08-31-65SpMtg AUOUST 31, 1965, A special meet'ing of the City Council of the City of Delray Beach was held in the Council C~ambera at 11:30 A.M., Tuesday, August 31st, 1965, with Mayor Al. C. Avery in the Chair~ City Manager David M. Oatchel, and Councilmen J. LeRoy Croft, James H. Jurney, jack L. Saunders and George ~albot, Jr., being present. Mayor Avery called the meeting to order and announced that same had been called for the purpose of considering sidewalk installation on various streets and for any other business which might come before the meeting. An opening prayer was delivered by City Clerk R. D. Worthing, and the Pledge of Allegiance to the Flag of the United States of America was given. (See Pages 245-B thru 2J,5-D) Resolution No. 39-65 was unanimously passed and adopted on this first and final readin~ on motion by Mr. Croft and seconded by Mr. Saunders.. It was pointed out that there would be a public hearing on Resolu- tion No. 39-65 at the next regular meeting on September 13th, for the p~rpose of hearing objections, if any, on said proposed improvements as set forth in Resolution No. 39-65. Mayor Avery said the City plans to do some work on N. E. 22nd Street concerning widening and drainage of same, but that cost would be assumed by the City. It was suggested that this item be brought to Council at their next regular meeting with detail of the proposed work, estimated Cost there- of, and a request for Council approval of same. BE IT FURTHER RSSOLVSD that said special assessments against all the lots and lands as set forth here~n which are specially bens-" fitted, shall be and remain liens superior in dignity to all other liens, except liens for taxes, until paid, from the date of the as- sessment upon the respective lots and parcels of land assessed~ and which shall bear in~ereet at the rate of eight (8) per cent per annum, and,which may be paid in three (3) equal' yearly installments with ac- crued intergst'~on all deferred payments. Payments shall be made at the sam. p~ac. that ~axe. payable to th. City of Delray Beach, Florida~,~ / are paid, namely at the office of the City Tax Collector, and upon failure of any propertyto~er to pay any arulual installment due, or any part thereof, Or any annual interest upon deferred payments, the City of Delral~ Beach may bring necessary legal proceedings by a Bill in chancery to enforce payment thereof withes11 accrued interest to- gether with all legal ~osts incurred, including a reasonable attorneY's fee.
