A regular meeting of the City. Council of Delray Beach was held in
the Council Chambers at 8~00 P.M., with Mayor Al. C. Avery i~ the Chair,
City Manager David M. Gatchel, City Attorney John Ross-:~ams0 and Coun-
cilmen J. LeRoy Croft, James H. Jurney and George Talbot, Jr., being
present.
1. An opening .prayer was .delivered by the Rev. Paul Gaas.
1.a. The Pledge of Allegiance to the Flag of the United States of
America Wad given.
2. The minutes'of the regular Council meeting of September 12th. 1966,
were' unanimously approved, on~ motion by Mr. Talbot and seconded by Mr.
Croft.
3. Mrs. A. F. AndersOn, S. E'. 4th Avenue, complained of the mosquitoes
and rodents, also t&li grass and weeds on the vacant properties in the
southeast area of town and asked what the City-planned to dO to elimi-
na=e these nuisances. 'Mrs. Anderson said that she had'written about
these Conditions, but had not received a reply.
Mayor AVery said that~ he recalled having received an anonymous
letter regarding such conditions and had turned it over to the City
Manager. The Mayor then aaked,.Ci~ty Manager Gatchel for a report on
said conditions and what is pianned to be done.
Th.e City Mana:ger, reported that all the vacant lots in the City are
mowed four times each year, that the area Mrs~ Anderson has.' referred
to is Scheduled to be mowed as soon as the mowers can get to that area
further,, 'that they areAwork~ng ~n the southeast section of, town at .this
time.
3. Evangelist J. T.. Turner, Assistant Pastor of the Church of the
Living God, accompanied by Rev. Willie C. Smith, Pastor of the Church
of God by Faith, and Rev. Moses .Andrews, requested,permission to. hold
a tent revival starting this week, location of the tent to be on the
corner of N. W. 10th Avenue and 1st Street.
EvangelS. St TUrner reminded Council of its granting Rev. Willie C.
Smith the..privilege .of .COnducting a street revival for 'one. Su~dayl this
month, and' informed CounCil that these ministers as~ CouncillPe~[sSi°n
to hold these street revivals continually in order to help their people.
Following co,~ents, Mayor Avery asked for a motion that both of

'3."Mrs. Wi. Iliam James, representing the Delray Beach Woman's Republican
Club, asked' permission t9 use the Community Center G~mnasium, Thursday,
October 20th, at 7:30 P.M. for a card party.
Mr. Talbot moved that the "City Manager be authorized to grant such
permis~ion provided that_it does not interfere with some scheduled
activity. The motion was seconded by Mr. Croft and carried unanimously.
3. Mr. Robert K...MileS,, J~.., associated with the Delray Beach Playhouse,
thanked the. City Council for' their long and constant support of the
Playhouse activities, and requested a Proclamation declaring October 1st
thru 31st as_ DELRAY BEACH PLAYHOUSE MOZ~TH, the reason b~ing that the
first play Of the year. ~S.to b~ given dU~ing the month and it is also

Mr. Miles then asked Council permission for Mr. Harvey Brown to
make a legal pass in his airplane over the beach area of town one week-
end in October to dist~ibute approximately 25 coupons, about the. size of
a postal card~ which-is part of the Delray Beach Playhouse membership
drive campaign program. .

5.a. Mr. Jur~'eY informed' Council that he had received a complaint today
regarding old refrigerators, junk automobiles, etc. at N. W. 4th Street
just outside the City limits, and if such a bad condition does exist
that he would like for the Clty Manager to request the County to abate
said nuisance.
5.a. Mayor Avery reported that Councilman SaunderS is absent tonight
due to illness.
6.a. Concerning a survey of parceIs of ~&~d~'t~violation of the City
nuisance laws Preseneed'by'th~ City Ma~~Mf'* Croft moved that the
City Clerk be authorized to proceed wi'th t~forcement of Chaptar 15
of the Code of Ordinances. The motion~was-.se~onded by Mr, Jurney and

6.b. City Manager Gatchel informed Council that the City Engineer an~
Consulting Engineers have advised the Administrati°n of a broken cast
iron pipe force main leading out Of Lift Station No. 18 located on
Andrews Avenue. Further, that measures wou~d soon be undertaken through
the normal work scheduling to take care or'this matter, which is out-
lined in a letter dated September 19th from Mr. D. R. Neff, Pro,eot'
Manager of Russell a Axon.
6.c. The City Manager informed Council that Miss Addie Sundy has
quested exemption for occupational license fee, relating to conduct of
business within the City of Delray Beach due to age factor of the aP-
plicant. Further, that Section 16-4 'of the Code of'Ordinances directs
that Council act upon any such 'apPlicatiOn, and as a result of appli-
cant's qualification having be~n verified, it is recommended that this
requested exemption be authOr{zed.
The request'for exemption of occupational license fee was unani-
mously granted, on motion by Mr. Talbot and seconded by Mr. Croft.
6.d. Concerning bids received' f~r replacement of the pavilion floor,

"Bids were solicited for a Timber D~C~ Floor and/or alternate
Reinforced Concrete FlOor at the pavi!ion on f/~e Municipal Beach,
in accordance with plans and specifications furnished by the City,
from six qualified contrac~tors. The following bids Were received:

The City Manager .said it had been advertised that the City would re-
ceive bids for an awning and framework for. the pavilion and that he
anticipates that a number of bids will be presented tO Councii at the
next regular meeting.
Mr. Croft moved that the Contract for construction of the concrete
pavilion be awarded to Blair Construction Co. in the amount of $2,330.59
funds to be authorized from the General Fund Contingency ACCOUnt. The

During disc~ssion, it was mentioned that the work of 'floor construc-

Further, it has been determined that a 2-ton (6 cu.yd.) dump truck is
needed in. the Stree~ Depart, ,~nt and authorization for its purchase
at a ,bid re,cei~ed in .the .amount' of .$3',7.49.00 is requested. The City
Manager reported that no 'additional fund's are. necessary for the pur-
chase of.said dump truck a*s there ar~ sufficient funds avail*able in
the Street ~partment Account.
Mr.. Jur~ey moved tha't authorization be given for advertising; for
sale ~he obsolete equipment, and commended the City Manager for en-
deavoring' to get this equipment off of the City, inventory thus reducing
the city's insurance premium. The motion was seconded by Mr. Croft and
carried unanimously.
Mr. CrOft moved to grant the r~quest for purchase of the 2~ton dump

Mrs. Fisher said that as Chairman of the Westside Recreation Ad-
visory Board her major concern is that. the work of this Board be con,
sidered. Further, that the Board had been very active during the past
year an~ on May 17th, 1966, a seven page report had been submitted to
each of the Councilmen, and to Various other individuals and organi-
zations, and that no reply had been received regarding said report.
Following discussion, Mr. Talbot moved that Mrs. Celestine Cartwright,
Mr. A. W. Risker, Mr. Charles Oxidine0 Jr., Mrs. Gertrude 9teen, Mrs.
Joyce Fisher, Mrs. Raleigh Harris and Mr. Carlis Brantley, be' appointed
as members of'the Westside Recreation Advisory Board, with Mrs. Fisher
as temporary chairman until a Chairman is elected by the Board, the
motion being s~conded by Mr. Jurney and unanimously carried. These
terms of appointment to sa.id Board expire on July 8th, 1967.
7.a. City Clerk Worthing informed Council that Mr. F. J. Schrader,
veloper of High ACres Subdivision, requests abandonment of that part of
N. W. 4th Avenue extending northerly from N. W. 18th 'Street, being a
distance of 134 feet, which right-of-way serves no purpose as a public
right-of-way and dead-ends at the center of the rear lot line of im-
proved Lot 20, Lake Shore Estates. Further, it is recommended that the
petition for abandonment be granted subject to a utility easement of
thirty feet in width over said strip bein~ granted the City, said ease-
ment lying within and extending from a line 12 feet waS~ of, and a line
18 feet east of a northerly projection of the centerline of No W. 4th
Avenue.
The City Clerk then presented RESOLUTION NO. 36-66.

City Clerk Worthing said that adoption of ResolUtion No. 36-66
should be made with the understanding and directive that said Resolu-

described and determined to be necessary.
Mayor Avery relinquished the gavel to Vice-Mayor Croft and moved
that Resolution No. 36-66 be passed on this first and ~inal reading.
The motion was seconded by Mr. Jurney and upon' call of' roli, Mr. Croft,
Mr. Jurney and Mayor Avery voted in favor of the motion and Mr. Talbot
abstained from voting.

AMENDING HEIGHT OF SIGN REGULATIONS'
The City Clerk informed Council that the Planntng/~oning Board, at
its regular meeting held on September 20th, unanimously recommended
amending Section 3-10 of the Code of Ordinances b~ adding Paragraph
(o) which reads as follows and is reflected in Ordinance No. $6-66:
"Height of Signs. No ~ole sign or ground sign shall be erected
or altered, to a height exceeding twenty-five (25) feet above
the finished grade."
Mayor Avery requested that Ordinance No. 56-66 be tabled until such
time as a workshop meeting can be held, said workshop meeting to be
open to the public and all interested parties notified of same.
Mr. J~rney moved that Ordinance No. 56-66 be table~ for further
study, the motion being seconded by Mr. Croft and unanimously carried.
9.a. Regarding appointment of BOard members, the following letter
from the Planning/~oning Board was read:
"In view of the expiration of the terms of Mr. James H. SCheifl.ey
and Mr. Lonnie W. Cook, Jr., of the Planning and zoning BOard on
September 28th, 1966, the Board wishes to recommend that both Mr.
Cook and Mr. Scheifley be reappointed for a new five year term."
Mr. Croft moved that said appointments be made, as reconvnende~.
The motion was seconded by Mr. Jurney and carried unanimously.
9.b. Regarding the Preliminary Plat of Delray Beach Heights First
Addition, the following Planning/Zoning Board report, dated September
22nd, was read:
"At a regular meeting of the Planning and Zoning Board held on
September 20th, 1966, in the. Council Chambers the Board con-
sidered a proposed subdi¥~sio~ plat for Mr. John F. Beatt¥
known as Delray Beach Heights First Addition on S. 'W. loth
Street at S. W. 12th Terrace.
After review of this plat the Board recommends that it be ap-
proved as a Preliminary Plat with the following conditions:
1. All sidewalks be provided in accordance with the existing
subdivision regulations.
2. That special!-attention be given both the storm and sanitary
sewer s~ste~~ tin this area."
Mr. Talbot moved that the C~lncil accept the Planning/Zoning Board's
recomme~lda~ons, the motion being seconded by Mr. Croft.
Regarding the recommendation that special attention be given both
the storm and sanitary sewer system in this area, City Engineer Fleming
quoted the following paragraph from Section 4 of the ordinance regu-
lating the subdiviaion of lands:
"Receipt of the signed copy of the approved Preliminary Plat is
authorization for the sulx!~Vide= to proceed with the preparation

of plans and specifiuations for the following minimum improve-
ments and with the preparation of 'the final plat. Prior to the
construction of any improvements required or to the submission
of a bond in lieu thereof, the subdivider shall furnish the
Director of Public Works all plans, information and data ne-
cessary to determine the character of the site improvements
and compliance with the city standards and specifications.
These plans shall be examined by the Director of ~ublic Works
an~ will be approved if in accordance with all the requirements."
The City Engineer said this had been pointed out due to the fact
that drainage might be critical in that area and no elevation is shown
on the preliminary plat.
Upon call of roll that the preliminary plat of said subdivision be
accepted, the motion carried unanimously.
10.x. City Manager Gatchel informed Council of a letter received from
Mr. Anthony H. HoIliday, Principal of Carver High School, requesting
permission to solicit advertisement from the business places in the
City, as well as contributions of ~1.00 from patrons, the proceeds
from said project to go fOr the support of a Year Book to be pubZished
by the school .this year.
Said request was UnanimOusly granted, on motion by Mr. Jurney and
seconded by Mr. TaLbot.

4. With.respect to Lift.Station 21, a salient feature of the

location. When sewers are constructed West to Rainbow Homes,
Sherwood Park, and other westerly areas, a much larger lift

serve a comparable area.
5. T~en we come to the question of cost. Lift Stations 10 and
19, were competit£vely bad within the past year. Even though
they are comparable in capacity to p~0posed '-Davco~ Lift Station
21, the base ~Davco~ Station bids were ell much higher. The bid
price of these stations is shown below, to be compared with Lift
Station 2.1 cost of $12,475:
Lift Station 10 .... $25,767.
Lift Station 19 .... $26,400.

The City Manager recommended that authorization be given for Change
Order No. 3 to the Contract of Bumby & Stimpson for Areas 20 and 22
for the installation of said Lift .Station for a lump sum price of
$12,475.
Mr. Talbot moved that~ sai~ Change order No. ~ be authorized,, the
motion being seconded by Mr. Croft.
During discussion, Mr. Neff informed CoUncil that the Lift Station
covered in proposed Change Order No. ~ is designed to handle everything
west to approximately 1-95 from S. W. 4th Street to the southerly City
limits, but wi1! need to be rep]aced when sewers are extended west to
the Rainbow HOmes, Sherwoo~ Park and Country Club areas.
Upon call of roll on the motion that said Change Order No. 3 be
authorized, the motion carried unanimously.
10.x. City Manager ~atchel caI~ed Council attention to the progress
reports from Glace Engineering. Corporation and City Engineer Fleming,
on the status of the Beach Revetment Construction Program which is
rapidly nearing completion.
The City Manager announced there would be a meeting of the Direc-
tors of the Fiorida Shore and Beach 'Preservation. ASsOCiation at 10:00
A.M., Thursday, September 29th at the Ci'ty Hall which ~ould be followed
by lunch and an afternoon inspection program.
City Manager"~atchel announced that the Dedication Ceremony for the
Beach Revetment Project would be held Sunday afternoon, October 30th,
the exact hour to be announced at a later date.
10.x. Mayor Avery announced that there would be a Dedication Ceremony
for STERLIN~ FIELD~ (fo~mer V.~.W. ~all Field) on Sunday afternoon,
November 7th, the exact time to be announced at a later date.

THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
1, That Area No. 11 - Systems 11 and 11-A of the sani-
tary sewer system, heretofore designated Project No. 5964-8b, is
hereby accepted by the City as being operational, and the initial
schedule of rates, fees and other charges previously established
shall become effective Nbvember 1, 1966.
2. That nothing herein contained shall be construed as
discharging the contractors from the strict performance of their
remaining contractual duties. That each of the contractors, and
their bonding companies, remain responsible in all respects until
released in accordance with their agreements with the City.
