A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, VACATING AND ABANDONING THAT PORTION OF S.E.
9TH COURT LYING BETWEEN THE EAST RIGHT-OF-WAY OF S.E. 6TH
AVENUE AND THE WEST RIGHT-OF-WAY OF S.E. 7TH AVENUE, PLAT OF
RIO DEL REY SHORES AS RECORDED IN PLAT BOOK 25, PAGE 5 OF
THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA.
WHEREAS, Marcel M. Hurni and Annette B. Hurni, his wife, are
the fee-simple owners of Lots 1 and 2, Block 1, Rio Del Rey
Shores, recorded in Plat Book 25, Page 5 of the Public Records of
Palm Beach County, Florida; and,
WHEREAS, Rangeley Range, Inc., a Florida Corporation, is t~e
fee-simple owner of Lots 7 and 8, Block 2, Rio Del Rey Shores,
recorded in Plat Book 25, Page 5 of the Public Records of Paim
Beach County, Florida; and,
WHEREAS, E.J. Carraro, President of Rio Del Rey Shores
Homeowner's Association, has made application for abandonment of
that portion of S.E. 9th Court lying between the east
right-of-way of $.E. 6th Avenue and the west right-of-way of S.E.
7th Avenue, Plat of Rio Del Rey Shores Subdivision; and,
WHEREAS, the City Council initiates this abandonment at the
request of E.J. Carraro; and,
WHEREAS, the fee simple owners of Lots 1 and 2, Block 1 and
of Lots 7 and 8, Block 2, each have not objected to same; and,
WHEREAS, pursuant to the recommendation of the Planning and
Zoning Board, a plat is to be of record within ninety days (90)
of the City Commission action approving said abandonment; and,
WHEREAS, the City Council of the City of Delray Beach,
Florida, finds that its interest and the described property is no
longer needed for the public good and deems it to be in the best
interests of the City of Delray Beach to vacate and abandon said
portion of S.E. 9th Court,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DBLRAY BEACH, FLOR1DA, AS FOLLOWS:
Section 1. That pursuant to Chapter 177.101(5) of the
Florida Statutes, it is hereby determined to vacate and abandon
all right and interest it lolds to the following real property:
That portion of S.E~ 9th Court lying between the east
right-of-way of S.E. ~,th Avenue and the west right-of-way of
S.E. 7th Aven~e~ Plat of R~o Del Rey Shores as recorded in
Plat Book 25, Page 5, Public Records of Palm Beach County,
Florida.
Section 2. That the action in Section 1 shall not become
effective until a final plat which combines the abandoned area
with a replat of Lots 7 and 8, Block 2, Rio Del Rey Shores. Such
plat must be recorded on or before March 23, 1988 for this action
to be valid.
PASSED AND ADOPTED in special session on this the 22nd day
of December, 1987.
