Res 50-86 RESOLUTION NO. 50-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, OPPOSING THE DISPOSAL OF BEACH QUALITY SAND AT AN OFFSHORE SITE WITHIN PALM BEACH COUNTY. WHEREAS, the U.S. Army Corps of Engineers has need from time to time to perform maintenance dredging from waters within Palm Beach County; and, WHEREAS, the Corps is authorized to investigate offshore ocean sites for the disposal of dredged material and has on many occasions used these sites for depositing of beach-quality sand; and, WHEREAS, the Corps is currently requesting proposals to conduct field surveys to provide for designation of an alternative disposal site offshore Palm Beach Harbor; and, WHEREAS, it is recognized that navigability of inlets must be maintained to promote commercial and recreational uses of coastal waters, it is further recognized that inlets alter the natural drift of beach-quality sand resources; and, WHEREAS, recent state legislation requires all maintenance dredging of beach-quality sand to be placed on downdrift beaches or if placed elsewhere an equivalent quality and quantity of sand from an alternate location be placed on the downdrift beaches at no cost to the State; and, WHEREAS, beach erosion has become a serious menace to the economy and general welfare of the people, Florida Statute 161.088 has declared it to be a necessary governmental responsibility to properly manage and protect Florida's beaches from erosion; and, WHEREAS, the beaches within Palm Beach County have experienced severe erosion and are in desperate need of beach-quality sand; and, WHEREAS, a disposal site south of the Lake Worth Inlet within the shoreline of the Town of Palm Beach has been identified as a suit- able and preferable site for the depositing of beach-quality sand, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the foregoing recitals are hereby affirmed and ratified. Section 2. That the U.S. Army Corps of Engineers be put on notice that the City of Delray Beach is opposed to depositing of beach- quality sand offshore. Section 3. That all coastal Municipalities and Inlet Districts within the County, the Board of County Commissioners, the County's Legislative Delegation, Congressional Representatives of the County and the Governor be notified of the Council's action. Section 4. That all coastal Municipalities and Inlet Districts be encouraged to adopt a similar resolution and forward them to appropriate parties.
