Res 74-85 RESOLUTION NO. 74-85 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REQUESTING PERMISSION FROM THF BOARD OF COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES 171. 062, TO REZONE LAND ANNEXED TO THE CITY OF DELRAY BEACH' FROM THE COUNTY ZONING CLASSIFICATION IL- LIGHT INDUSTRIAL, TO THE CITY'S ZONING CLASSIFICATION LI (LIGHT INDUSTRIAL) DISTRICT. WHEREAS, the City of Delray Beach received a request for annexa- tion from Beril Kruger & Associates, as agent, for William F. Hagerman, Chairman of Overland Express Inc., a Minnesota Corporation, the fee-simple owner of the following described property: A portion of the west one-half (W½) of Tract 16, Sub- division of Section 20, Township 46 South, Range 43 East, according to the Plat thereof recorded in Plat Book 1, Page 4, of the Public Records of Palm Beach County, Florida, more particularly described as follows: Begin at the northwest corner of said Tract 16; thence run on an assumed bearing of S 89° 27' 00" E 441.38 feet (on an assumed bearing of east 442.52 feet: deed) along the north line of said Tract 16 to a point; thence run S 00° 57' 00" W 196.92 feet (S 1° 25' 54" W 196.92 feet: deed) to a point; thence run N 89° 27' 00" W 441.40 feet (west 442.38 feet: deed) to a point of intersection with the west boundary of said Tract 16, said point also being a point on the centerline of S.W. 4th Avenue; thence run N 00° 57' 19" E 196.92 feet (N 01° 23' 32" E 196.92 feet: deed) along said centerline to the point of beginnning, less the west 25.00 feet thereof, said lands situate, lying and being in Palm Beach County, Florida. The sub3ect property is located on the east side of S.W. 4th Avenue between Linton Boulevard and Southridge Road. The above-described parcel contains a 1.88 acre parcel of land, more or less; and, WHEREAS, the City Council has considered this annexation request by the proposed adoption of Ordinance No. 92-85; and, WHEREAS, in order for this parcel to be zoned to the City Zoning classification of LI (Light Industrial) District subsequent to its annexa- tion, it is necessary under Chapter 171.062 of the Florida Statutes for the City to request permission from the Board of County Commissioners of Palm Beach County, Florida, for the change in zoning of this parcel which is currently zoned IL-Light Industrial; and, WHkREAS, the proposed zoning for the subject property is con- sistent with the City's currently existing Land Use Plan designation; and, %~BE~EAS, the City Council has determined that the subject prop- erty is compatible with Palm Beach County's Comprehensive Plan, and the proposed uses and designations are compatible with existing patterns in the immediate vicinity of the annexed property, NOW, THEREFORE., BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests a waiver from the Board of County Commissioners of Palm Beach County to immediately rezone the property described above from IL-Light Industrial to LI (Light Industrial) District which would not result in an increase in tl'~e density for such land. Section 2. That a certified copy of this resolution is being sent to each member of the Board of County Commissioners, the County Administrator and the Director of Planning, Zoning and Building.
