Res 58-90 JUL-05-19 O1:2 m 193847 OR8 6508 1700 RESOLUTION NO. 58-90 A CORRECTIVE RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, CORRECTING RESOLUTION NO. 7-90 WHICH VACATED AND ABANDONED A PARCEL OF LAND LYING IN SECTION 29, TOWNSHIP 46 SOUTH, RANGE 43 EAST, CITY OF DELRAY BEACH, PALM BEACH COUNTY, FLORIDA, BEING A PORTION OF LINDELL BOULEVARD AND GERMANTOWN ROAD AS SHOWN ON .THE PLAT OF LINTON CENTER, RECORDED IN PLAT BOOK 39, PAGES 8 & 9, OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, TO SHOW THE PROPER LEGAL DESCRIPTION, TO PROVIDE FOR VACATION AND ABANDONMENT OF SAID LAND, AND TO PROVIDE THAT THIS RESOLUTION SUPERCEDES RESOLUTION NO. 7-90. WHEREAS, Palms of Delray, Inc., is the fee-simple owner of a parcel of land lying ad3acent to land lying in Section 29, Township 46 South, Range 43 East, City of Delray Beach, Palm Beach County, Florida, being a portion of Lindell Boulevard and Germantown Road, as shown on the Plat of Linton Center, Recorded in Plat Book 39, Pages 8 & 9, of the Public Records of. Palm Beach County, Florida, and, WHEREAS, Thomas T. McMurrian, Agent, made applica- tion for abandonment of a parcel of land lying in Section 29, Township 46 South, Range 43 East, City of Delray Beach, Palm Beach Coun~y,r~ Florida, being a portion of Lindell Boulevard and Germa.ntown Road, as shown on the Plat of Linton Center, recorded in Plat Book 39, Pages 8 & 9, of the Public Records of Palm Beach County, Florida, and, WHEREAS, the City Commission of the City of Delray Beach, Florida, finds'that its interest in the described property is no longer needed for the public good and deems it to be in the best interests of the City of Delray Beach to vacate said portion of Lindell Boulevard and Germantown Road as shown on the Plat of Linton Center. WHEREAS, the City Commission of the City of Delra¥ Beach, Florida now clarifies and corrects the legal descrip- tion shown in resolution 7-90. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMIS- SION OF THE CITY OF DELRAY BEACH, FI,ORIDA, AS FOLLOWS: Section 1. That pursuant to Chapter 177, Sec- tion 177.101(5) and Chapter 166 of the Florida Statutes, it is hereby determined to vacate and abandon all right and interest it holds to the following described property. A parcel of land lying in Section 29, Township 46 South, Range 43 East, City of Delray Beach, Palm Beach County, Florida, being all of Parcel S-2 of the Plat of Linton Center, recorded in Plat Book 39, Pages 8 and 9, of the Public Records of Palm Beach County, Florida, together with a portion of Lindell Boulevard and Germantown Road lying Southerly of, and adjacent to, Parcel 1 and said Parcel S-2, of said Plat of Linton Center, and being more particularly described as follows: Commence at the Northwest corner of said Parcel 1, thence along the Westerly boundary of said Parcel 1 for the following courses: Thence S40° 54'08"W for 265.49 feet; thence S14°55'20"W for 173.09 feet; thence S09° 48'15"W for 91.81 feet to the point of beginning; Thence N68°53'll"E for 28.34 feet to the point of curvature of a curve concave to the South, having a radius of 50.00 feet; thence easterly along said curve to the right through a central angle of 62°10'55" for 54.26 feet to a point of reverse curvature with a curve concave to the North, having a radius of 25.00 feet; thence Easterly along said curve to th~ left through a central angle of 62°10'55" for 27.13 feet to a point of tangency; thence N68°53'll"E for 30.30 feet to the point of curvature of a curve concave to the South, having a radius of 167.09 feet' thence Easterly along said curve to the right through a central angle of 67°52'24'' for 197.94 feet to a point of tangency; thence S43°14'25"E for 633.34 feet; thence S43°10'45"W for 365.89 feet; thence S46°49'15"W for 80.00 feet; thence N43'10'45"W for 365.89 feet; thence N43°14'25"W for 663.02 feet to the point of curvature of a curve concave to the South, having a radius of 75.00 feet;~ thence Westerly along said curve to the left through a central angle of 87°52'24'' for 88.85 feet to a point of tangency; thence S68° 53'11"W for 184.87 feet to Westerly boundary of said Plat of Linton Center; thence along said Westerly Boundary, N09°48'15"E for 116.57 feet to the point of beginning. Containing 2.385 Acres, more or less. Section 2. This resolution supersedes resolution 7-90 and correctly states the legal description of the right-of-way abandoned by the City of Delray Beach: PASSED AND ADOPTED in regular session on this the 12th day of Junm , 1990.
