AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING THE LAND
DEVELOPMENT REGULATIONS OF THE CITY OF DELRAY
BEACH, BY AMENDING CHAPTER 7, "BUILDING
REGULATIONS", SECTION 7.1.5(C), "PROPER DISPLAY OF
BUILDING NUMBERS", TO PROVIDE THAT OWNERS OF
PROPERTIES WHERE BUILDINGS ARE SUBDIVIDED INTO
SUITES OR BAYS SHALL INSTALL AND MAINTAIN CORRECT
SUITE AND BAY DESIGNATIONS; PROVIDING A SAVING
CLAUSE; PROVIDING A REPEALER CLAUSE; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Delray
Beach desires to amend the Land Development Regulations of the
City of Delray Beach, Florida, to provide sufficient
identification of individual suites and bays for buildings so
subdivided, in addition to maintaining in a conspicuous place, a
correct street number for the entire building; and,
WHEREAS, the City Commission of the City of Delray
Beach, Florida, finds that it is appropriate to amend its
existing codes to further provide for suite and bay designations
in order to ensure that police and fire emergency personnel can
correctly identify the exact location of a reported emergency.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 7, "Building Regulations", of
the Land Development Regulations of the City of Delray Beach,
Florida, is hereby amended by amending Section 7.1.5(C), "Proper
Display of Building Numbers", to read as follows:
(C) Proper Display Of Building, Bay, or Suite
Numbers: The owners of all properties having
a building thereon shall install and maintain
in a conspicuous place a correct street
number of sufficient size, shape, and
character as to be visible and readable from
the adjacent street. The owners of all
properties where any building is subdivided
into suites or bays, shall install and
maintain in a conspicuous place~ a correct
suite or bay designation. The suite and bay
designations shall be of sufficient size,
shape and character as to be visible and
readable from the adjacent street. I~~
Street numbers, and suite or bay designations
not meeting the requirements of this section
shall be removed by the owner of the ~I
~ property on which the numbers, and
suites or bay designations are located, and
the numbers or designations meeting the
requirements of this section shall be posted,
within 30. days after notice by certified or
registered mail.
Section 2. That all ordinances or parts of ordinances
which are in conflict herewith are hereby repealed.
Section 3. That should any section or provision of
this ordinance or any portion thereof, any paragraph, sentence or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not effect the validity of the
remainder hereof as a whole or part thereof other than the part
declared to be invalid.
Section 4. That this ordinance shall become effective
ten (10) days after its passage on second and final reading.
PASSED AND ADOPTED on second and final reading on this
the llth day of Auqust , 1992.

This is the second reading of an ordinance amending the Land

The Code Enforcement Office, Fire Department and City Attorney's
Office prepared this proposed ordinance which requires that in
addition to correct street number identification on buildings,
properties which are subdivided into suites and bays also be labeled
in order to facilitate the location of reported emergencies. The
suite or bay designations, like street numbers shall be of sufficient
size, shape and character as to be visible and readable from the
adjacent street.
Recommend approval of Ordinance No. 26-92 on second and final reading.

SUBJECT: REGULAR MEETING OF JULY 21~ 1992
CONSIDERATION OF ORDINANCE 26-92, ADDRESSING OF SUITES
ITEM BEFORE THE BOARD:
The action requested of the Board is that of review and
comment upon a proposed modification to Section 7.1.5(C) of
the LDRs which deals with identification of buildings by
adding requirements for identification of bays and suites
within buildings.
Section 1.1.6(A) provides that prior to action on a proposed
amendment to the LDRs a recommendation is obtained from the
Planning and Zoning Board.
BACKGROUND:
The reason for this request is obviously to provide for better
identification of bays and suites within structures. Such
identification is appropriate for enforcement and emergency
services and will of value to citizens who are locating their
destination.
Attached is correspondence from the City Attorney's Office and
the proposed ordinance.
RECOMMENDED ACTION:
Review and comment, as deemed appropriate, and then provide a
recommendation to the City Commission.
