A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY
BEACH, FLORIDA, AUTHORIZING THE CITY TO PURCHASE FROM
SELLER CERTAIN REAL PROPERTY IN PALM BEACH COUNTY,
FLORIDA, WHICH PROPERTY IS LOCATED EAST OF WALLACE DRIVE,
SOUTH OF S.W. 10TH STREET, DELRAY BEACH, FLORIDA, HEREBY
INCORPORATING AND ACCEPTING THE CONTRACT STATING THE
TERMS AND CONDITIONS FOR THE SALE AND PURCHASE BETWEEN
THE SELLERS AND THE CITY OF DELRAY BEACH, FLORIDA.
WHEREAS, the City of Delray Beach, Florida, wishes to acquire
certain property located in the vicinity of Wallace Drive and S.W. 10th
Street for the purpose of constructing Southwest 10th Avenue; and
WHEREAS, the Sellers hereinafter named desire to sell the
property hereinafter described to the City of Delray Beach, Florida; and
WHEREAS, it is in the best interest of the City of Delray Beach,
Florida, to purchase said property for the purpose described above.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Commission of the City of Delray
Beach, Florida, as Buyer, hereby agrees to purchase from the United States
Department of Justice, as Sellers, land for public purposes for the
purchase price of One Hundred Twenty-Two Thousand Four Hundred Dollars
($122,400.00) and other good and valuable considerations; said parcel
being more particularly described as follows:
Parcel A:
Lot 14, less the East 215 feet thereof, of Esquire
Subdivision, according to the Plat thereof on file in the
Office of the Clerk of the Circuit Court in and for Palm
Beach County, Florida, recorded in Plat Book 23, Page 43;
Parcel B:
Lot 15, less the East 215 feet thereof, of Esquire
Subdivision, according to the Plat thereof on file in the
Office of the Clerk of the Circuit Court in and for Palm
Beach County, Florida, recorded in Plat Book 23, Page 43;
Parcel C:
The South 31.25 feet of the East 200 feet of Lot 14 and
the North 31.25 feet of the East 200 feet of Lot 15,
Esquire Subdivision, as recorded in Plat Book 23, Page
43, of the Public Records of Palm Beach County, Florida;
Parcel D:
The South 60 feet of the East 200 feet of Lot 15, Esquire
Subdivision, according to the Plat thereof on file in the
Office of the Clerk of the Circuit Court in and for Palm
Beach County, Florida, recorded in Plat Book 23, Page 43;
and,
Parcel E:
The North 60 feet of the East 200 feet of Lot 14, Esquire
Subdivision, according to the Plat thereof on file in the
Office of the Clerk of the Circuit Court in and for Palm
Beach County, Florida, recorded in Plat Book 23, Page 43.
Section 2. That the costs of closing and transactions, title
insurance, doc~ent preparation and attorney's fees shall be borne by the
City of Delray Beach, Florida.
Section 3. That the terms and conditions contained in the
Contract for Sale and Purchase of Real Property, and addenda thereto,
between the City of Delray Beach, Florida, and the Sellers as
hereinabove named are incorporated herein.
PASSED AND ADOPTED in regular session on this the 22nd day of
March, 1994.

RESOLUTION NO. 29-94/AUTHORIZING PURCHASE OF PROPERTY FOR
THE CONSTRUCTION OF S.W. 10TH AVENUE
DATE: MARCH 18, 1994
Resolution No. 29-94 authorizes the purchase by the City of certain
property located in the vicinity of Wallace Drive and S.W. 10th
Street for the purpose of constructing Southwest 10th Avenue. The
purchase price is $122,400.00. It also incorporates and accepts
the contract stating the terms and conditions for the sale and
purchase between the United States Department of Justice (as
Seller) and the City of Delray Beach (as Buyer).
Funding will be from General Construction Fund - S.W. 10th Avenue
(Account No. 334-3162-541-61.89).
Recommend approval of Resolution No. 29-94.
