A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, VACATING AND ABANDONING A PORTION OF
PRINCESS BOULEVARD LOCATED WITHIN SANDS O' SEA SUBDIVI-
SION ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK'
21, PAGE 27 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY,
FLORIDA.
WHEREAS, William C. Rotter and Barbara E. Rotter, his wife, are
the fee-simple owners of Lots 27 and 28, Sands O'Sea Subdivision,
according to the Plat thereof, recorded in Plat Book 21, Page 27 of the
Public Records of Palm Beach County, Florida; and,
WHEREAS, George F. Prado and Mary Prado, his wife, are the
fee-simple owners of Lot 29, Sands O'Sea Subdivision, according to the
Plat thereof, recorded in Plat Book 21, Page 27 of the Public Records of
Palm Beach County, Florida; and,
WHEREAS, Thomas R. DeSimone, is the fee-simple owner of Lot 30,
Sands O'Sea Subdivision, according to the Plat thereof, recorded in Plat
Book 21, Page 27 of the Public Records of Palm Beach County, Florida;
and,
WHEREAS, Penelope M. Wade and William Wade, her husband are the
fee-simple owners of Lot 43, less the south 23 feet thereof, Sands O'Sea
Subdivision, according to the Plat thereof, recorded in Plat Book 21,
Page 27 of the Public Records of Palm Beach County, Florida; and,
WHEREAS, Maureen Kruse, is the fee-simple owner of Lot 44, less
the south 23 feet thereof, Sands O'Sea Subdivision, according to the
Plat thereof, recorded in Plat Book 21, Page 27 of the Public Records of
Palm Beach County, Florida; and,
WHEREAS, Maureen Kruse, Katrina Kruse and Heather Kruse, as
joint tenants with right of survivorship, are the fee-simple owners of
Lots 45 and 46, less the south 23 feet thereof, Sands O'Sea Subdivision,
according to the Plat thereof, recorded in Plat Book 21, Page 27 of the
Public Records of Palm Beach County, Florida; and,
WHEREAS, Barry Garfield, Contract Purchaser and authorized
agent for all above-named property owners, has made application for
abandonment of a portion of Princess Boulevard, as described in Section
1 below; and,
WHEREAS, the City Council of the City of Delray Beach, Florida,
finds that its interest in the described property is no longer needed
for the public good and deems it to be in the best interests of the City
of Delray Beach to vacate and abandon said portion of Princess Boulevard
within the plat of Sands O'Sea,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That pursuant to Chapter 166 of the Florida
Statutes, it is hereby determined to vacate and abandon all right and
interest it holds to the following described real property:
That part of the right-of-way for Princess Boulevard as
shown on the Plat of SANDS O'SEA, according to the plat
thereof recorded in Plat Book 21 at Page 27 of the Public
Records of Palm Beach County, Florida, described as
follows:
Begin at the Northeast corner of Lot 43 of said plat of
SANDS O'SEA; thence West, along the North line of Lots 43
through 46, inclusive, 400.00 feet to the Northwest
corner of said Lot 46; tnence N 2°17'53'' E, 50.04 feet to
the Southwest corner of Lot 27; thence East, along South
line of Lots 27 through 30, inclusive, 400.00 fe~t to the
Southeast corner of said Lot 30; thence S 2°17'53'' W,
50.04 feet to the said Point of Beginning.
PASSED AND ADOPTED in regular session on this the 17th day
of December , 1985.
