A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH~, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF
COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES
171.062, TO REZONE LAND ANNEXED TO THE CITY OF DELRAY
BEACH FROM THE COUNTY ZONING CLASSIFICATION AG-AGRICUL-
TURAL TO THE CITY'S ZONING CLASSIFICATION R-1AA (SINGLE
FAMILY DWELLING) DISTRICT.
WHEREAS, the City of Delray Beach received a request for annexa-
tion from Thomas F. Fleming, III, on behalf of himself, and as an author-
ized representative for the following named parties:
Amel ia Coury, individual ly, as successor Trustee to
George Coury, Trustee, Deceased, and as Co-Personal Rep-
resentative of the Estate of George Coury, Deceased;
Patrick W. Bell, as Co-Personal Representative of the
Estate of George Coury, Deceased;
Thomas F. Fleming, III, as Co-Trustee for the Benefit of
Janet Fleming Zlanabitnig under Article V of the Last
Will and 'Testament of Thomas F. Fleming, Jr., Deceased;
Anne W. Fleming, as Co-Trustee for the Benefit of Janet
Fleming Zlanabitnig under Article V of the Last Will and
Testament of Thomas F. Fleming, Jr., Deceased;
NCNB National Bank of Florida, as Co-Trustee for the
Benefit of Janet Fleming Zlanabitnig under Article V of
the Last Will and Testament of Thomas F. Fleming, Jr.,
Deceased,
the fee simple owners of the following described property:
PARCEL ONE
The Northwest one-quarter (NW%) of the Southwest one-
quarter (SW%) and the West one-half (W½) of the Northeast
one-quarter (NE%), of the Southwest one-quarter (SW%) of
Section 30, Township 46 South, Range 43 East, said parcel
lying in the MODEL LAND COMPANY'S SUBDIVISION of the
South one-half (S½) of said Section 30, as recorded in
Plat Book 6 at Page 52 of the Public Records of Palm
Beach County, Florida.
PARCEL TWO
The East 274.73 feet of the Northwest Quarter of ~he
Southeast Quarter of the Northwest Quarter, South of
Germantown Road; the Southwest Quarter of the Southeast
Quarter of the Northwest Quarter, LESS the West 185.91
feet; that part of the Northeast Quarter of the Southeast
Quarter of the Northwest Quarter within boundary of the
Lake Worth Drainage District and South of Germantown
Road, West of Canal, in Section 30, Township 46 South,
Range 43 East, Palm Beach County, Florida.
The subject property is located south of Germantown Road,
between the E-4 Canal and Homewood Boulevard, if extended
south.
The above-described parcels contain a 64.89 acre parcel
of land, more or less; and,
WHEREAS, the City Council has considered this annexation request,
approved annexation of the subject parcel and did so by adoption of Ordi-
nance No. 3-85; and,
WHEREAS, in order for this parcel to be zoned to the City Zoning
classification of R-1AA (Single Family Dwelling) Distrigt .subsequent to
its annexation, it is necessary under Chapter 171.062 of the Florida
Statutes for the City to request permission from the Board of County
Commissioners of Palm Beach County, Florida, for the change in zoning of
this parcel which is currently zoned AG-Agricultural; and,
WHEREAS, the proposed zoning for the subject property is con-
sistent with the City's currently existing Land Use Plan designation; and,
WHEREAS, the City Council has determined that the subject prop-
erty is compatible with Palm Beach County's Comprehensive Plan, and the
proposed uses and designations are compatible with existing patterns in
the immediate vicinity of the annexed property,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council hereby requests a waiver from
the Board of County Commissioners of Palm Beach County to immediately
rezone the property described above from AG-Agricultural to R-1AA (Single
Family Dwelling) District which would result in an increase in the density
for such land.
Section 2. That a certified copy of this resolution is being
sent to each member of the Board of County Commissioners, the County
Administrator and the Director of Planning, Zoning and Building.
PASSED AND ADOPTED in regular session on this the 15th day of
January , 1985.
