06-11-62 JUNE 11, 1962. A regular meeting of the City Council of Delray Beach was held in tho Council Chambers at 8:00 P.M., with Mayor Walter Diotz in tho Chair~ City Manager LOuis J. Smitzes, City Attorney John Ross Adams and Councilmen A1 C. Avery, GeOrge Talbot, Jr., and George V. Warren being present. 1. An opening prayer was delivered by City Clerk Worthing. 2. On.motion by ~. Talbot and seconded by Mr. Avery, thc minutes of May 28th, June 1st and ~une 2nd, 1962were unanimously approved. 3. Mr. Avery called attention to the fact that's delegation from the Delray Beach WOman, s Clubwere presentand info~med'.them that concerning areoent request from their organization tho City is in the process of removing certain palm trees and striping the parking lot at the Woman's Club leased property. ~. }~. Warren read :the May 17th, 1962Beautification. Committee minutes as follows:' "It was reported that Mr. Milton Boone had offered to land- scape the area south of 10th Street along the east side of the Florida East 0east Railroad at his expense if the city would provide water for maintenance of the landscaping. A motion was~made by Mr. Gatinat, seconded by Mr. Merritt, that the city be requestedlto provide water for this area. Motion passed. There being no further business, the meet- ing was adjourned." City Manager Smitzes reported .that ~he cost of thiS project as estimated by the Di~ectorof Public Works would be appro:~matoly ~625.00 and t~hat said amount of money is available from the City Beautification ~und. There was discussion as to the exact location of this property and whether or not itwas within the City Limits. Mr. Warren moved that the request be tabled until the next meeting and it be determined whether said land is within the City. The motion was seconded by Mr. Avery and carried unanimously. Standafer had been investigated in the usual manner and approved by the Police.Department. . It was moved by Mr. Avery, seconded by Mr. Woodard and iunani- mously carried'that said request be granted. 6.b. The City Manager presented a request for a Beer and Wine. License, consumption off the premises, £romMr. James T. McMurrain, owner and operator of McPk~rain Superette, and informed the Council that the applicant had been investigated and approved.by the Police Department. On motion by Mr. Talbot and seconded by ~. Avery, the request was unanimously granted. 6-11-62 6.8. City Manager Sr~tzes read the following letter from Attorney Jo~m Moore regarding the City Dock Lease, dated June 5, 1962. "Reference is made to original lease dated September 29, 1955 between the City of Delray Beach as lessoP and Archer.and Warriner, Inc. as lessee. This lease, as amended onAp~il 23, 1962, is presently h*ld by Jarman C. Smith, Jr. and Maryon J. Smith, his wife, by virtue of assignment dated July 2, 1959. The property leased is in the City of Delray Beach, Florida, and is described as follows: "Ail of the property owned by the City of Delray Beach bounded and described as follows: onthe Esot, by the West.right-of-way line of the Intracoastal Waterway; on. the North, by the South right-of-way line of S. E. 1st Street, as extended; on the West; by the East right-of-way line of Marine Way;an~ on the South, by .theSouth right-of-way line of S. E, 2nd Street, as extended. The City Manager presented a survey report of alleged Nuisances existing in violation of Chapter 15 of the City's Code of Ordinances that had been furnished by the Fire Department. It was moved by Mr. 'Talbot, seconded by Mr. Avery and unanimously carried to direct the Ci~ty Clerk to comply with .Ordinance No. G-388 as applicable to this Nuisance survey report. City Manager Smitzes presented a report Public Works concerning cost of construction of certain Florida East Coast Railway crossings. The pe~destrian type crossing for s. E. 7th Street as suggested by the Rai~'~ay Company amounting to around ~i~10,000,00 and an automotive type crossing amounting to around $23,000. O0 Mr. Avery moved that the idea of a pedestrian crossing be'~re- fused by this Council and that the City Manager be directed to pro- ceed with estimates on the regular type of crossing for said street and it be brought to the Council at budget time. T~he motion was secomded by Mr. Warren and carried unanimously. ~.h. The City Manager. presented his following memorandum concerning the current status and recommendations of existing sewer contracts: "The recommendations stated herein are reaomm~ndatio~s which reflect the proper course of action that~'shomtd be taken if the Council wishes to proceed toward an~Oc'ean Outfall ~ystem instead of an activated sludge treatment plant system~ "1. Harry Pepper CO.~ Inc. - Jacksonville, FlOrida Contract amount ~290,471.00 - ~lU~ge Treatment Plant Mr. Pepper has retained Robert Griffith, Attorney from Boyn~on Beach, who has submitte~a figure of $15,000.00 as an offer of settlement to terminate his contract . This settlement figure is conSid~?~ too~hi~gh. We there- fore recommend the Council giv.~..~rizatiOn to im- mediately terminate in second'th ~rmihation clauses of the contract doc~~ "2. This Ordinance waa placed, on first reading 'on April 23rd, 1962 and advertised for public hearing on May ~th~ i962 at which time action on said Ordin~ce was deferred ~tila i~ter date-~ ~. Avery moved that the authorization for publication of said Ordin~e be given and that Attorney J. W. Nowlin be notified, in person, as to when the pubiic hearing wo~ld be.
