A regular meeting of the City Council of Delray Beach was held in
the COuncil Chambers at 8:00 P.M., with Mayor J. L. Saunders in the
Chair, City Manager David M. Gatchel, City Attorney John Ross Adams,
and Councilmen James H. Jurney, LeRoy W. Merritt, James B. Wilson and
O. F. Youngblood being present.
1. An opening prayer was delivered by the Rev. Charles Carrin.
2. The Pledge of Allegiance to the Flag of the United States of America
was given.
X. Councilman Wilson introduced his son Pete, a practicing Attorney in
San Diego, Calif. and also an Assemblyman serving in Sacramento, Calif.
3. The minutes of the regular Council meeting of July 22nd and special
meeting of August 7th, 1968, Were unanimously approved, on motion by
Mr. Jurney and seconded by MrJ Youngblood.
4. City Clerk Worthing read a "Thank You" note'from Danny Clark, win-
ner of the $50.00 bond donated by the City of Delray Beach to the 5th
Annual Soap Box Derby.
4. City Clerk Worthing read the following letter from Fred W. Sands
of S. D. Spady Elementary Scho°l, dated July 24th, 1968:
"Once again the program is about to draw to a close. In be-
half of the faculty and student body here, I wish to thank the
Council of the City of Delray Beach, and the Recreational Direc-
tor, Mr. Elliott, for the wonderful support and supplies received.
AS in bygone years, you have made it possible for the boys and
girls here to excel physically as well as mentally."
5. Mr. Jurney said he would like to direct an item to the City Manager
and alSo. to the City Attorney for the correct legal procedure, and
that a report be made on same at the next meeting. He said that when
the City has the Bon Aire Hotel demolished, which he hopes will be in
the very near future, he would recommend that the hard debris or fill
from that building be used to fill "Priest Pond" which is located in
the southwest area of the City. He recalled the drowning of a child
in said pond some time ago, and referred to the possibility of the
pond becoming a health hazard in the future.
6.a. Concerning a survey of land in violation of the City's Nuisance
Laws, presented by the City Manager, Mr. Wilson moved that the CitY
Clerk be instructed to proceed with the enforcement of Chapter 15 of
the City code of Ordinances, the motion being seconded by Mr. Merritt
and unanimously carried.
'.During. lengthy comments, Mr. Jurney said..:ho, is...not in'accord with
the current City lot mowing program financed by the City and asked that
this item be considered by Council at a workshop meeting.
Mayor Saunders asked that the City Manager schedule this item for
consideration at a Workshop meeting.

6.b. The City Manager informed Council that Mrs. Phannye F. Hayes and
her husband Council Hayes, have offered to purchase Lot 24, Block A,
Westside Heights, City owned land locate~ on the southwest corner of
N. W. 9th Avenue and 2nd Street, as they desire to construct a home at
that location. Further, they have deposited with~e City an amount
representing three-quarters of the assessed valuation of the land, and
Councilmay deny this request or direct the administration to provide
for procedure, as outlined in Section 7 of the City Charter.
The City Manager referred to a sketch showing the location of the
above described property, the lot being 64.67 feet by 135.13 feet..He
pointed out that N. w. 2nd Street has been designated to have a grade
separation at 1-95 which would necessitate the widening of N. W. 2nd
Street, and suggested reservation by the City of a portion of said lot
for future widening of that street. He suggested, if it is CounCil
desire, that the City Administration further contact the petitioners
concerning City retention of 15 feet of said lot for right-of-way pur-
poses and determine if they are still interested in obtaining the prop-
erty, followed by a report on same to Council at the next meeting.
Mr. Wilson moved that Mrs. Hayes be contacted and that her request
be granted subject to the reservation that the City reserves the right
to a portion of the lot, approximately 15 feet, for the widening of
N. W. 2nd Street The motion was seconded by Mr. Youngblood.

It was explained that the City Manager would contact Mrs. Hayes to
determine if she is still'interested in the property with a reduction
in footage for right-of-way purposes, and report his findings to Coun-
cil at the nextmeeting,' at which time the Council may reject the of-
fer, or approve the request and offer the.property at a public auction.
Upon call of roll, the motion carried unanimously.
6.c. In compliance with Section 169 of the. City Charter, the City Man-
ager presented a proposed assessment roll concerning assessments a-
gainst certain properties as a result of Council previously authorizing
the opening, grading and paving of that part of N. E. ?th Court lying
between ~. E. 7th and 8th Avenues· Said assessment roll was unani-
mously approved, on motion by Mr. Youngblood and seconded by Mr. Wilson.

6.d. Concerning a Supplemental Agreement to Cambron ConstrUction Com-
pany contract pertaining to sanitary sewers, the City Manager informed
Council as follows:
"It has been determined by the City's Consulting Engineers, Russell
& Axon, and concurred in by the City's Director of Public Utilities
and Administration that a provision should be made at this time for
authorizing the contractor to furnish all necessary labor, materials
and supplies to provide for the addition of drop-piping in Manhole
at Station 19-69, being the intersection of S. E. 4th Avenue and S.
E. 8th Street.
This addition to the original contract for sewage lines installa-
tions in the SOUTHBASTAREA is determined warranted in order to pro-
vide for intercepting sewage flow from Lateral l-B-1 of Area % 1, at
S. E. 8th Street and 4th Avenue, and tieing same in with the present
sewage flow from that part of Area % 1 west of S. E. 4th Avenue, in-
cluding Areas 21, 23 and 25.
Total cost for this additional construction is $181.00, and it
shall be agreed and understood that the contract time will not be ex-
tended as a result thereof, and such change shall not alter in any
manner the force and effect of the original contract dated June 18,
1968.
Approval of Supplemental Agreement No. 1, to provide for this
dition to said contract, together with authorization for its execution
by the proper City officials, is recommended.'!
Unanimous approval was given for said SupPlemental Agreement No. 1,
on motion by Mr. Merr£tt and seconded by Mr. Wilson.

?.a. City Clerk Worthing informed Co~ncil that Mr. & Mrs. W. F. Snyder~
owners of Homewoc~ Park, a Subdivision adjacent to and west of the
Delray Beach Country Club, have determined that for better development
and ultimate improvement of the.subdivision, replat of the original
lay-out is essential, and have had Prepared, by State of Florida regis-
tered sUrveyors, a replat of that subdivision. Further, the replat of
Homewood Park has been approved by the City Engineer, DirectOr or, Plan-
ning, Director of Public Utilities, as well as the Planning and Zoning

Board, and it is, therefore, recommended that C°unciI approve this
FINAL Replat of Homewooa Park Subdivision, as submitted by the owners.
The Final Replat of Homewood Park Subdivision was unanimously ap-
proved, on motion by Mr. Youngblood and seconded by Mr. Jurney.

ANY PORTION OF THE OCEAN BOULEVARD LYING WEST
THEREOF.

City Clerk Worthing informed Council that this Resolution provides
for locating the West right-of-way line of Ocean Boulevard adjacent t~
Lot 1, BloCk 1, Ocean Park, being the next property south of the City
owned Municipal Pool building, and abandoning any portion of said
Ocean Boulevard lying west thereof. Further, this resolution, the ef-
fect of which is made possible by cooperation of the property owner of
Lot 1, Block 1, Ocean Park, is in further support of action taken by
the City in 1947 in its determination to establish the "Brockway Line"
as a west line of Ocean Boulevard, at which time the owners of the
above described property, as well as the owners of approximately a
dozen other properties on Ocean Boulevard within the affected area,
between Beach Drive on the north and Casuarina Road on the south, did
not lend their support nor acknowledge existence of said Brockway Line
as related to their individual property lines.
Resolution No. 36-68 was unanimously passed and adopted, on this
first and final reading, on motion by Mr. Jurney and seconded by Mr.
Youngblood.

9.a. Concerning'Bids received for construction of a Law Enforcement
Complex and equipment thereof, City Manager Gatchel reported that he
had hoped to have a ~formal report prepared for Council consideration
tonight, but since the bids came in at a much higher level than antici-
pated it will require considerable effort between the architect, assoCi-
ate architect and the low bidders in each of the two items of contract.
He said they have established a definite program and are proceeding in
trying to come to some level of cost that Council can consider in a
favorable manner, and hopes to have such a report for Council consid-
eration at the next regular Council meeting.
10.a Mrs. Dorothea Montgomery, a resident of Mira Mar Garden Apartments,
said that she had inquired at the time of construction of the Summit
Condominium regarding sufficient water pressure in the beach area with
the construction of high-riSe buildings,'and that she had been assured
there would be sufficient pressure. Shereported that since construc-
tion and occupancy of the Bar-Harbour Condominium the Mira Mar Garden
Apartments do not have sufficient water pressure. Mrs. Montgomery
mentioned the Seagate Manor and proposed Seagate Towers and asked
Council what provision is being made in the budget for providing suf-
ficient water to'the beach area.
The City Manager reported that money has been provided in the cur-
rent budget, and plans are being made. for looping the water system for
the entire beach area. ~Purther, the next looping of the water system
would be with a 16" line in the vicinity of Tropic ISle Subdivision
and according to the City Engineers and Consulting Engineers that
would provide sufficientwater pressure.
The City Manager said there needed to be several workshop sessions
concerning future expansion of the City water and sewer systems.
10.a. Mr. Richard Roth, representing the Delray Beach Jaycees, inform-
ed Council their organization had started a City Jaycee Clean-up Project
yesterday,.August llth, and had picked up a truck load of litter in two
hours and had only worked on one side of a street for a distance of ap
proximately half a mile. He recommended that the City furnish tarpau-
lins to cover the lOaded trash trucks to prevent the trash and debris
from falling on the Streets.
Mayor Saunders commended the Jaycees for their efforts in such a
project.
10.b. City Manager Gatchel presented Council with copies of the pro-
posed Budget for the fiscal year of 1968-69, and read his accompanying
letter of transmittal.
10.c. The City Manager reported~tha~'the meeting scheduled by the City
of Boynton BeaCh.for this Thursday evening concerning some of the 1-95
problems has'been postponed. '
10.c. The City Manager reported that on October 27, 28 and 29, 1968,
the'Florida Leagueof Municipalities will hold its annual convention
in Jacksonville, Florida, and he feels that reservations should be in
as early as the end of this week. He asked that Council give this some
consideration and inform his office as soon as possible of their in-
tention concerning attending this convention.

10.c. City Manager Gatchel said he had received a letter from Mr. Wm.
'K. Gimlich saying that he is working on the possibility of a boat show
and festival for Delray Beach on October.26th and 27th, per the follow-
ing news item released to the local newspaper:
"Preliminary planning is. being done for a boat show and festi-
val to be held in the center of Delray on October 26th and 27th.
It is contemplated that leading dealers from Palm Beach to
Fort Lauderdale will display 1969 boats and accessories. It will
probably be the first major boat show in the Southeast-featuring
the new 1969 models.
Also being planned are excursion boat rides, a water show and
possibly a boat race. Admission will be free to all and any
profits from the various concessions will goto local civic groups.
The idea for this festival was dreamed up by Bill Gimlich, owner
of the LAST STRAW-gift shop-804 East Atlantic Avenue and he will
manage it. So far, Mr. Gimlich is very pleased with the reaction
to this from the boat dealers and from local merchants who are
bound to benefit from the several thousand people a day that the
show expects to attract to DelraY."
He reported that Mr. Gimlich said this would be a reasonably whole-
some family outing which should do a great good for Delray, publicity-
wise. The following is an excerpt from said letter:
"SinCe the show will be mostly on private property - about
all we ask of the City is your co-operation, some police pro-
tection and permission for a 3' wide canvas banner to be strung
across the street - on Atlantic Avenue near the draw bridge -
for publicity purposes - prior to the show. Also we would like
permission for the public to use the parking at the City owned
public park and the rest rooms there as well. Any expense .to
the City that arises from this Festival will be born by the
Festival.
We hope to not only meet all expenses but to show a small
prOfit and. to donate this to the Chamber of Commerce in part -
towards their new building fund and to other worthy local-civic'
groups that need donations."
The City Manager said'that unless there iS some.objection on the
part of Council, the Administration will undertake to providewhatever
assistance possible in this matter. Further, the request for the three-
foot banner across Atlantic Avenue would require State Road Department
approval.

SUPPLEMENTAL AGREEMENT NO. I.
This agreement entered into this llth day of March , 1968,
by and between the City of Delray Beach, Palm Beach County, Florida,
~.as party of the FIRST part, and Cambron Construction Company, Inc.,
as party of the SECOND part, as being a supplement to a certain Con-
by and between the parties aforesaid, dated September 27, 1967,
the construction.of Sewage Works Project in Areas 23 and 25 of the
City of Delray Beach, Palm Beach Courtly, Florida.
WITNESSETH:
I. WHEREAS, the party of the FIRST part desires to amend the
Contract to provide for the addition of certain items, the increase
of certain items and the deletion of certain items of the Contract
dated September 27, 1967; and
WHEREAS, the party of the FTRST pa,~t desires to expand its
Contract to include work in Area 27 and in .Area 12.
II.' THEREFORE, the party of the SECOND part agrees to construct
the additional items and the increased items, as detailed in APPENDIX
"A", ~urnishing all necessary labor, materials and supplies at the
Supplemental Agreement unit prices.
III. It is further agreed and un~erstoo~ that the c~ntract time
will be extended 90 calendar days, and that this change shall not alter
in any manner the force and effect of the original Contract dated
September 27.~ 1967, and the same shall stand in full force and effect
in all respect except as amended by this agreement.

RESOLUTION NO. 35-68.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, LOCATING THE WEST RIGHT-OF-WAY LINE OF
THE OCEAN BOULEVARD, ABANDONING ANY PORTION OF THE OCEAN
BOULEVARD LYING WEST THEREOF.
WHEREAS, for many years-there has been considerable un-
certainty as to the exact location of the west right-of-way line
of the Ocean Road, also known as the Ocean Boulevard, in the frac-
tional East half of Section 16, Township 46 South, Range 43 East,
as per plat thereof filed in Plat.Book 1, Page 25 of the Public
Records of Palm Beach County, Florida, and
WHEREAS, a line to serve in the place of the west boundary
line of the Ocean Boulevard in Fractional Section 16, Township 46
South, Range 43 East and commonly known as the Brockway Survey Line
has heretofore been established according to plat thereof on file
in Plat Book 5 at Page 15 of the Public Records of Palm Beach County,
Florida, which line has been used for building and zoning purposes
as the west line of the Ocean Boulevard, and

WHEREAS, the City of Delray Beach desires to definitely
establish the location of the west right-of-way line of such Ocean
Boulevard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Delray Beach, as follows:
SECTION 1. That the City of Delray Beach hereby accepts
and designates the above described line known as the Brockway
Survey Line as shown on that certain plat on file in Plat Book
5 at Page 15 of the Rublic Records of Palm Beach County, Florida,
as being the west right-of-way line of the Ocean Road or Ocean
Boulevard as shown on the plat'of the fractional East half of
Section 16, Township 46 South, Range 43 East, recorded in Plat
Book 1, at Page 25 of the Public Records of Palm Beach County,
Florida, insofar as the s~me affects the property hereinafter
described.
SECTION 2. That the City of Delray Beach hereby abandons
and vacates that portion of the Ocean Road or Ocean Boulevard
shown on plat recorded in Plat Book 1 at Page 25 of the Public Rec-
ords of Palm Beach County, Florida, located in the hereinafter de-
scribed property and lying west of the Brockway Survey Line as shown
in the plat thereof recorded in Pl~t Book 5 at Page 15 of the Public
Records of Palm Beach County, Florida.
SECTION 3. This Resolution shall become effective upon
%he proper acceptance thereof by the owner of the hereinafter de-
scribed property, which acceptance shall be signified by the exe-
cution of the attached consent and release.
