~letter from Glace Engineering Corporation containing such recom-
mendation is attached to the official copy of these minUtes~) See pages

City Engineer Mark Fleming read portions of his memorandum to the
City Manager concerning this item, and recommended that the contract
for said repair work be awarded to the Murphy Construction Company,
Following lengthy discussion, and there being no objection from the
representative of Glace Engineering Corporation, the City Engineer, the
City's Legal Counsel, Mr. Merritt said in view of the discussion and
the need for the repair of the revetment wall, he would move that the
bid of Murphy Construction Company, in the amount of $88,593.75 with a
60-day completion date, be accepted. The motion was seconded by Mr.
Wilson and carried unanlmOusly.
6.d. Concerning Supplemental Agreement' No, 2, reflecting Final ESti-
mate No. 10, on completed Sanitary Sewer Areas 25 and 27 covered by
Contract with Cambron Construction Company, City'Manager Gatchel re-
ported to Council as follows:
"Supplemental Agreement No. 2, relating to Cambron Construc-
tion Company's contract dated September 27, 1967, reflects, in
.detail, final cost reconciliation of all differences between the
'As Built' quantities and the 'Bid'quantities for Areas 25 and
'27 of the sewage Works Project.
Said SuPPlemental Agreement No. 2, further supplemented by
Final Estimate No~ 10 in the amount of $12,620.17, attached to
and form~ing a'part thereof, reflects the Consulting Engineers'
recommendation for final acceptanceof, and payment for, said
completed contract.
This'final estimate has been reviewed and approved by the
Director of Public utilitieS, together with the City Engineer,
and all of itsComputations havebeen verified by the Director
of Finance, and all deletions and additions to the original
contract reflect an underrun of $988.83.
Supplemental Agreement No. 2 further includes a request from
Cambron Construction Company for an extension of six calendar
days to the project. The COnSulting'Engineers recommed this re-
quest be granted, and it is, therefore, recommended that the
Final Estimate No. 10, and SupPlemental Agreement No. 2 be ap-
proved and the project be Placed under the One year warranty
Bond as provided for in the contract."

6.e. The'City Manager informed Council that the Directors of the South
Palm Beach County 6thAnnual Soap Box DerbyreqUest Delray Beach par-
ticipation in the amOUnt of $57.50, of~ which amoUnt $37.50 is for a
savings bond, and $20.00 'for a trophy; fur.ther, 'a~like amount was pro-
vided for the Derby of 1966, as'well as for last year's Derby, and
Subject to Council approval for such participation, an appropriation
of such an amount should be authorized from the General ~und Contin-
gency Account.
Approval for such participation, and authorization for an appro-
priation in the amount of $57.50 from'the ~eneral Fund Contingency
Account, was unanimously granted by Council, on motion by Mr. Merritt
and seconded by Mr. Wilson.
6.f. City Manager Gatchel informed Council that Cambron Construction
Company, Inc., requests~the opportunity of delaying the overlaying
(paving improvement) of a small portiOn of.S.W. 10th Street in the
vicinity of Lift Station No. 25 at S. W. 12th Avenue and 10th Street,
until the completion by the same contractor of the Southeast Inter-
ceptor Project in the Tropic Palms area, which, in.part, due to dis-
tribution line installation on Miami Boulevard, will require certain
road improvement and clean-up work in that immediate area upon com-
pletion of the Sewage Works Pro~ect in the Southeast Area~ further,
concurring with the consultingEngineers, Russell & Axon, it is recom-
mended that this request be granted.
The request was unanimously granted, on motion by Mr. Merritt and
seconded byMr. Wilson.
6.g. The City Manager informed Council that authorization is requested
to permit the'various departments'of the City the opportunity of se-
lecting miscellaneous equipment and furniture, for departmental use,
from the personal property contents of the Bon Aire Hotel, as are deem-
ed useful, economlcally justiflable, and in the best interest of the
City. He named various items that the different departments are Con-
cerned with and could use, and said it is felt that by municipal uti-
lization, there can be more value received than by attempting to dis-
pose of such items at public auction.
Mr. Merritt moved to grant the request of.the City Administration
for use of said equipment and furniture, and~asked that a list of the
different items and the departments selecting them be a matter of re-
cord. The motion was seconded by Mr. Wilson~ who also requested that
such a list as mentioned by Mr. Merritt be kept, also that a fair mar-
ket value be placed on each item, which would reduce the net invest-
ment in said property.
The City Manager said the request would be complied with, and Coun-
cil would be furnished with a copy of such list.
Upon call of roll, the motion uarrie~ unanimously.
6.h. Regarding consulting engineers' special service, City Manager
Gatchel informed Council as follows=
"Russell & Axon, the City's Consulting Engineers, were autho-
rized by the preceding Council, and the current Council~ in work-
shop session with the City Manager, Mr. George Russell, and other
representatives of Russell & Axon, to perform special engineering
services in connection with the revision of storm sewer prelimi-
nary plans, cost estimates and supplementary data required for
submittal to HUD along with the City's application for federal
assistance in financing the southwest storm drainage improvements,
which included Mr. Russell's appearance in Atlanta.
Authorization is requested for effecting payment of the engi-
neers' bill for such services, in the amount of $1,757.30, compu-
tations and rate schedule, originally agreed upon, having been
analyzed and approved by the Director of Finance, such expendi-
ture to be chargeable to the Special Assessment Fund."
Mr. Wilson moved to proceed with the authorization as recommended,
the motion being seconded by Mr. Yo~ngblood and unanimously carried.
~.d. Concerning the status of the applications of the City to the
Department of Housing an~ Urban Development for a loan and a grant in
connection with the Southwest Drainage. Prgject, the City Manager re-
ported that Mr. George Russell of R~ssell & Axon was in Delray Beach
on July 18th, and they had called Mr. Jerome Conner of HUD to inquire
about the tWO applications, and had been informed that the applications
were progressing quite satisfactorily through their normal processes
in that department, but at present they were not able to give any in-
formation as to any time schedule or priority on either request.

Further, July 1st is the beginning of the new fiscal year for the
Federal Government and the funding of various items in the new budget
has not yet been completed.
The City ~mnager said that. Mr. Conner had promised to keep the City
advised as to any additional information or anything the City can do
regarding said applications.
6.i. The City Manager informed Council the State Road Board has finally
approved the installation of a full-actuated ~traffic control signal at
the intersection of State Road 5 {Federal' Highway) and N. E. 14th
Street~ further, Council approvaI of this 'installation is recommended,
along with authorization for necessary fUnds to cover the cost thereof,
to be provided .from the General Fund Contingency Account. He said he
feels the success in getting this light is largely due to the atten-
tion to duty and the emphasis given this Droject by the Police Depart-
ment and, more particularly, the Safety Officer, Sergeant C. E. Dalton,
in personal contact with officials of the State Road Department caus-
ing a resurvey to be made an~ the ultimate approval. He reported a
balance of approximately $700. in the Capital Improvement Fund of the
Traffic Engineering budget and said an additional $1,S00. would be
necessary to make such installation.
Mr. Merritt moved that the City Administration be authorized to in-
stall the traffic signals at State Road 5 and N. E. 14th Street, and
the transfer of $1,500. be made from the' General Fund Contingency Ac-
count to pay for the installation. The motion was seconded by Mr.
Wilson an~ carried unanimously.
?.a. City Clerk Worthing informed Council that a petition has been
received requesting transfer of Beer License No. 301, currently is-
sued to Kenneth H. Lelly~ which business, lo~ated at 104 N. W. 5th
Avenue, has been purchased by Mr. Simon Barnes~ further,, the applicant
has been investigated in the prescribed manner, approved by the State
Beverage Department and the City's law enforcement division, and it is
recommended that this petition for transfer of license be approved.

9.a. Pertaining to recent requests fromCouncil, the City Manager
submitted reports and recommendations for certain improvements rela-
tive to the following items:
1. Providing 'sewage facilities to the home of Rev. N. A.
Jenkins, located at 214 N. W. 2nd Stre~t~
2.Concerning possible extension of the sewage collection
system to Jefferson Manor and PoincianalHeights Sub~iv£sions~
3. Extending sewage collection provisions to the improved
property of Mr. T. P. Wyatt, at 8 S. W. 10th Street.
Concerning Item 1, providing sewer facilities to the home of Rev.
N. A. Jenkins, 214 N. W. 2nd Street, the city Manager reported this
work had been planned in the City work' sChedule, to be accomplished by
City forces prior to the receipt of Rev. Jenkins request and that the
work has now been completed.
Concerning Item 3, the ~ity Manager read the following memorandum,
dated June 28th, from Director of Public Utilities D. E. Christison,
and said that he could not recommend said.installation at this time ~
as it does not meet the economic feasibility ratio established, and
until the matter of right-of-way can be resolved:
"A study of the situation on S. W. lOth Street, relative to
Mr. Wyatt's inquiry regarding sewer service, indicates that
physically such service is possible. However, the existing man-
hole at S. W. 2nd Avenue is 31 feet south of centerline of S. w.
10th Street (half section line), whereas the right-of-way of
S. W. 10th Street easterly is only 25 feet south of the half
section line.
If widening of S. W. lOth Street is contemplated in this
area, additional right-of-way or easement should be obtained
so that straight alignment of the sewer may be made that will
~0t interfere with future road construction.
Inasmuch.as the .average depth for this sewer would be8-10
feet, the estimated cost should be used as $12.00 per lin. ft.
A length of 650 feet should be planned, with this depth it is
recommended that the work be done by contract if possible.
At present, there are 5 units on the south side of 10th
Street and 1 unit on the north side of lOth Street that could
be served. This does not bring the cost/revenue factor within
the amount established as feasible."
Concerning Item 2 regarding possible extension of the sanitary
sewage collection system to Jefferson Manor and Poinciana Heights
Subdivisions, the City Manager rep6rted a balance of approximately
$92,000. in the Sewer Construction Account, a part of which has been
earmarked for a specific item, and based on this accounting, he had
asked the Engineering Department to go further into the possibility
of extending sewers into Area 13, in which the two above mentioned
subdivisions lie. He referred to a memorandum from the City Engineer,
dated June 4, 1968, concerning the estimated Cost of. such a project,
and then read the following memorandum from the City Engineer, dated
July 17th, 1968, regarding Sanitary Sewers in Area 13:
"Further, in reference to my memorandum toyou dated June 4,
1968, regarding the subject Sanitary Sewer Extension to Poinciana
Hts. and Jefferson Manor, and in accordance with your instruc-
tions, I have made a rough study of this area to determine the
extent of the improvements that could be provided with an ex-
penditure, of (a) approximately $50,000, and (b) approximately
$90,000.
The basic preliminary design for Sec. 13 calls for the con-
struction of a Lift Station at the corner.of N. W. 10th Avenue
and N. W. 3rd Street with a f~rce main tying into the existing
installation'under Atlantic'Avenue at W. 12th Avenue. Full cost
of the Lift Station wa's estimated at $24,000, and the Force Main
at $20,000, for a total of $44,000.

Inasmuch as it is not possible to serve this area without
the installation of a Lift Station and force main, it becomes
obvious that an expenditure as low as the $50,000 figure is not
· logically justifiable with respect to additional services pro-
vided. For an expenditure of approximately $90,000, the follow-
ing two schemes are presented:

(a) Install the complete lift station, as designed.
(b) Install.the:force:main in the final location, as designed.
(c) This will leave a sufficient amount to construct a collec-
tion system for only the nearest of the two subdivisions,
Poinciana Heights, with about S? house connections. The expendi-

(a) Install the complete lift station. (In both schemes, it
may be possible to modify this cost by reducing the pumping
capacity in such a manner that it may be increased later.)

a point only a block and a half away.~This installation would
be salvagable in part, on installation of the final force main.
(R. & A..have been consulted .on this, and state that there is
no possibility of overloading System % 11 by this installation
for several years.)
(c) This will leave a sufficient amount to construct a collec-
tion system encompassing all of Poinciana Heights and Jefferson
Manor, and providing approximately 100 house connections. The
expenditure/revenue ratio will be about 24:1.
It seems obvious that Scheme % 2 is the best recommendation
for immediatelysewering these areas, however I would highly
recommend, prior to authorizing any expenditure that thispro-
ject be studied in connection.with the overall Citypicture,
with a view to adopting that procedure which will most. quickly
put the City in. position to finance construction of the entire
Area % 13 which is badly in need of this improvement."
The City Manager said this report indicates the need for further
meetings concerning this matter andsuggested it be considered at a
workshop meeting with the idea of sewering the entire Area 13.
Mayor Saunders asked that the City Manager schedule this item for
the next workshop meeting. ,
9.b. The City. Manager said that.copies of his "Personnel Policies" in
accordance with regulations contained'in the City's Administrative
Code have been furnished Councii, and subject to approval by Council,
it is recommended that effective dates for the various phases of said
Personnel Policies be as follows:

Mr. Wilson moved to approve the recommendations of the City Manager
concerning Sections l02 through 113 of the Personnel Policies, the
motion being seconded by Mr. Youngblood and unanimously carried.
9.c. The'City ~anager said since Council has approved his recommen-
dations as ~to the effective' dates of the Personnel Policies, 'it is his
desire that these policies be printed in appropriate booklet'form to
be made readily available to all City personnel~ therefore, he request-
ed an appropriation of $180.00 from the General Fund Contingency Ac-
Count, and $20.00 from the Water Fund Contingency Account to cover the
cost of printing 1,000 copies of the Municipal Employees' Handbook re-
flecting and setting forth the policies and responsibilities of all
City employees.
Mr. Wilson moved thatthe City Manager be authorized to spend the
funds as requested, the motion being seconded by Mr. Merritt and
unanimously carried.
9.d. This 'item followed Agenda Item 6.h.
9.e. The City Clerk said that Council, at its last regular meeting,
referred back to the Zoning Board a petition for zoning change from
R-iA to C-2 of Lots.14 and 15, replat of part of Block 1, Model Land
Company's Subdivision of the West half of Section 21-46-43, requesting
the Board to reconsider this request. Further, the Board convened on
July 16th, and following a review and general-discussion concerning
this rezoning request, again unanimously recommends the petition be
denied, detailed reasons for this decision being as follows:
"(1) Such would encourage the spread of commercial activities
~into a predominately residential area.
(2) Activities permitted in a C-2 zone are limited in scope to
uses which require more centralized locations.
'(3) Neighborhood opposition is strong."
Mr. O. D. Priest, Jr. aPPeared in behalf of his brother, the peti-
tioner, and displayed a sketch of the subject property and said that
in his 'opinion, it is unsuitable for any type of residential con-
Struction.
Following lengthy discussion, and objections to the requested re-
zoning from Mr. F. G. Railing, 621 South Swinton Avenue, and Mr. A. C.
Kilburn, 614 South Swinton Avenue, Mr. Wilson moved that this item be
tabled for action at the next Council meeting and that it be taken up
at the next work~hop meeting for thorough study. The motion was sec-
onded by Mr. Merritt and Carried unanimously.
9.f. City Clerk Worthing read the Beautification Committee meeting
minutes of July 10th, 1968, and Council action was requested on the
following two items.
"1. Following a discussion of the newly acquired Bon Airs Hotel
property, Mrs. Plume moved that a plan'be developed which would
provide an adequate part of the front section facing. Atlantic
Avenue.to be developed into a park area. (Motion seconded, and
unanimously approved). The Committee requests the privilege of
reviewing the plan before it is developed. (Action requested)
2. Since a report from Mr. Gomery's committee investigating the
property at the southeast corner of 6th and North Swinton Avenue
showed it to still be in unsightly condition, Mrs. Bowen moved
that the City investigate the violations under the City ordinance
and take action; also that the Committee send the owner a letter
requesting improvement. (Motion seconded and passed) (Action
requested)"
Concerning the first item, Mr. Merritt moved that it be referred
back to the Beautification Committee for them to submit a plan for
Council approval, the motion being seconded by Mr. Youngblood and
unanimously carried.
Concerning the 2nd item, it was reported the property referred to
is on the list of nuisance items presented to Council tonight and a
notice will be mailed to the property owner.

10.a. Mrs. Annette Tucker mentiOned the Southwest Drainage Project
and asked what recourse the Citywould take on that item if the grant
or loan is not approved bY the Federal Government.
Mayor sa~nders said it is not known at this time what would be done
in such an event,
lO.a. Mrs. Tucker asked what progress has been made on the integration
of the'Police force following a request or proposal made by'the Chris-
tian Movement for Civic Action of Delr&y Beach, concerning which com-
ments were made by the City Manager.
Concerning the proposed budget for 1968-69Mrs. Tucker asked if it
is possible for the Council to meet with some of the Colored Civic
Organizations so that they may make suggestions or inform the Council
of items they feel need to be included in the budget. She requested,
at Council convenience, that a meeting be set'up with some of the
members of the Christian Movement for'Civic Action, .and other organi-
zations if they desire to meet with Council, concerning the 1968-69
Budget and needsin the Negro community.
Mayor Saunders said there had been representatives from colored
organizations at all of the recent Council meetings informing the
Council of needs' in that area. He said that Mr. Youngblood is their
colored representative on the Council and suggested they work through
him and let him bring their ideas to Council in workshop meetings.
lO.a. Mrs. Phyllis Plume reported on the progress of the Youth Em-
ployment Service program, saying that there have been 61 young people
placed in jobs to date.
City Manager Gatchel said the City has made use of this Youth Bm-
ployment Service in placing some young people in Summer jobs.
10.b. Mayor Saunders complimented the City forces on the crash pro-
gram in getting the trash and garbage cleaned up and said he thinks
the City looks much better.
10.b. Concerning Workme~.'s Compensa~on Insurance, City Manager
Gatchel informed'Council of receipt of a che~k in the amount of
$3,773.75 from the Phoenix of Hartford Insurance Companies in payment
of a dividend declared by their .Board of Directors in accordance with
their Participating Plan filed in this State, it being for the policy
period of January 1, 1967 to January 1, 1968.
The City Manager said he is Very proud of this and. it is the first
rebate the City hasever had on its Workmen.'.s Compensation Insurance,
and reported further: "Through the efforts of the Insurance Company
and the efforts of our City staff, Administration, we devised a plan
which resulted in this saving to the City and this is largely due to
the efforts of our Fire Department. Prior to the year January 1, 1967,
all injuries of personnel, no matter how serious or how minor, were
taken to doctors for treatment. As of January 1, 1967, we put in a
plan by which the supervisor, foreman or superintendent, if in his
judgment the inj'ury was of a relatively minor nature, was to take the
injured employee to the Fire Station for first aid treatment to be
provided by the firemen who normallystaff and man our rescue wagon,
F. D. ~ 7. I think you can see the results right here. Many of the
injuries of a minor nature have been treated Successfully by the fire-
men and have thus saved the City in.experience rate in the number of
cases~'that the insurance company had to pay. forprofessional services
rendered even in minor cases."
During further comments, the City Manager said the Phoenix of
Hartford Group, in their field services rendered here, have put on
training programs fo~ the City personnel and have shown training films
and the City, at their recommendation, has improved the safety features,
particularly in the garage area, and now, when inspected by the State
Industrial Commission, there are writeups of only inconsequential
nature. ~

10.b. Concerning recent requests for sidewalk installation, City
Manager Gatchel presented the following memorandum from the City
Engineer, dated July 22, 1968:
"1. Request by Mrs. Ernestine Holliday of 40 N. W. 9th Avenue,
for a sidewalk from Atlantic Avenue to N. W. 2nd Street. Origi-
nally the right-of-way of N. W. 9th Avenue south of.lst Street
stopped about 200' north of Atlantic Avenue right-of-way line
and only a 15' strip was dedicated south of this point. A few
years ago Mr. Holland obtained a dedication of an additional
10', and paving to about the full width of the right-of-way was
extended from Atlantic Avenue north to the original dedicated
right-of-way, however, at the juncture of these two rights-of-
way there still exists a right-angle jog about equal to the
width of the pavement. It would, accordingly, be impossible
to provide a sidewalk from Atlantic AVenue northward for the
first 200' in the existing right-of-way. The cost to provide
sidewalk along the west side of 9th Avenue from the jog to the
south right-of-way line of N. W. 2nd Street, iS estimated at
approximately $2,875 if done by Contract for assessment.
2. As requested by Mr. Saunders, a sidewalk on N. E. 4th.Street
extending from Swinton to N. E. 7th Avenue would provide the best
service if installed on the northerly side of the pavement for
this entire stretch. The cost of this work, if done by contract
for assessment, is estimated at $5,950.
3. Sidewalk on the west side of N. Swinton from N.2nd to 3rd
Streets, as requested by Mr. Jurney. The complaint was that
the sidewalk in.this area was low and should be raised. This
is normally a maintenance item inasmuch as a sidewalk already
exists and would require only overlaying the existing pavement
to bring the sidewalk to the desired grade. The cost, if dOne
by City forces, is estimated at $1,050, which includes both
labor and materials."
Mayor'Saunders asked about the procedure of constructing the side-
walk requested by Mrs. Holliday and if it would be advertised.
City Clerk Worthing explained that if Council determines to provide
for that sidewalk Construction, there would be a legal advertisement
advising the affected people of a Public hearing concerning the pro-
posed improvement, at which time they would be heard, and Council
would determine from that public hearing whether or not to proceed
with the improvement.
Mayor Saunders asked Mr. Youngblood if he would discuss the
approximate cost of the sidewalk with Mrs. Holliday and determine if
they would desire to proceed with this project on the usual cost shar-
ing basis with.the City.
City Manager Gatchel asked that City Engineer Fleming contact Mr.
Youngblood and provide whatever assistance he may in providing cost
figures, etc. concerning construction of said sidewalk.

10.b. Concerning a request by the Novo InveStment Corporation for
abandonment of a portion of ~~Drive, the City Manager said this
matter had been referred to several members of the City staff, and it
is now recommended that only the South 99.66 feet be abandoned rather
than 152 feet, and provision be made for public utilization of a 30
foot ingress, egress easement and utility easement, to'connect Venetian
Drive with MacFarlane Drive. He further explained the 1°cation of two
drainage and utility easements, and Mr. Ralph Priesmeyer, a represent-
ative of the petitioner, informed Council that his Corporation .under-
stands the recommendations that have been made and are in accord with
same.
Following lengthy discussion, RESOLUTION NO. 34-68, covering said
street abandonment .and Provision o~ easements as explained by the City
Manager, was unanimously passed an~ adopted on this first and final

Gentlemen:
Bids were received on the subject project on July 16, 1968
at 1.0:00 A.M. A total of two bids were received. The...aggre-
gate low bid was submitted by Murphy Construction Compajay
of West Palm Beach in the amount of $88,593.75. The high bid
was submitted by Cleary Brothers Construction ComPany of West
Palm Beach in the amount of $90,418.75. The total bid prices
were very close with the high bid being only 2% above the low
bid.
It can be seen from the attached tabulation that both bids
had what appeared to be an unbal&nced item included. The
Murphy Construction Company bid of $70.00 per lineal foot
for ~teel sheet piling as compared to $7.00 a lineal foot bid
by Cleary Brothers'for the same item, and a $2.00 square yard
bid for th~ 10" concrete berm by Murphy Construction Company
as compared to a $21.00 bid by Cleary Brothers Construction
Company for this item. Both the bidders are well known
contractors in the southeast Florida area and .the' bids, in
general~seem to be very well in line.

After analyzing, the bids and ~iscussions with the City Engi-
neer, City Manager, and Mr. Fred Holling~worth, it i's recom-
mended that the award of the work be made to Murphy Construction
Company and upon his presentation to the City of the properly
executed legal docnunents as cal'led for in the apecifications
that the City enter' into a contract with Murphy Construction
Company for the proposed work.

This agreement entered into this 8th day of July , 1968,
by and between the'CITY OF DELRAY BEACH, PALM BEAGH COUNTY,
FLORIDA, as party of the FIRST part, and GAMBRON CONSTRUGTION
COMPANY, INC., as party of the SECOND part, the same being a
change or supplement to a certain Con~ract by and between the parties
aforesaid, dated September 27, 1967, for the construction of Sewage
Works Project in Area 23 and 25 of ~he CITY OF DELRAY BEACH, PALM
BEACH COUNTY, FLORIDA.
WITNESSETH: ~.
I. W/-IEREAS, the party of the FIRST part desires to amend
the Oontract to reconcile the final quantities as constructed,
with the quantities as originally bid,

WHEREAS, the final constructed quantities are set forth
in the Final Estimate No. 10,
- and -
W}IEREAS, the Final Estimate No; 10, is by reference,
made an integral part of this Supplemental Agreement,
WHEREAS, the result of all deletions and additions
to the original contract is a net underrun of $988.83,
- and -
WHEREAS, this Supplemental Agreement, when signed
by all parties thereto, constitutes final acceptance by the
GITY OF DELRAY BEAGH, FLORIDA, of all work carried out
under this Gontract.
II. THEREFORE, the party of the SECOND part agrees that
the final reconciliation Supplementa1 Agreement supersedes
any and all previous correspondence or verbal agreements
~.~ regarding deletions or additions to the scope of the work car-
tied out under this Contract dated September 27, 1967, for
the construction of a Sewage ~Arorks Project located in Areas
23 and 25 of the CITY OF DELRAY BEACH, PALM BEACH
~ . COUNTY, FLORIDA, and the party of the SECOND part further
agrees that all prices and quantities shown on the attached
Final Estimate are correct, and that the amount of Twelve
thousand, six hundred, twenty dollars and seventeen cents,
($12,620.17), constitute s final payment, including retainage,
for all materials furnished, and work performed under this
contract, all in accordance with the terms of the original _
~. Gontract.
III. It is further agreed and understood that the contract
time is extended six (6) calander days, and that this change
shall not alter in any manner the maintenance, and perfor-
mance guaranties of the original Gontract dated September
27, 1967, and the. same shall stand in full force and effect
in all respects.
