A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AUTHORIZING PURSUANT TO THE CHARTER
OF THE CITY OF DELRAY BEACH, FLORIDA, AND SECTION 2-7(b)
OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH,
FLORIDA, THE EXCHANGE OF REAL PROPERTY OWNED BY THE
CITY OF DELRAY BEACH LOCATED IN SECTION 16, TOWNSHIP 46
SOUTH, RANGE 43 EAST.
WHEREAS, the City of Delray Beach, Florida is the owner of property more
particularly described as follows:
The South 50' of the North 65.5' of Lot 15 of the Subdivision of
fractional East half of Section 16, Township 46 South, Range 43
East, Plat Book 1, Page 25, less and except the West 155' of the
above described property (Fire Station Parcel).
WHEREAS, Ocean Properties, Ltd. is the owner of property more particularly
described as follows:
The North 58' of the South one-half of Lot 13, less the West ten
feet thereof; Ocean Beach, according to the ?lat thereof, recorded
in Plat Book I at Page 25 of the Public Records of Palm Beach
County, Florida; and,
WHEREAS, the City Council of the City of Delray Beach has previously
discussed and is of the opinion that it would be in the best interest of the City to
exchange the above-referenced real property owned by the City for the
above-referenced real property owned by Ocean Properties, Ltd. upon the terms and
conditions set forth in this Resolution. Such property shall be exchanged with Ocean
Properties, Ltd bearing all costs and expenses for such exchange of both pieces of
property, including, but not limited to, owners title insurance, documentary stamps on
the deeds of conveyance, and recording fees for the deeds of conveyance; and provided
further that such exchange is expressl.v made contingent upon Ocean Properties, Ltd.
developing and constructing on the parcel Ocean Propert~s, Ltd. shah be conveying to
the City, a parking lot made in accordance with the C;ty's plans and specifications,
with all costs and expenses attendant thereto, which shall include but not be limited to
paving, curbing, landscaping, striping, installation of parking meters, and permitting,
to be borne solely by Ocean Properties, Ltd.; all of which shalI be accomplished to the
City's sole satisfaction prior to any such property exchange taking place.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council of the City of Delray Beach, Florida does
hereby authorize the Mayor to execute a standard form general warranty deed of the
above-described real property located in the City of Delray Beach in accordance with
the terms of this exchange, as set forth herein.
