A RESOLUTION OF T~E CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, VACATING AND ABANDONING THE SOUTH HALF OF
AVENUE J RIGH%'-OF-%~AY IN ITS ENTIRETY, AVENUE K RIGHT-
OF-WAY IN ITS ENTIRETY, KINGS COUR~ RIGHT-OF-WAY IN IT
ENTIRETY, ALL ALLEYS RIGHTS-OF-~IAY IN THLIR ENTIKETY ~/{D
EASEMENTS IN THEIR ENTIRETY' AS SHOWN ON THE PORTION OF
THE PLAT OF DEL-RATON PARK AS RECORDED IN PLAT BOOK 14,
PAGE 10 OF THE PUBLIC RECORDS OF PAL~ BEACH COUNTY,
FLORIDA.
WHEREAS, Delray Shopping Associates, Ltd., J.J.W. Incorporated,
General Partner J. 5~ichael Pratt, President, are the fee-simple owners of
a portion of the plat of Del-Raton Park, Palm Beach County, Florida,
according to the plat thereof recorded in Plat Book 14, Page 10 of tk~e
Public Records of Palm Beach County, Florida, said portion being bounded
as follows: On the North bY the centerline of Avenue J; on the East by
the West right-of-way line of Florida Boulevard; on the South by the North
right-of-way line of Avenue L; and on the West by the East right-of-wa~
line of U.S. Highway No. 1, said right-of-way line being 38 feet ~.ast of
and parallel with the West line of Blocks 29 and 30 of the said plat of
Del-Raton Park containing 670,421 square feet (15.39 acres); and,
WHEREAS, General Partner J. hichael Pratt, President of Delray
Shopping Associates, Ltd., J.J.W., Incorporated, has made application for
abandonment of the South half of Avenue J right-of-way in its entirety,
Avenue K right-of-way in its entirety, Kings Court right-of-way in its
entirety, all alleys rights-of-way in their entirety and easements in
their entirety as shown on the portion of the plat of Del-Raton Park as
recorded in Plat Book 14, Page 10 of the Public Records of Palm Beach
County, Florida; and,
WHEREAS, the City Council of the City of Delray Beach, Florida,
deems it to be in the best interests of the City of Delray Beach to vacate
and abandon said rights-of-way, alleys and easements in their entirety as
shown on the portion of the plat of Del-Raton Park as recorded in Plat
Book 14, Page 10 of the Public Records of Palm Beach County, Florida,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section i. That pursuant to Chapter 166 of the Florida Statutes,
it is hereby determined to vacate and abandon the followin9 described real
property:
The South half of Avenue J right-of-way in its entirety,
Avenue K right-of-way in its entirety-, Kings Court
right-of-way in its entirety, all alleys rights-of-way in
their entirety and easements in their entirety as shown
on the portion of the plat of Del-Raton Park as recorded
in Plat Book 14, Page 10 of the Public Records of Palm
Beach County, Florida.
Section 2. That the abandonment of the parcel of lana as ~e-
scribed in Section 1 above shall be effected subject to the following:
(1) That a 5' x 20' anchor easement be provided for
installation and maintenance of existing facilities
belonging to Florida Power and Light Company.
