11-04-68SpMtg NOVEMBER 4, 1968. A special meeting of the City Council of the City of Delray Beach, Florida, was held in the Council Chambers at 2:00 P.M., Monday, Novem- ber 4th, 1968, with Mayor J. L. Saunders in the Chair, City Manager David M. Gatchel, City Attorney John Ross Adams, and Councilmen James H. Jurney, LeRoy W. Merritt, James B. Wilson and O. F. Youngblood being present. An opening prayer was delivered by City Clerk R. D. Worthlng, follow- ed by the Pledge of Allegiance to the Flag of the United States of America. Mayor Saunders called the meeting to order and said that same had been called for consideration of revised Plans and Specifications con- cerning the Law Enforcement Complex, negotiated Contract for construc- tion thereof, and for any other business that may come before the meet- ing. Mayor Saunders introduced Messrs James H. SCheifley, Daniel R. Neff, Richard F. Ward, John L. Pitts, III, and James H. Jurney, and announced that they have filed as candidates for Councilman in the coming Election. City Manager Gatchel reported that Mr. James Gamble Rogers, II, Architect; Mr. Roy M. Simon, Associate Architect; the Contractors, City Attorney John Ross Adams; and the Administration have been working on the Contracts forsaid Law Enforcement Complex, and asked that the sum- mary, for Council action, be presented by Mr. Rogers. Mr. Rogers reported as follows: "We have prepared two contracts based on the standard form of agreement of the American Institute of Architects, one with the general contracting firm of Hays and Robinson, the other with the Southern Steel Company of San Antonio, Texas, who will furnish the jail equipment. These have been reviewed by Mr. Adams, for Council, and also by Council members. We have had a recent discussion and they appear to be in good order and we recommend their approval. In addition, the Contracts will include two Addenda which change certain elements of the building, not, however, the appearance of the building or the efficiencyor the structure or the structural integrity at all, so we feel that all in all it is going to be a very satisfactory building in all respects. My recommendation is, and Mr. Simon concurrs, that we recommend that Council approve these contracts." City Attorney Adams confirmed Mr. Rogers Statements, and informed Council that in approving the Contract for Hays and Robinson they should also include approval at the final contract figure of $409,790.5'3, together with Addenda No. I and No. 2, and with the fur- ther provision that if the contract calls for the permit fee to be paid by the owner, the City, that those fees be waived. Mr. Merritt moved that the Contract with Hays and Robinson be final- ized in the amount of $409,790.53 together with Addenda~ Noel:and No.2, with a further provision that if the City is required to pay the permit fee that it be waived. The motion was seconded by Mr. jurney and car- ried unanimously. Mr. Merritt then moved that the Contract with Southern Steel Company be finalized in the amount of $40,830.00 together with Addenda No. 1, and with the provision that if the City is required to pay the permit fee that it be waived. The motion was seconded by Mr. wilson and car- ried unanimously. It was pointed out that the Contract with Hays and Robinson has a three hundred day time limit, and the Contract with Southern Steel Co. would be completed within that time limit; also that the money for this construction was provided for at a lower market than would be possible today; further, those funds have been eaT~gadditional interest in The meeting a 2:23 P.
