A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, VACATING AND ABANDONING THE RIGHTS-OF-WAY
AND EASEMENTS IN A PORTION OF THE WEST EL BE PLAT, AS
RECORDED IN PLAT BOOK 15, PAGE 22, OF THE PUBLIC RECORDS
OF PALM BEACH COUNTY, FLORIDA.
WHEREAS, the City of Delray Beach, Florida, is the fee-simple
owner of Lot 14, less the north 7 feet, Lots 15 through' 27, inclusive,
Block 3; Lots 15 through 28, inclusive, Block 7; Lots I through 26, in-
clusive, Block 8 and Lots 1 through 24, inclusive, Block 9, West E1 Be
Subdivision, as recorded in Plat Book 15, Page 22, of the Public Records
of Palm Beach County, Florida; and,
WHEREAS, the City of Delray Beach, Florida, has made application
for abandonment of the rights-of-way and easements in a portion of the
West E1 Be Plat; and,
WHEREAS, the City Council of the City of Delray Beach, Florida,
finds that its interest in the described property is no longer needed for
the public good and deems it to be in the best interests of the City of
Delray Beach to vacate and abandon said rights-of-way and easements in
West E1 Be Subdivision,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That pursuant to Chapter 166 of the Florida Statutes,
it is hereby determined to vacate and abandon the following described real
property:
The rights-of-way and easements within that portion of
the West E1 Be plat lying south of the north line of Lots
15 through 28, Block 7 projected eastward to the west
right-of-way line of the Florida East Coast Railroad,
except for the right-of-way of S.W. 4th Avenue; the north
5 feet of Swinton Avenue; the 5-foot easement along the
north line of Lots 15 through 28, Block 7; and the 5-foot
easement, along the east line of Lots 14 through 27,
Block 3.
PASSED AND ADOPTED in regular session on this the 23rd day of
April , 1985.
