Ord 23-02ORDINANCE NO. 23-02 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DRI.RAY BEACH, FLORIDA, AMENDING THE CODE OF ORDINANCES OF THE CITY OF DE1.RAY BEACH, AMENDING CHAPTER 35, "EMPLOYEE POLICIES AND BENEFITS", BY ENACTING SECTION 35.056, "DESIGNATION OF PERSONNFJ. AS CRITICAL TO SECURITY", TO PROVIDE FOR FINGERPRINTING AND BACKGROUND CHECKS FOR CERTAIN EMPLOYMENT APPLICANTS AND EMPLOYEES FOR THOSE DEPARTMENTS WHICH ARE DESIGNATFJD AS CRITICAL TO SECURITY; PROVIDING A SAVING CLAUSE, A GENERAL REPEALER CLAUSE, AND AN EFFECTIVE DATE. WHEREAS, there are certain employment positions which are designated as critical to the security of the City; and WHERF. AS, the City Commission has determined it to be in the public's best interest to subject both the employees and applicants of these designated positions to fingerprinting and background checks in order to ensure safety and security. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DRLRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Title III, "Administration", Chapter 35, "Employee Policies and Benefits", of the Code of Ordinances of the City of De[ray Beach, is hereby amended by enacting Section 35.056, "Designation of Personnel as Critical to Security" to read as follows: Section 35.056 DESIGNATION OF PERSONNEL AS CRITICAL TO SECURITY, (A) All departments designated herein as critigal to security shall require that any person applying for. or continuing employment in. any such department or in any such facility which is derided to be critical to security shall be finge~rinted. The fingerprints shall be submitted to the Department of Law Enforcement for a state criminal history record check and to the Federal Bureau of Investigation for a national criminal history record check. The information obtained from the criminal history record checks conducted pursuant to the ordinance may be used by the City to determine an applicant's eligibility for employment or appointment and determine the employee's eligibility for continued employment. Refusal to submit to fingerprinting and backgr_ ound checks may result in discipline up to and including termination of alread,v existing employees or a decision not to hire new applicants. 03) Employees from the following divisions and departments are hereby designated as critical to security, and thus all applicants and employees of the following departments and divisions shall be subjected to fin~rinting and backgr~ ound checks: (1) Police (2) Mana~ment Information Systems (3) Fi e Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That all ordinances or parts of ordinances in conflict herewith be, and the same are hereby repealed. Section 4. Ordinance No. 23-02 provides for the fingerprinting and national/statewide background checks of the employees of these depaxurtents.
