A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, TO LEVY A TAX ON ALL
PROPERTIES WITHIN THE DOWNTOWN DEVELOPMENT
AUTHORITY TAXING DISTRICT OF THE CITY OF DELRAY
BEACH, FLORIDA, FOR MAINTENANCE AND OPERATION, AND
TO APPROPRIATE SAID COLLECTIONS THEREUNDER.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1: That a tax of $1.00 per one thousand
dollars ($1,000.00) of assessed valuation is hereby levied on all
taxable property within the Downtown Development Authority Taxing
District of the City of Delray Beach for the fiscal year
commencing October 1, 1996, and ending September 30, 1997. There
shall be and hereby is appropriated for the purpose of financing
the operation of the Downtown Development Authority Taxing
District revenue derived from said tax operating and maintenance
expenses of the Downtown Development Authority Taxing District,
and also in addition, all revenues derived by said Taxing
District during said fiscal year from all other sources other
than the tax levy for current bond service and that part of
collection of delinquent taxes levied for bond service. The
assessed valuation on all taxable property for operating purposes
within the Downtown Development Authority Taxing District of the
City of Delray Beach is $99,014,924. The operating millage rate
of $1.00 per one thousand dollars ($1,000.00) exceeds the
rolled-back rate of $0.84 per one thousand dollars ($1,000.00) by
19.05%.
Section 2: That the above millage rate is adopted
pursuant to Florida Statutes Section 200.065(2) (e)(2), and
subject to adjustment in accordance with Section 200.65(5) of the
Florida Statutes which provides that each affected taxing
authority, other than municipalities, counties, school boards,
and water management districts, may adjust its adopted millage
rate if the taxable value within the jurisdiction of the taxing
authority as certified pursuant to Section 200.65(1) is at
variance by more than three percent (3%) with the taxable value
shown on the assessment roll to be extended.
Section 3: That public hearings were held on the
proposed budget on September 3, 1996, September 17, 1996 and
December 10, 1996.
PASSED AND ADOPTED in regular session on this 10th day
of December, 1996.

Resolution No. 87A-96 levies the tax within the Downtown
Development Authority Taxing District for FY 1996/97 and should
be adopted prior to Resolution No. 88-96 making appropriations of
sums of money for all necessary expenditures of the City for the
period October 1, 1996 to September 30, 1997.
Recommend approval of Resolution No. 87A-96.

BEACH HAS BEEN DETERMINED BY THE DEPARTMENT OF
.REVENUE TO BE IN VIOLATION OF THE LAW, NECESSITAT-
ING THIS SECOND NOTICE.
The City of.Delray Beach has tentatively adopted a measure to
increase its property tax levy.
Last year's property tax levy:
A. Initially proposed tax levy $17,722,073
B. Less tax reductions due to Value Adjustment Board
and other assessment changes. $51,888
C. Actual property tax levy $17,542,736
This year's proposed tax levy $18,541,496
All concerned citizens are invited to attend a public hearing on
the tax increase to be held on Tuesday, December 10, 1996, 7:00
p.m., at City Hall, 100 NW 1st Avenue, Delray Beach, Florida.
A FINAL DECISION on the prOposed tax increase and the bud-
get will be made at this hearing.
