A regular meeting of the City council of Delray 'Beach was held in
the CoUncil Chambers at 8:00 P.M., with Mayor J. L. Saunders in the
Chair, City Manager David M. Gatchel, City AttOrney John Ross Adams,
and Councilmen James H. Jurney, LeRoy W. Merrltt, James B. Wilson and
O. F. YoungbIood being present.
1. An opening prayer was delivered by Father Timothy Harmon.
2. The Pledge of Allegiance to the Flag of the United States of
America was given.
3. The minutes of the regularCouncil meeting of OCtober 14th, 1968,
were unanim°usly approved, on motion by Mr. Wilson and seconded by Mr.
Merritt.
X. Mayor Saunders introduced Messrs. James H. Jurney, James B. McGuire,
Daniel R. Neff, Robert L. Richwagen, James Hr Scheifley and Charles J.
Wick, II, and announced that they have filed as candidates for Council-
man in the coming Election; further, that eight candidates have filed
for two Council vacancies.
4. City Clerk Worthing read the following letter from Mr. Jim Maynor,
Parade Chairman of the South Florida Fair and Exposition, dated October
15, 1968, and said that the'Brochure concerning same will be on file in
the office of the City Manager:
"You are cordially invited to participate in Florida's fourth
largest parade, the 1969 South Florida Fair Parade to be held at
4:00 P.M. on Saturday, January 18, 1969.
We are enclosing a brochure containing information and pic-.
'tures of the 1968 Parade which was attended by 75,000 spectators
and seen by many thousand more who viewed the live teleVision
broadcast. The South Florida Fair Parade will be shown on tele-
vision again in 1969 and will contain new and beautiful floats.
Please make your reservations soon as the number of floats
will be limited to 25 and arrangements should be made as early
as possible for all participants. We look forward to hearing
from you."
Mayor Saunders asked that this item be placed on the agenda of the
next council meeting, and that the Councilmen be thinking about it 'in
the meantime.
$. Mr. Jurney mentioned the debris left along the F. E. C. Railway
tracks following replacement of the cross-ties recently, and asked if
the City Manager could contact the Railway Company concerning removing
same.
City Manager Gatchel said he would again contact the F. E. C. Rail-
way Company and ask them to remove that debris.
5. Mayor Saunders read the following ELECTION PROCLAMATION.
WHEREAS, the Charter of the Cityof Delray Beach, Florida, provides
for a Primary Election for the purpose of nominatingfour Council
Member Candidates for the next General Election, and
WHE~S, in pursuance of said Charter provisions, it is.provided
that a Primary Election shall be held two weeks prior to the first
Tuesday in December.

5. Mayor Saunde:s read a PROCLAMATION proclaiming the week of November
10-16, 1968, as SAVINGS AND LOaN WEEK in Delray Beach. and urged the
citizens of our .con~unity to welcome the thousands of savings and loan
delegates who will be traveling in Florida during that period.
5. Mayor Saunders announced that the League of Women Voters have sched-
uled a Candidates Forum to be held in the Council Chambers at the City
Hall on Wednesday, November 13th, 1968, at 8:00 P.M., for the candi-
dates who have filed for the two Council vacancies.
5. Mayor Saunders said at the last council meeting a report had been
made from the Garden Club Presidents' Parley of the work just completed
at the Veterans of Foreign Wars Monument in the City Park, and Mr.
Wilson had suggested that they be given public recognition for their
fine work.
Mayor Saunders presented Mrs. Greydon Boyd, President of the Garden
Club Presidents' Parley, with a framed Certificate of Recognition from
the City for the outstanding service of the Garden Clubs of Delray
Beach in the field of Beautification.
6.b. Concerning disposal of the Bon Aire Hotel and contents thereof,
City Manager GatcheI informed Council that the total receipts from sale
of furniture, fixtures, etc., was $5,191.41. He also presented Council
with a list of Personal Property items from the hotel that were dis-
posed of by donation to the DelrayBeach Primitive Baptist. Church and
the Gulfstream Goodwill Industries, Inc., and the items that are being
utilized by the different City departments.

The City Manager said that he considers the value of the items from
the hotel that are being used by the City, together with the $5,191.41
would well equal,.or perhaps exceed, the $7,350.00 the Council agreed
to pay Big Chief, Inc. to demolish the Bon Aire Hotel building.
City Manager Gatchel and City Clerk Worthing were commended for
their good'work in the disposition of th~personal property items at
'the Bon Aire Hotel.
6.c. City Manager Gatchel informed Council that the Seacrest Hotel
property, Ocean Beach Lot 16 less dedicated R/W, also Lot 15 less the
west 167 feet, comprising approximately 84,188 square feet, has been
offered to the City, as a possible site for recreational facilitieS,
for the sum of $625,000.
Following.comments on the high costper square foot of said property,
Mr. Wilson moved that no action be taken on this offer at this time,
and that it be deferred for discussion at a workshop session. The
motion was seconded by Mr. Merritt and carried unanimously.
7.a. The City Clerk informed Council that Mrs. Fione Warndof, 140
Marine Way, who gives piano instruction in a studio at 824 East Atlantici
Avenue, petitions for a gratis occupational license on the grounds of
being 65 years of age or older, and in view of her age, and otherwise
complying with the requirements for such exemption, it is recommended
that the request be granted.
The request for gratis license was unanimously granted, on'motion
by Mr. Merritt and seconded by Mr. Youngblood.
7.b. City Clerk worthing informed CoUncil that an application, for dis-
pensing beer and wine, for consumption on the premises, has been re-
ceived from Mary P. Flaherty, who will operate the business to be known
as the Bridge Restaurant at 840 East Atlantic Avenue, and desires to
serve beer and wine in conjunction therewith; further, the applicant
has' been'thoroughly processed in the required manner, and approved by
the proper law enforcement agencies, and it is recommended that the
application be approved.
The request was unanimously granted, on motion by Mr. Jurney and
seconded by Mr. Wilson.

7.c. The Council was informed that the Daughter of Zion Seventh-Day
Adventist Church, 143 N. W. 6thAvenue, Delray Beach, has petitioned
for permission to solicit funds within the' City from November 9th
through the 23rd, the proueeds from same to be used for Welfare, Edu-
cation and Medical Relief~ further, the Solicitations Committee has
reviewed the application from the Church, and under date of October
23rd, recommends Council approval thereof.
The request for solicitation of funds was unanimously granted, on
motion by Mr. Wilson and seconded by Mr. Merritt.
7.d. CounCil was informed that 'Mr. clyde Kehlenbeck, 114 S.' W. 2nd
Street, has requested a gratis occupational license to do miscellaneous
and odd jobs, on the grounds of being 65 years of age or older, and in
view of his age, and otherwise complying with the requirements for such
exemption, it is recommended the request be granted.
The request of Mr.. Kehlenbeck for a gratis license was unanimously
granted, on motion by Mr. Youngblood and seconded by Mr. Wilson.
8.a. City Clerk Worthing presented ORDINANCE NO. 25-$8.

Mr. Wilson questioned'this property being annexed to' the City in an
RM-1 zoning classification as setting a precedent of RM-1 zoning in-
stead of R-3 zoning classification in the beach area.
There being no objection tO Ordinance No. 25-68, said Ordinance was
unanimously passed and adopted on this second and final reading, on
motion by Mr. Jurney and seconded by Mr. Merritt.

During the public hearing scheduled for any interested'party to be
heard concerning said Ordinance, Mr. Thomas Woolbright, Chairman of the
Planning and Zoning BOard, said that he thought all Planning and Zoning
changes were to come before the Planning and Zoning Board before they
are aPProved bY Council~ further, he thinks the Council would be setting
a precedent concerning setbacks from the Brockway Line if this Ordinance
is passed.
Following a question by Mayor Saunders, City Attorney Adams said
that Section 29-7.9 of the Code of Ordinances allows the Council to
initiate changes in Zoning regulations, land use, restrictions in
zoning classifications, and if it does involved change in the zoning
classification or the land use ~ must be referred to the Planning
Board for their consideration and recommendation~ however, it is his
interpretation that if it merely changes a restriction or a regulation
in the zoning code that itdoes no~ have to be referred to them.
Following discussion, Mr. Merrit~ m~ved that Ordinance No. 26-68 be
referred to the Planning and Zoning Board and reco~sidere~ at the next

8.c. City Clerk Worthing presented ORDINANCE NO.. 27-68, and said
this Ordinanceprovides for creating setback regulations concerniBg
future proposed improvement of South 12th Street, and an easterly~ex-
tension thereof, being part of the County's proposed access road from
Military Trail easterly to State Road AiA and to further xn orporate
Lots 33, 34 and 35, Del-Harbour Subdivision.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING SECTION 29-8.2, CHAPTER 29,
CODE OF ORDINANCES OF THIS CITY BY AMENDING SUB-SECTION
(C) PERTAINING TO SETBACK REQUIREMENTS WITHIN A CERTAIN
AREA OF THE CITY OF DELRAY BEACH.
The City Clerk informed Council that the Traffic and Parking Com-
mittee, at its meeting on the-22nd of October, were informed by the
City Manager as to the status of the proposed South 12th Street road
and bridge, and. upon motion made and duly seconded, the Committee unan-
imously recommended that the City Council support the County in their
request for reservation of the right-of-way along the section line, as
proposed.
During lengthy comments, Mr. Jurney said that he is not opposed to
an Intracoastal Waterway Bridge in the south end of the City limits of
Delray Beach, nor is he opposed to the access road to 1-95; however,
he does oppose this particular route that has been chosen. He said he
would abstain from voting on this Ordinance as he owns property in the
vicinity of this proposed route.
Mr. Youngblood said this item had been discussed at a workshop meet-
ing, and it had been pointed out that this 12th Street route would per-
haps hurt fewer people, but regardless of what route is taken, some
people would be hurt. Further, it is his understanding that Delray
Beach will not have to pay for the bridge, and it would be well that
the bridge be located where the County and State officials have desig-
nated that it be.
City Manager Gatchel read~a letter.from Miss Louise Suggs, dated
October 21, 1968, objecting to the 12th Street bridge and road; A copy
of a letter from Mr. George B. Aspinwal.1, Secretary of the Tropic Isle
Civic Association, dated October 23, 1968, to the members of that or-
ganization informing them of the proposed 12th Street route and that
Council would consider same at its October 30th Council meeting;
letter from Mr. Roy M. Simon, President of the Delray Beach Chamber of
Commerce, dated October 23rd, 1968, expressing the need of access to
South Ocean Boulevard and 1-95 and urging Council to take immediate
action on those measures necessary to expedite said facility; and a
report from. the Planning and Zoning Board, dated October 30th, 1968,
unanimously favoring the proposed right-of-way and asking that the City
Council reserve said right-of-way by the most ex, lent means possible.

The City Manager saidthat at a Council workshop meeting last week
the City Administration had been asked to get what information possible
as to the thinking of the County, the planning of the County, and the
right-of-way cost as estimated by the. County, on the routes as proposed
for the bridge crossing of the Intracoastal Waterway. He reported this
material had been obtained by Mr. Abbott, the Director of Planning,
Zoning and Inspection, and displayed to COuncil sketches of the three
routes that were first considered. One route with the interchange at
Germantown Road, veering from the section line across on the north side
of Del-Harbour, with the right-of-way cost estimated to be $343,000.00.
To use this route he said construction of a road would be necessary
for access to Intracoastal waterfront property. He said the second
route varied a little from the first one, at an estimated right-of-way
cost of $360,000.00. Further, the present 'route being considered, is
right on the section line, cutting across the F.I.N.D. property and
across part of the Del-Harbour at an estimated right-of-way cost of
$200,000.00.
The City Manager said the finalization of their recommendation is as
follows: "Routes depicted on the attachments have met the criteria
established by the City, County, Florida State Road Department, and the
U. S. Bureau of Public Roads, to assure a southerly interchange for
Interstate 1-95 in Delray Beach." He said that the State. Road Depart-
ment says uniess this ~can a~l be .put together they cannot guarantee
DelrayBeach an interchange on 1-95. Further; "Route three is proposed
as the desired route. First, the right-of-waycost is poSSibly
$143'000. 'cheaper than anyother feasible route for the following
reasons: Route three does not split the Tropicana Golf Course property
in an undesirable manner. Routes one and two would require the purchase
'of all lots north of Del'Haven Drive. Routes 'one and two require the
purchase of a great portion of the lots south of Del-Haven Drive so
that access can be provided to the isolated property. Unnecessary
north-south property is required for routesone and two so that a
sweeping double-reverse curve can be provided. F.I.N.D. property will
be used in route three. Routes one and two require unsafe double-re~
versecurves and ingress-egress across the elevated portions of the
superelevated curves requires a safety hazard and a hardship on the
adjacent property. Atthe intersection of AIA and proposed 12th Street
two dangerously close intersections will be created with routes one and
two."
Mayor Saunders said there Was Some question as to what the 12th
Street route woUld do to the Harbour, and Mr. Abbott was asked to
comment On that. Mr. Abbott said the Countydoes not have a .final
answer for that, but should the property become landlocked the'County
is prepared.to pay for the damage; however, the County doesforesee.
that there is a' very goodpossibility'that a canal Will be placed so
that the northern pact of Del-HarboUr SubdivisionWill again become
Waterfront property.
Mr, Jurney said he thought the intersection of route three with U.S.
No. i would be dangerous, and the City Manager said he WOuld try to get
some information on that from the County.
Mayor SaUnders recommended that Ordinance .No. 27-68 be placed tonight
on first reading'and some of the details could be worked out prior to
second reading and Public hearing on November 25th. It was suggested
that in the meantime the problem of whethera new canal Would, or would
not, be cut through so .that propertywould'not 'be landlocked~ also the
information concerning the. intersection of'U. S. No. 1.
Mr..Youngblood moved that Ordinance No. 27-68be placed on first
reading. The'motion was seconded by Mr, Wilson,' subject 'to the con-
ditions just discussed, which ~ras accepted by'Mr. Youngblood. UpOn

9.a. The Council was informed that at its last regular meeting, the
Planning and Zoning Boardadvised of having held a public-hearing for
Site Plan consideration of plans for development of the Bart property
immediately west of the DelraYBeach National Bank, and the Board's
report thereon unanimously recommended.that CoUncilaccept the Site
Plan ~or development of sa.i~ tract. Further, Council referred the
Board's report to the Traffic and parking Committee for reviewofthe

Site Plan, and that Committee, aS reflected in its minutes of a meeting
held on October 22nd, did consider this propoaed development and recom-
mends as follows= "That traffic from the apartments be limited to a
right turn only on entering. Atlantic Avenue, and the flow of traffic
thereonbe engineered~by .theCity Administration."
The City Clerk said that. in conformity with the provisions .of Chap-
ter 29-7.5% 'of the City's.Code of Ordinances,. it may be the pleasure
of Council toapprove the Site Plan, as recommended by the Planning and
Zoning Board, and further subject to the recommendation of the Traffic
and Parking Committee. It was so moved by Mr. Jurney, seconded by Mr.
Merritt and unanimously carried.
9.bo City Clerk Worthing said that.atl, the lust regular meeting, Council
referred a~petition..for':'~abandonment/of:.,analley.to~the Planning and.Zon-
ing Board, whichhas reviewed the request, and recommends abandonment
of said alley, subject to the approval of the City Engineer. Further,
Council may deny or grant this request, and subject to its approval of
such abandonment, RESOLUTION NO. 40-68 has been prepared and provides. -
for vacating and abandoning said 10 foot alley lying adjacent to and
north of Lot.2, Block 3, Rio Del Rey Shores Subdivision.
Following discussion, Mr. Jurney moved that this item be referred
to the City Attorney and that he examine same to determine if the alley
right-of-way reverts to the abutting property owners or whether it re-
verts back to the original developer of the property, if the Cityl..aban-
don~'same~ for.a.'repor~.at the next regular Council meeting. The mo-
tion was seconded by Mr. Merritt, and upon call of roll, Mr. Jurney,
Mr. Merritt, Mr. Wilson and Mr. Youngblood voted in favor of the motion
and Mayor Saunders was opposed.
10.do Mr. Fred Mills, owner of the Tropicana Golf Course property
which has been under discussion this evening, said that he hadnot
been approached by any official as to thepossibility of right-of-way
through his property, and that he has not been able to get any defi-
nite information as to the proposed road. route.
Mayor Saunders said that the City would see that someone gets in
touch with Mr. Mills on this item.
10.a. Mr, Wilson expressed his appreciation, and commended the City
Administration, and particularly Mr. E11iott the Recreational Director,
on the fine cooperation and help received from the City pertaining to
the Kiwanis sponsored'Halloween Parade.
10.b. City Clerk worthing said that in compliance with Chapter 12 of
the Code of Ordinances, Council is hereby informed of the following
individuals having filed as Candidates for City Councilman, and should
pass upon their qualifications:

City Attorney Adams reported that City Clerk Worthing had checked
to determine that all candidates are registered voters of the City and
that he has checked their deeds and all are owners of improved property
and the deeds have been r~corded for more than a year.
Mr. Youngblood moved to approve the qualifications of the Candidates
upon the recommendation of the City Attorney and City Clerk, the motion
being seconded by Mr. Merritt and unanimously carried.
The City Clerk said that in further compliance with Chapter 12 of
the Code of Ordinances, Council should provi~ for the appointment of
a Clerk and Inspectors to preside overthe Polls at the Primary and
General Elections~ further, the following experienced Election

Mr. Merritt moved that the City Clerk be directed to provide for

10.b. City Manager Gatchel said that the unforeseen~enses concern-
ing the Public Works Budget had been discussed, and it is requested
that Council approve the transfer of $7,000.00 from the General Fund
Contingency Account No. 910-858-800 to the Public Works Garbage Collec-
tion - labor wages - Account No. 910-333-205.
The City Manager's request for transfer of funds was unanimously
approved, on motion by Mr. Wilson and seconded by Mr. Merritt.
10.b. .Relative to negotiated contracts for the Law Enforcement Complex,
City Manager Gatchel read the following letter from Architect Roy M.
Simon, dated'October 30th, 1968:
"Re: Law .Enforcement Oomplex.
As requested by the Council, Mr;' J. G. Rogers and' I entered
into negotiations with contractors interested in the construc-
tion of the Law Enforcement Complex for Delray Beach~
On October 7, we met with those contractors who had submitted
proposals, namely, William Q. Hays and M. J. Robinson Construc-
tion Company of Boynton Beach.and Wo G. Lassiter Company, Inc.
of West Palm Beach. Hays & Robinson again, submitted the lowest
proposal based on the Modified Specifications dated SePtember
17, 1968, and other suggested changes to the original Contract
Documents. A copy of the Hays & Robinson Proposal is attached
for your review.
The.revisions dO not alter the building to any serious con-
sequence. The specification was loosened slightly. The prime
differences, or changes, involve changing the structural'system
- from skeleton-frame to bearing wall; changing the air condition-
ing System from a zoned Water-chiller system to a central air-to-
air system; changing of the interior finish in certain areas;
deletion of the $5,000.00 contingency allowance.; and the accept-
ance of Alternates % 1 and % 2 of the Base Bid~
The Proposal for the building submitted, as outlined above,
adjusts the Original Proposal, dated August 7, 1968~ from "
$515,266.00 to $404,790.53, or a reduction of $110,'475,47-. The
Contingency Allowance of $5,000.00 should be reinstated.
The Proposal for the jail equipment submitted by DecatUr Iron
and Steel Company is Base Bid $58,700.00. Alternate %'1 reduces
th~ Base Bid by $17,000.00, thereby adjusting the jail equipment
price to $41,700.00.

cost that would not effect the use, future development, or
maintenance of the project.
Under the circumstances of prevailing conditions in the con-
struction industry, this negotiated Proposal appears to be the
best available at this time."
The City'Manager also read a list of the proposed revisions from Wm.
Q. Hays and M. J. Robinson Construction Company, dated October 30, 1968,
bringing their base bid down from $515~266.00 to $409,790.53. (Copy of
said list of revisions is attached to the official copy of these min-
utes.)
The City Manager then read the following memorandum, dated October

Mr. J. Watson Dunbar suggested that the item of construction of the
Law Enforcement Complex be placed on the ballot of the November 19th
o '
Primary Election for an p~n~ n from the freeholders.
Following lengthy discussion and comments, Mr. Merritt moved that
contracts be negotiated with Mr. Hays and Mr. Robinson for building of
the Law Enforcement Complex, and with another company for providing the
jail equipment, at the earliest possible date. The motion was seconded
by Mr. Jurney and carried unanimously.
City Manager Gatchel saidthat by the Council action just taken he
would assume that the Administration is instructed to prepare contracts
as outlined in the documents presented to Council tonight, and suggested
the possibility of a special Council meeting for the purpose of execut-
ing the contracts after they have been prepared. The Council expressedi
its agreement to same.

Range 43 East, lying between the Easterly
Right-of-way Line of State Road AIA (formerly
State Road No. 140) asd the waters of the
Atlantic Ocean.
Section 2. That the boundaries of the City of Delray Beach,
Florida, are hereby redefined so as to include therein the above de-
scribed tract of land, and said land is hereby declared to be within
the corporate limits of the City of Delray Beach, Florida.
Section 3. That the tract of land hereinab°ve described is here-
by declared to be in Zoning District RM-1 as defined by existing ordi-
nances of the City of Delray Beach, Florida.
Section 4. That the lands hereinabove described shall immediate-
ly become subject to all of the franchises, privileges, immunities,
debts (except the existing bonded indebtedness), obligations, liabili-
ties, ordinances and laws to which lands in the City of Delray Beach
are now or may be, and persons residing thereon shall be. deemed citi-
zens of the City of Delray Beach.
Section 5. That if any word, phrase, clause, sentence or part
of this ordinance shall be declared illegal by a court of competent
jurisdiction, such record of illegality shall in no way affect the

NOW, THEREFORE, BE IT ORDAINED by the City Council
of the City of Delray Beach, Florida, as follows:
That Sub-section (6), Section 29-7.5, Chapter 29,
Code of Ordinances of the City of Delray Beach, Florida, be
and the same is hereby amended to read as follows:
Sec. 29-7.5. General Provisions and Exceptions.
"(6) Along Ocean Boulevard (State Road
A1A)-a building setback of twenty-five
(25) feet shall be observed from the so-
called 'Brockway Line' (as appears in
Plat Book 20, Page 4, Public Records of
Palm Beach County, Florida) except that
