01-08-62 JANUARY 8, 1962. A regular meeting of the City Council of Del~ay Beach was held in the Cot~ncil Chambers at 8:00 P.M., with Mayor Walter Dletz in the Chair, City Manager Louis J. Smitzes, City Attorney John Ross Adams and Councilmen A1 C. Avery, George Talbot, Jr., George V. Warren and Oliver W. Woodard, Jr. being present. 1. An opening prayer was delivered by Elder Hoyt B. Simms. 2. On motion by Mr. Avery and seconded by Mr. Talbot, the minutes of the January 2nd, 1962 Council meeting were unanimously approved. X. Regarding "Rules of Order" by which the Council will operate, Mr. Woodard moved that the followingparliementeryprocedures be adopted which are exceptions to Roberts Rules of Order; "For any action which requires a-motion, that a motion be made and seconded, then the proper discussion held. If the Chairman wishes to make a motion, that he vacate the chair verbally, then receive his second, and the meeting is to be conducted by the Vice-Mayor. Consent vote is not to be used, rather a roll call vote by strict alphabetical orders" The motion was seconded by Mr. Avery and unanimously carried. X. Regarding the temporary appointment of two Municipal Judge Ad- Litem, Mr. Talbot moved for the continuance of the terms of Mr. Charles Byron and Mr. Paul Gringle until Council action is taken under the Charter, the motion being seconded by F~r. Woodard and unanimously carried. X. City 0lark Worthing then read RESOLUTION NO. 1378. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRA¥ BEACH, FLORIDA, CREATING THE OFFICE OF VICE,~IAYQR FOR AND DURING THE TEP~! OF THiS C~0UNCiL AND APPOINTING ~ COUNCIL~N TO SAID OFFICE. WHEREAS, the City Council, by Section 28 of the City Charter, is authorized to create such offices as may, in its Judgment, be n~cessary for the government of said city, and WHEREAS, the Council deems it for the best interests of the City to create the Office of Vice-Mayor for and during the term of this Council, and to make an appointment to the same, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. The Office of Vice-Mayor is hereby created for and during the term of this Council. Section 2. 0. W. Woodard, Jr. is hereby appointed to said position. City Manager Smitzes psad the following three letters addressed to Mayor Walter Dietz: "As one present during the installation ceremonies, I was pleased to hear of your firm pronouncements for our City for the forthcoming year. This is good policy. "An accilerated lot clearing,and trimming programis on the right track in City beautification, sanitation and fire pre- vention. Mr. Donald Farrar of 3811 Wall Street, Delray Beach, asked for permission to make commaents upon Agenda item 6.b., if and when his offer contained in said agenda item is turned down by the. Council. 3. Mr. Walter Dutch, a Realtor from Boynton Beach, informed the Council that he has had an offer from m group of people in the de- velopment field who desire to purchase the city owned property in Ocean Ridge, namely Lot 14, Block A. palm Beach Shore Acres, and asked if the city would sell thiS property. ..~ Mr. Warren moved to advise Mr. Dutch that said beach property is ~t for sale. Mayor Dietz relinquished ~he'Chair to Vice-Mayor Woodard and seconded the motion. Following discussion, and upon call of roll, Mayor Dietz, ~r. Talbot and ~,Lr. Warren voted in favor of the motion, Mr. Avery and Mr. Woodard being opposed. 3. ~Ir~. Charles Senior, Manager of the'Florida Power & Light Co. at 2~0 N. E. 2nd Avenue, Delray Beach, presented the Mayor with a check to the City in the amount of $~1,928.1~ which amounts to 6% of their gross revenue for the year 1961, and recalled that the first check he presented to the City from Florida Power & Light Company was in 1947 in the amount of $~7,000.00. ~. ~ir. Warren read the Beautification Committee Mee~.~g minutes of December 28th, 1961 and January 4~th, 1962. Item 3 of the January~4th meeting is as follOwS: "After a discussion concerning the proposed palm trees for the bea6h area, a-motion was made by Mrs. Evaul, seconded by Mrs. Little that the city be asked to reopen' the bidding for these coconut palms and to allow bidders to submit their prices on. the basis of twenty five, fifty and seventy five lots." ..~ ~ -2- 1-8-$2 , ffanuary 8, 1962 Cono6rntng said item 3, Mr. Warren mcr, ed that the Council accept the suggestion of the Beautification Committee and .let out bids in those three catagories. City Manager Smitzes informed the Council of .a donation in the amount of.$103.25 from the Delray Beach Jr. Woman's Club for use by the Recreation Department in a physical fitness program, and Mr. Avery moved for official recognition of this donation. The motion was seconded by Mr. Woodard and carried unanimously. 6.a. Regarding .the reques.t for authorization to make an offer in the name of .the city for purchase of a tract of unimproved property, ~t~. Talbot moved that the City Manager be. instructed to make an offer on the undisc,loSed piece of p~opertY, the motion being 'seconded by Woodard and unanimously carried. . 6.b. Regarding disposition Of offer of $1,000.00 made by Mr. Donald Farrar for the purchase of Gym .equipment for the Community Center, Mr~ Warren read tbs preface item as follows:. In accordance with Council action dated December 26th, i96i the Recreation Director met with Mr. Donald Farrar concerning his offer of $1,000.00 to the City for the purpose of building a complete Gym in the Civic Center. The purpose of the meeting was to get in writing the details of Mr. Farrar's proposal to the city. A copy of the written offer was presented to each of the Councilmen. The proposal, as submitted, would entail in- vestment in equipment and a program that would be more comprehensive than the Recreation Department should commit itself to at. this time. As such, it is recommended the city decline the proposa~l 'as~being too comprehensive to fit into the -planned recreational programs bei. ng put into operation by the Recreation' Department." Mr. Warren:then moved to accept the recommendation to deny the offer, the motion being sec- onded by Mr. Talbot and unanimously carried. }~r. Farrar, following Council denial of his offer, expressed regret at such action which he. deemed unappropriate~ 6.c. City Clerk Worthing read ORDINANCE. NO'.' AN E}XERGENCY ORDINANCE'OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA PER- TAINING TO PER~.LITTING THE ERECTION OF BUBI- NESS DIRECTIONAL SIGNS ALONG EAST FIFTH AND SIXTH AVENUES UNDER CERTAIN CONDITIONS FOR A PERIOD OF SIX MONTHS. WHEREAS, the Code of Ordinances of De]may Beach makes it un- lawful to erect business directional signs~ and WHEREAS, the City Council of the City of Delray Beach, Florida deems it necessary to enact this. ordinance on an emergency basis in order to alleviate a hardship on certain businesses in this.'City and also to alleviate the traffic flow' on certain streets in .this com- munity, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY'BEACH, FLORIDA, AS FOLLOWS: Section 1. Each busines.s establishment on East Fifth and Sixth Avenues of this City shall have, the.right to apply for one business directional sign.to be erected on the opposite highway under the following conditions: Section 2. The 'privilege granted in this emergency ordinance is a temporary measure and all. such signs.~ shall .be removed six months from the date hereof unless further enabling legislation is passed at that time. It is 'the intent of' this ordinance that it shall no longer have any force or effect six montb~ from the date hereof. This Ordinance is effective the 8th day of JanUary, 1962. Railway Co, any for beautification of certain portions identified in said agreement of the Railway,s R/W within the city limits. RE~0DUTION NO. 1375. Upon motion duly made and seconded, the following resolution was passed and adopted: BE IT RESOLVED. by the. In seconding the motion, Mr. Avery stated that this represents a lot of work and Is a forward step in City Beautification. The motion carried unanimously. ?.g. City Clerk Worthing informed the Council that Resolution No. 1376, providing for extension of water ser. v~ce to Seacrest High School is necessary due to the present established policy of the city which limits the extension of water Service to a distance of 200 feet from any main distribution line. RESOLUTION NO. 1376. ~ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING RESOLUTION NO. 1240 AS THE SAME PERTAINS TO APPLICATIONS FOR EXTENSION OF CITY WATER SERVICE TO PROPERTIES LOCATED OUTSIDE THE CORPORATE LIMITS OF SAID CITY. WHEREAS, Section 26 of the City Charter of the City,of De]may Beach, Florida, requires at least two regular meetings of the City Council each month, BE..
