A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, VACATING AND ABANDONING A PORTION OF
TANGELO TERRACE AND ROYAL PALM DRIVE LOCATED WITHIN THE
SUNNY ACRES SUBDIVISION, AS RECORDED IN PLAT BOOK 21,
PAGE 63, OF THE PUBLIC RECORDS OF PALM BEACH COUNTY,
FLORIDA, AND A PORTION OF ROYAL PALM DRIVE LOCATED WITHIN
THE PARK TEN FIRST ADDITION SUBDIVISION, AS RECORDED IN
PLAT BOOK 45, PAGE 167, OF THE PUBLIC RECORDS OF PALM
BEACH COUNTY, FLORIDA.
WHEREAS, Joseph Carosella, General Partner of The Seneca Group,
is the fee-simple owner of the following described property:
The North half (N½) of the West half (W½) of Lot 22,
Section 20, Township 46 South, Range 43 East, Palm Beach
County, Florida, according to the Plat thereof recorded
in Plat Book l, at Page 4 of the Public Records of Palm
Beach County, Florida, lying East of Interstate Highway
No. 95.
Lot 21, Section 20, Township 46 South, Range 43 East,
Palm Beach County, Florida, according to the plat re-
corded in Plat Book 1 at Page 4, Public Records of Palm
Beach County, Florida, less the East 351.85 feet thereof,
less the North 450 feet of the West 400 feet thereof and
less the right-of-way for State Road No. 9 (I-95) as
recorded in Official Records Book 1848, Page 1491, Public
Records of Palm Beach County, Florida, and less the North
50 feet thereof for right-of-way for S.W. 10th Street;
and,
WHEREAS, Beril Kruger, as agent for The Seneca Group, a General
Partnership, has made application for abandonment of a portion of Tangelo
Terrace and Royal Palm Drive, as described in Section 1 below; and,
WHEREAS, the City Council of the City of Delray Beach, Florida,
finds that its interest in the described property is no longer needed for
the public good and deems it to be in the best interests of the City of
Delray Beach to vacate and abandon said rights-of-way in The Sunny Acres
Subdivision and the Park Ten First Addition Subdivision,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That pursuant to Chapter 166 of the Florida Statutes,
it is hereby determined to vacate and abandon the following described real
property:
That part of the right-of-way for Royal Palm Drive and
Tangelo Terrace as shown on the plat of Sunny Acres, Palm
Beach County, Florida, according the plat thereof re-
corded in Plat Book 21 at Page 63 of the Public Records
of Palm Beach County, Florida, described as follows:
Begin at the Northwest corner of Lot 1, Block A of said
plat of Sunny Acres; thence East (assumed) along the
North line of Lots 1, 3 and 5 of said Block A, 301.34
feet to the Northeast corner of said Lot 5; thence N
0"16'00" W, along the Northerly extension of the ' East
line of said Lot 5, 25.00 feet to the North line of said
plat of Sunny Acres; thence West, along said North line,
324.08 feet to the East line of the West half (W½) of Lot
22, Subdivision of Section 20, Township 46 South, Range
43 East, as shown on the plat thereof recorded in Plat
Book 1, at Page 4 of the Public Records of Palm Beach
County, Florida; thence S l°10'00" W, along said East
line, 311.40 feet to the intersection with the Westerly
extension of the South line of Lot 2 of said Block A,
Sunny Acres; thence N 89°44'00" E, along said Westerly
extension, 22.87 feet to the Southwest corner of said Lot
2; thence N l°16'00" E, along the West line of Lots I and
2 of said Block A, 286.30 feet to the said Point of
Beginning.
PASSED AND ADOPTED in regular session on this the 23rd day of
