08-08-68SpMtg AUGUST 7, 1968. ., A special meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at' 2.-00 P.M., Wednesday, August 7th, 1968, with Mayor J. L. Saunders in the Chair, City Manager David M. Gatchel, and Councilmen James H. Jurney, LeRoy W. Merritt, James B. Wilson and O. F. Youngblood being present. The Pledge of Allegiance to the Flag of the United States of America was given. Mayor Saunders called the meeting to order and said that same had ii:! been called for the purpose of: ~ ' 1. Receiving, opening, and making public, Bids for construction of a Law Enforcement Complex, as well as Jail Equil~nent for the Build- Lng; ;..~. 2. Final reading of Ordinance No. 22'68, providing for annexation of certain lands located in Section 28-46-43, with 200 feet of frontage on South. AiA; 3. For any other business that may come before the meeting. The City Manager presented the following bids received on Contract No. I and Contract No. 2 concerning the Law Enforcement Complex and Jail Equilmnent: Sp. 8-7-68 '160 Mayor Saunders asked that these bids be tabulated for considera- tion by the Architectand City Administration followed by a recommenda- tion concerning same to Council. City Clerk Worthing presented ORDINANCE NO. 22-68. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING TO THE CITYOF DELRAY BEACH CERTAIN LAND LOCATED IN SECTION 28, TOWNSHIP 46,SOUTH, RANGE 43 EAST, WHICH LAND IS CONTIGUOUS TO EXISTING MUNICIPAL LIMITS OF SAID CITY; REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LAND; PROVIDING FOR THE RIGHTS AND OBLIGATIONS OF SAID LAND; AND PROVIDING FOR THE ZONING THEREOF~ (Copy of Ordinance No. 22-68 is attached to the official copy of these minutes.) There being no objection to Ordinance No. 22-68, said Ordinance was unanimously, passed and adopted on this second and final reading, on motion by Mr. Jurney and seconded by Mr. Merritt. Mr. Youngblood mentioned observing ~ young person in swimming at the beach recently in ordinary troUserS and said he was of the opinion that a.certain type of clothing is required by City ordinance. The City Attorney said he would check the ordinance and take this item up with the city Manager. The meeting adjourned at 2:20 P.M. R. AN ORDINANCE OF THE CITY' COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING TO THE CITY ..OF DELRAY BEACH CERTAIN LAND LOCATED IN SECTION 28, TOWNSHIP 46 SOUTH, RANGE 43 EAST, WHICH LAND IS CONTIGUOUS TO EXISTING MUNICIPAL LIMITS OF SAID CITY; REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LAND; PROVIDING FOR THE RIGHTS AND OBLIGATIONS OF SAID LAND; AND PROVIDING'FOR THE ZONING THEREOF. WHEREAS, CHAMBERLIN FLORIDA RESORT, INC., is the fee simple owner of the property hereinafter described, and WHEREAS, MR. M. A. CHAMBERLIN, Pres~'dent of CH~ERLIN FLORIDA RESORT, 'INC., by his Petition, has consented and given per- mission for the annexation of said property by the City of Delray Beach, and WHEREAS, the City of Delray Beach has heretofore been author- ized to annex lands in accordance with Section 185.1 of the City Char- ter of said City granted to it by the State of Florida; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the' City Council of the City of Delray Beach, Palm Beach County, Florida, hereby annexes to said City the following described tract of land located in Palm Beach County, Florida, which lies contiguous to said 'City, to-wit: A part of Section 28, Township 46 South, Range 43 East, being all that part of the' North 200 feet of the South 2000 feet (measured at right angles to the East and West Quarter Section line of said Sec- tion) of that part of said Section, which lies north of the East and West Quarter Section. line through said Section, and lies East of the Easterly right- of-way line of State Road A1A. Section 2. That the boundaries of the City of Delray Beach, Florida, are hereby redefined so as to include therein the above de- scribed tract of land~, and said land is hereby declared to be within the corporate limits of the City of Delray Beach, Florida. Section' 3. That the tract of land hereinabove described is hereby declared to be in Zoning District R-3 as d~fined by existing ordinances of the City of Delray Beach, Florida. Section 4. That the lands hereinabove described shall im- mediately become subject to all of the franchises, privileges, immuni~ ties, debts (except the exiSting bonded indebtedness), obligations, liabilities, ordinances and laws to which lands in the City of Delray Beach are now or may be, and persons residing thereon shall be deemed citizens of the City of Delray Beach. Section 5.
