A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, VACATING AND ABANDONING A 10 FOOT UTILITY
EASEMENT LYING WITHIN LOTS A AND B OF THE BLUE SEAS
SUBDIVISION, ACCORDING TO THE PLAT THEREOF RECORDED IN
PLAT BOOK 23, PAGE 185 OF THE PUBLIC RECORDS OF PALM
BEACH COUNTY, FLORIDA. ~
WHEREAS, Howard W. Locker and Mary E. Locker, his wife, are the
fee-simple owners of Lots 9, 10, 11, 12 and Lot B, and that part of Lot
A lying North of the South line of Lots 9, 10, 11 and 12 extended
Easterly in a straight line to State Road A1A, all being in Blue Seas, a
subdivision of the City of Delray Beach, according to the Plat thereof
on file in the office of the Clerk of the Circuit Court in and for Palm
Beach County, Florida, recorded in Plat Book 23, Page 185; and,
WHEREAS, Howard W. Locker and Mary E. Locker, his wife, have
made application for abandonment of a 10 foot utility easement lying
within Lots A and B of the Blue Seas Subdivision; and,
WHEREAS, the City Council of the City of Delray Beach, Florida,
finds that its interest in the described property is no longer needed
for the public good and deems it to be in the best interests of the City
of Delray Beach to vacate and abandon said 10'' foot utility easement
located within Lots A and B of the Blue Seas Subdivision,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That pursuant to Chapter 166 of the Florida
Statutes, it is hereby determined to vacate and abandon all right and
interest it holds to the following real property:
That part of the 10 foot Utility Easement dedicated to
the City of Delray Beach by Deed Book 1060, pages 345 and
3~8 of the Public Records of Palm Beach County, Florida,
being a part of Lots A and B, BLUE SEAS, according to the
plat thereof recorded in Plat Book 23 at page 185 of the
Public Records of Palm Beach County, Florida, described
as follows:
Commence at the Northwest corner of said Lot B; thence
Easterly, along the North line of said Lot B, 30.0 feet
to the Point of Beginning; thence Southerly, parallel
with the West line of said Lots A and B, 130.0 feet;
thence Westerly, parallel with the North line of said Lot
B, 10.0 feet; thence Northerly, parallel with the said
West line of Lots A and B, 130.0 feet to the said North
line of Lot B; thence Easterly, along said North line,
10.0 feet to the said Point of Beginning.
PASSED AND ADOPTED in regular session on this the 22nd day
of April , 1986.
