Res 23-85 RESOLUTION NO. 23-85 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, VACATING AND ABANDONING TRACT "A" AND TRACT "B" OF THE PLAT OF TROPIC ISLE HARBOR SHOPPING CENTER IN SECTIONS 32 AND 33, TOWNSHIP 46 SOUTH, RANGE 43 EAST, DELRAY BEACH, PALM BEACH COUNTY, FLORIDA, AS RE- CORDED IN PLAT BOOK 25, PAGE 77 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA. WHEREAS, Boca Isle Condominium Association, Inc., is the fee- simple owner of Boca Isle - "Pelican Harbor North No. 2" a replat of a portion of Tropic Isle Harbor Shopping Center, as recorded in Plat Book 25, Page 77 of the Public Records of Palm Beach County, Florida; and, WHEREAS, Pelican North, Inc., is the fee-simple owner of that portion of "Tropic Isle Harbor Shopping Center", as recorded in Plat Book 25, Page 77, of the Public Records of Palm Beach County, Florida; and, WHEREAS, Randy S. Kertesz, Vice President of Boca Isle Condomin- ium Association, Inc., and Pelican North, Inc., has made application for abandonment of Tract "A" and Tract "B" of the Plat of Tropic Isle Harbor Shopping Center; and, WHEREAS, ~the City Council of the City of Delray Beach, Florida, finds that its interest in the described property is no longer needed for the public good and deems it to be in the best interests of the City of Delray Beach to vacate and abandon said Tract "A" and Tract "B", NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That pursuant to Chapter 166 of the Florida Statutes, it is hereby determined to vacate and abandon all right and interest it holds to the following described real property: TRACT "A" - That portion of "TROPIC ISLE HARBOR SHOPPING CENTER", as recorded in Plat Book 25, Page 77, of the Public Records of Palm Beach County, Florida, described as follows: Beginning at the northwest corner of said plat; thence, on an assumed bearing of S 89"41'03" E along the north line of said plat, said line also being the north line of Section 32, Township 46 South, Range 43 East, a distance of 225 feet; thence~ South 279.!8 feet to the north right-of-way line of Tropic Isle Drive as shown on said plat; thence, West along said north right-of-way line a distance of 86.14 feet to a point of curvature; thence, northwesterly along said north right-of-way line and along the arc of a curve to the right, having a radius of 222,96 feet and a central angle of 49"06' 38", an arc distance of 191.11 feet to a point on the east right-of- way line of State Road No. 5 (also known as U.S. Highway No. 1) as shown on said plat; thence, N 8"18'22" E along said east right-of-way line a distance of 205.57 feet to the Point of Beginning. Said lands containing 1.476 acres, more or less. TRACT "B" - A portion of the Plat of Tropic Isle Harbor Shopping Center, according to the Plat thereof as re- corded in Plat Book 25, Page 77 of the Public Records of Palm Beach County, Florida, being more pa rticula fly described as follows: COMMENCING at the Northeast corner of said Plat of Tropic Isle Harbor Shopping Center; thence, South a distance of 276.19 feet; thence West a distance of 224.13 feet to the POINT OF BEGINNING; proceeding thence West a distance of 394.73 feet; thence North a distance of 279.18 feet to the North line of said Plat of Tropic Isle Harbor Shop- ping Center; thence S89"41'03"E along said North line a distance of 149.27 feet to the Northeast corner .of Sec- tion 32, Township 46 South, Range 43 East; thence S89" 49'25"E along said North line a distance of 337.37 feet to a point of intersection with a curve to the right; thence Southerly a distance of 129.34 feet along the arc of said curve having a radius of 272.31 feet and a central angle of 27"12'50" to a point of reverse curve to the left; thence Southerly a distance of 135.59 feet along the arc of said curve having a radius of 332.31 feet to a point of reverse curve to the right; thence Southwesterly a distance of 37.52 feet along the arc of said curve having a radius of 25.00 feet and a central angle of 85"59'16" to the POINT OF BEGINNING.
