A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF D£LRAY
BEACH, FLORIDA, VACATING AND ABANDONING A SIX (6) FOOT
UTILITY EASEhENT AT THE REAR OF LOTS 7 THROUGH 12, IN-
CLUSIVE BLOCK 14, PLAT 2 OF 2, SOUTHRIDGE, DELRAY BEACH,
PALM BEACH COUNTY, FLORIDA, ACCORDING TO THE PLAT
RECORDED IN PLAT BOOK 13 AT PAGE 39 OF THE PUBLIC RECORDS
OF PALM BEACH COUNTY, FLOkIDA.
WHEREAS, Richard A. Bird, Trustee, is the fee-simple owner of
Lots 7 through 13,, Block 14, Page 2 of 2, Southridge Subdivision, as
recorded in Plat Book 13, Page 39 of the Public Records of Palm Beach
County, Florida; and,
%~EREAS, Richard A. Bird, Trustee, has made application for
abandonment of the south six (6) feet of Lots 8, 9, 10, 11 and the south
six (6) feet of the east 38 feet of Lot 12 and the south six (6) feet of
the west 48 feet of Lot 7, Block 14, Plat 2 of 2, Southridge bubdivision,
Delray Beach, Palm Beach County, Florida, according to the Plat thereof
recorded in Plat Book 13 at Page 39 of the Public Records of Palm Beach
County, Florida; and,
WHEREAS, the City Council of the City of De lray Beach, Florida
deems it to be in the best interests of the City of Delray Beach to vacate
and abandon said six (6) foot utility easement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLL~4S:
section 1. That pursuant to Chapter 166 of the Florida btatutes,
it is hereby determined to vacate and abandon the following descrlbed real
property:
The south six (6) feet of Lots 8, 9, 10, 11 and the south
six (6) feet of the east 38 feet of Lot 12 and the south
six (6) feet of the west 48 feet of Lot 7, Block 14, Plat
2 of 2, Southridge Subdivision, Delray Beach, Palm Seacn
County, Florida, according to the Plat thereof recorded
in Plat Book 13 at Page 39 of the Public Records of Palm
Beach County, Florida.
Section 2. That the abandonment of the parcel of land as de-
scribed in Section 1 above shall be effected subject to the following:
(1) That a new easement for telephone facilities be
provided to serve the above properties and adjacent
properties.
