A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH', FLORIDA, VACATING AND ABANDONING A PORTION OF
RHODES VILLA AVENUE LOCATED WITHIN DELRAY BEACH SHORES, A
SUBDIVISION IN THE COUNTY OF PALM BEACH', FLORIDA, AC-
CORDING TO THE PLAT THEREOF RECORDED IN THE OFFICE OF THE
CLERK OF THE CIRCUIT COURT IN AND FOR PALM BEACH' COUNTY,
FLORIDA, IN PLAT BOOK 23, PAGE 167.
WHEREAS, Magalen Bryant, is the fee-simple owner of Lot 12, and
the North 25 feet of Lot 11, Delray Beach Shores, a subdivision in the
County of Palm Beach, Florida according to the Plat thereof recorded in
the office of the Clerk of the Circuit Court in and for Palm Beach County,
Florida, in Plat Book 23, Page 167; and,
WHEREAS, John W. Spinner, attorney for M~galen Bryant, has made
application for abandonment of a portion of Rhodes Villa Avenue, as de-
scribed in Section 1 below; and,
WHEREAS, the City Council of the City of Delray Beach, Florida,
fidns that its interest in the described property is no longer needed for
the public good and deems it to be in the best interests of the City of
Delray Beach to vacate and abandon said portion of Rhodes Villa Avenue
within the plat of Delray Beach Shores,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That pursuant to Chapter 166 of the Florida Statutes,
it is hereby determined to vacate and abandon all right and interest it
holds to the following described real property:
A part of Rhodes Villa Avenue right-of-way according to the
plat of Delray Beach Shores, Delray Beach, as said plat is
recorded in Plat Book 23, at Page 167, of the Public Records
of Palm Beach County, Florida, said part being more parti-
cularly described as follows: Begin at the Northeast corner
of Lot 11 of said plat of Delray Beach Shores, thence south,
along the East line of said Lot 11, 13.40 feet; thence East
20.10 feet; thence North 13.40 feet to the South line of Lot
12 of said plat of Delray Beach Shores; thence West, along
_ said South line, 20.10 feet to the said point of beginning.
Containing 269 square feet, more or less.
Section 2.~ That this abandonment shall not abandon the easement
dated June 21, 1972, recorded in Official Record Book 2026, Page 191 of
the Public Records of Palm Beach County across the east six (6) feet of
Lot 12.
PASSED AND ADOPTED in regular session on this the 13th day of
August, 1985.
