Res 11-84 RESOLUTION NO. 11-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY QF DELRAY BEACH, FLORIDA, VACATING AND ABANDONING A PORTION OF AVENUE "E" ACCORDING TO THE PLAT OF DLL-RATON PA~K, PAi.[,t BEACH COUNTY, FLORIDA, AS RECORDED IN PLAT BOOK 14 AT PAGES 9 AND 10 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORI DA. WHEREAS, Donald Ralph is the fee-simple owner of Lots 12 thru 33 inclusive, Block 22; Lots 1 thru 20 inclusive, Block 23; Lots 1 thru 10 inclusive, Block 35;. Lots 57 thru 66 inclusive, Block 35; and Lots 12 thru 33 inclusive, Block 36; Del Raton Park, Delray Beach, Florida, together with the right-of-way of Frederick Boulevard adjacent thereto, less the Westerly 38.0 feet, as measured at right angles, of Lots 12 thru 22 inclu- sive, Block 22; and less the Westerly. 38.0 feet, as measured at rig'ht angles, of Lots 1 thru 10, inclusive, Block 23; all in Del-Raton Park, Delray Beach, Florida; and, %/HEREAS, Donald Ralph has made application for abandonment of that portion of Avenue "E" lying north of Lahat Avenue between Federal Highway and Florida Boulevard;. and, .." WHEREAS, the City Council of the City of Delray Beach, Florida, deems it to be in the best interests of the City of Delray Beach to vacate and abandon the above-described parcel of land, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: section' I', That pursuant to Chapter 166 of the Florida Statutes, it is hereby determined to vacate and abandon the following described real property: A part of the right-of-way of Avenue "E" according to the Plat of DEL-RATON PARK, Palm Beach County, Florida, as recorded in Plat Book 14 at pages 9 and 10 of the public records of Palm Beach County, Florida, said part being bounded as follows: On the West by the Easterly right-of-way line of U. $. Highway No. 1 (S.R. 5); on the East by the Westerly right-of-way line of Florida Boulevard as shown on said Plat; on the North by Blocks 22 and 36 o'f said Plat and by a portion of the abandoned right-of-way of Frederick Boulevard; on the South by Blocks 23 and 35 of said Plat and by a portion of the abandoned right-of-way of Frederick Boulevard. Containing 23,908 square feet, more or less. section 2. That the abandonment of the parcel of land as de- scribed in Section 1 above shall be effected subject to the following: (1) That a 15' easement be reserved for the existin9 sewer force main along Avenue "E" from Florida Boulevard to Federal Highway.
