Res 24-86 RESOLUTION NO. 24-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, VACATING AND ABANDONING CERTAIN UTILITY AND INGRESS/EGRESS EASEMENTS LOCATED WITHIN THE LANDINGS SUBDIVISION, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 42, PAGE 21 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA. WHEREAS, Delray Beach Group Limited Partnership, a limited partnership existing under the laws of the State of Maryland and authorized to do business in the State of Florida, is the fee-simple owner of The Landings Subdivision, as recorded in Plat Book 42, Page 21 of the Public Records of Palm Beach County, Florida; and, WHEREAS, Harold G. Hathaway III, Agent for The Delray Beach Group Limited Partnership, has made application for abandoning certain utility and ingress/egress easements within The Landings Subdivision, as described in Section 1 below; and, WHEREAS, the City Council of the City of Delray Beach, Florida, finds that its interest in the described property is no longer needed for the public good and deems it to be in the best interests of the City of Delray Beach to vacate and abandon said utility and ingress/egress easements located within The Landings Subdivision, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That pursuant to Chapter 166 of the Florida Statutes, it is hereby determined to vacate and abandon all right and interest it holds to the following real property: Those easements as shown on the plat of THE LANDINGS, according to the plat thereof recorded in Plat Book 42 at page 21 of the Public Records of Palm Beach County, F~lorida, described as follows: Commence at the Southeast corner of said plat of THE LANDINGS; thence S.89°33'50"W., along the South line of said plat, 209.33 feet; thence N.0°26'10"W., 32.00 feet o t ,, to the Point of Beginning~ thence continue N.0 26 10 W., 120 00 feet thence S ' " . ; .89 33 50 W., 30.00 feet; thence S.0°26'10"E., 95.00 feet; thence N.89°33'50"E., 12.00 feet: thence S.0°26'10"E., 25.00 feet; thence N.89°33'50"E., 18.00 feet to the said Point of Beginning. AND Commence at the Southeast corner of said plat of THE LANDINGS; thence S.89°33'50"W., along the South line of said plat, 432.66 feet; thence N.0°26'10"W., 32.00 feet to the Point of BeginningL thence continue N.0°26'10"W., 120.00 feet, thence S.89 33 50 W., 30.00 feet, thence S.0°26'10"E., 120.00 feet; thence N.89°33'50"E., 30.00 feet to the said Point of Beginning. AND Co~ence at the Southeast corner of said plat of THE LANDINGS; thence N.6°45'37"W., along the East line of said plat, 142.90 feet to a point of curvature of a curve concave Westerly with a radius of 541.19 feet and a central angle of 15o15'43"; thence Northerly, along the arc of said curve, 144.16 feet; thence N.22°01'20"W., 9.20 feet; thence S.67°58'40"W., 6.00 feet; thence S'73°53'52"W''s 32 17 feet; thence N.22°01'20"W., 37.59 feet; thence .48623'04"W., 50.03 feet to the Point of Beginning of the centerline of the 12 foot utility easement to be herein described; thence S.33°56'45"W., 170.70 feet to the Point of Ending of the centerline of said Easement.
