A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, VACATING AND ABANDONING A
PORTIONS OF EXISTING UTILITY EASEMENTS LYING IN PARCEL
1 OF DELRAY TOWN CENTER, AS RECORDED IN PLAT BOOK 65,
PAGES 189 AND 190 OF THE PUBLIC RECORDS OF PALM BEACH
COUNTY, FLORIDA.
WHEREAS, MIG/Delray Town Center Limited Partnership, is the
fee-simple owner of Parcel 1, Plat of Delray Town Center, according to
the Pla~'thereof, recorded in Plat Book 65, Pages 189 and 190, of the
Public Records of Palm Beach County, Florida; and,
WHEREAS, Paula Winker, Agent, has made application for
abandonment of portions of existing utility easements lying in Parcel 1
of Delray Town Center; and,
WHEREAS, the City Commission of the City of Delray Beach,
Florida, finds that its interest in the described property is no longer
needed for the public good and deems it to be in the best interests of
the City of Delray Beach to vacate and abandon said utility easement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
C~TY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That pursuant to Chapter 177.101(5) and Chapter 166
of the Florida Statutes, it is hereby determined to vacate and abandon
all right and interest it holds to the following real property:
Being part of a 12 foot utility easement lying in
Parcel 1 of Delray Town Center, recorded in Plat Book
65, Pages 189 and 190 of the Public Records of Palm
Beach County, Florida, and being more particularly
described as follows:
Commencing at the Southeast corner of said Parcel 1;
thence North 01o27'42'' West along the East line of
said Parcel 1, a distance of 67.03 feet to a point on
the North line of a 12 foot wide utility easement as
shown on said Delray Town Center plat; thence South
88°32'18'' West along the North line of said 12 foot
utility easement a distance of 102.53 feet to the East
line of a 12 foot utility easement as shown on said
Delray Town Center plat.; said point designated as
Point "A" for future reference and the POINT OF
BEGINNING; thence continue South 88o32'18'' West along
the North line of said 12 foot utility easement, a
distance of 12.00 feet; thence North 01o27'42'' West, a
distance of 19.00 feet; thence North 88°32'18'' East, a
distance of 12.00 feet; thence South 01o27'42'' East, a
distance of 19.00 feet to the POINT OF BEGINNING.
Containing 228 square feet, more or less.
Together with a portion of an existing 12 foot utility
easement described as follows:
Commence at the previously described Point "A"; thence
continue South 88°32'18'' West along the North line of
said 12 foot utility easement, a distance of 60.84
feet to the East line of an existing 12 foot utility
easement as shown on said Delray Town Center plat and
the POINT OF BEGINNING; thence continue South
88°32'18" West, a distance of 12.00 feet; thence North
01o18'54'' West, a distance of 12.05 feet; thence North
88o41'06'' East, a distance of 12.00 feet; thence South
01o18'54'' East, a distance of 12.02 feet to the POINT
OF BEGINNING.
Containing 145 square feet, more or less.
Said lands situate lying and being in Palm Beach
County, Florida.
Bearings based on the East line of said Parcel 1,
having a bearing of North 01o27'47'' West according to
said plat of Delray Town Center.
Subject to easements and restrictions of record.
The subject property is located on the north side of
Linton Boulevard, between Military Trail and Palm
Forest Way, Delray Beach, Florida.
PASSED AND ADOPTED in regular session on this the 23rd day of
April, 1991.
