Res 46-87 RESOLUTION NO. 46-87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AUTHORIZING THE FILING OF AN APPLICATION FOR AN URBAN DEVELOPMENT ACTION GRANT, INCLUDING ALL UNDERSTANDINGS AND ASSURANCES CONTAINED THEREIN, ON BEHALF OF THE CITY OF DELRAY BEACH FOR A PROJECT KNOWN AS "AUBURN TRACE"; ACCEPTING THE TERMS AND CONDITIONS AS STATED IN THE PROJECT APPLICATION AND SUBJECT TO CONDITIONS TO BE DETAILED IN FUTURE GRANT AGREEMENTS; AUTHORIZING THE CITY MANAGER TO ACT AS THE OFFICIAL REPRESENTATIVE OF THE CITY; PROVIDING FOR MAKING FUNDS AVAILABLE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on July 14, 1987 the City Council of the City of Delray Beach, Florida, did authorize an application to thee Department of Housing and Urban Development for a determination of eligibility under the "Pocket of Poverty" criteria of the Urban Development Action Grant program; and, WHEREAS, on November 19, 1987 the City was advised by officials of the Department of Housing a;~ Urban Development that an area of the City had met the eligibality requirements of the program; and, WHEREAS, on November 10, 1987 the City Council of the City of Delray Beach, Florida, did tentatively approve a contract for the sale of a parcel of land to the Procacci Development Corporation for the purpose of developing a rental housing project known as "Auburn Trace", affordable to families of low to moderate income of the community, subject to the receipt of an Urban Development Action Grant for the project and such other terms and conditions as apply; and, WHEREAS, the City Council of the City of Delray Beach did provide due notice and conduct public hearings on November 17, 1987 and again on November 24, 1987 for the purpose of obtaining the views of the citizens, particularly the residents of the area of the proposed project, on the proposed project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section'l. That the City Manager (or Acting City Manager) of the City of Delray Beach, Florida, is hereby authorize] and directed to prepare and file an application to the Department of Ho?sing and Urban Development on behalf of the City of Delray Beech, Florida, for an Urban Development Action Grant ia the amcunt of $5,500,000 for the Auburn Trace project, subject ~o the te~ ms and conditions of the November 10, 1987 agre,,ment tertatively approved with the Procacci Development Corporation. Section 2. That the City Manager (or Acting City Manag~r) is hereby authorized and directed to execute a letter of coI~mi%tment to the Procacci Development Corporation agreeing to submit the Urban Development Action Grant application, implement the project, administer the loan, and commit to the assurances specified in 24 CFR, Part 570. Section 3. That the City Manager (or Acting City Manager) is hereby directed and authorized to act as the official representative of the City of Delray Beach in connection with this application and to provide such additional information as may be required by the Department of Housing and Urban Development. Section 4. That upon the closing of the November 10, 1987 contract for the sale and purchase of land to the Procacci Development Corporation the City will encumber the $1,100,000 purchase price from that sale for the purpose of providing the required 20% in matching funds for the Urban Development Action Grant. Section 5. That the City Council of the City of Delray Beach, Florida, hereby finds that this project is not a major federal action which will have a significant effect on the human environment and that a request to the Department of Housing and Urban Development for the release of project funds will not require an Environmental Impact Statement. Section 6. That a copy of the grant application will be on file in the office of the City Clerk and will be available for public inspection during normal working hours. Section 7.
