A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, VACATING AND ABANDONING A PORTION OF S.E.
5TH AVENUE AND S.E. 10TH STREET LOCATED AT THE S.E.
CORNER OF LOT 10, BLOCK 8, RIO DEL REY, ACCORDING TO THE
PLAT THEREOF RECORDED IN PLAT BOOK 12, PAGE 84 OF THE
PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA.
WHEREAS, Bill Wallace Nissan, Inc., a Florida Corporation, is
the fee-simple owner of Lot 10, Block 8, Rio Del Rey, according to the
Plat thereof on file in the Office of the Clerk of the Circuit Court in
and for Palm Beach County, Florida, recorded in Plat book 12, Page 84;
and,
WHEREAS, William L. Wallace has made application for
abandonment of a portion of S.E. 5th Avenue and S.E. 10th Street, as
described in Section 1 below; and,
WHEREAS, the City Council of the City of Delray Beach, Florida,
finds that its interest in the described property is no longer needed
for the public good and deems it to be in the best interests of the City
of Delray Beach to vacate and abandon said portion of S.E. 5th Avenue
and S.E. 10th Street,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That pursuant to Chapter 166 of the Florida
Statutes, it is hereby determined to vacate and abandon all right and
interest it holds to the following described real property:
Commencing at the Southwest Corner of Lot 10, Block 8,
Rio Del Rey, according to the Plat thereof recorded in
Plat Book 12, Page 84 of the Public Records of Palm Beach
County, Florida; thence run East, based on an assumed
meridian 29.36 feet along the South line of said Block 8,
to a point of curvature, said point also being the point
of beginning of the hereafter described land; thence run
Northeasterly along said curve to the left, having a
radius of 100.00 feet, a central angle of 89o30'20'', for
an arc distance of 156.22 feet to a point of tangent on
the East line of said Block 8; thence run S00°29'40"W
99.14 feet along the Southerly extension of the East line
of said Block 8 to the point of intersection with the
Easterly extension of the South line of said Block 8;
thence run West 99.14 feet along the Easterly extension
of the South line of said Block 8 to the point of begin-
ning. Containing 2013 square feet, more or less.
PASSED AND ADOPTED in regular session on this the 25th day
of February , 1986.
