A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, FINDING THE NECESSITY FOR AND APPROVING
AN EXPANSION OF THE GEOGRAPHIC AREA WITHIN THE CITY
LIMITS OF THE CITY OF DELRAY BEACH, FLORIDA, AS AN
ENTERPRISE ZONE; PROVIDING FOR APPLICATION FOR SUCH
EXPANDED ENTERPRISE ZONE.
WHEREAS, the City Council of the City of Delray Beach, Florida has deter-
mined the need for the benefits of the "Tax Credits for New Jobs", as set forth in
Section 220. 181, Florida Statutes; and,
WHEREAS, it is required by the Rules of the Department of Veteran and
Community Affairs, Division of Local Resource Management, in Chapter 93-15, that such
benefits can only be accrued upon designation of an area(s) as enterprise zone(s) in
accordance with Chapter 290, Florida Statutes; and,
WHEREAS, the City Council of the City of Delray Beach, Florida, by Resolu-
tion No. 44-83, has previously designated an area within the City limits of the City of
Delray Beach, Florida, as such an enterprise zone; and,
WHEREAS, the area to be found within the following boundaries (being an
expansion of the previously designated boundaries of the enterprise zone) (generally
being on the north by Northwest Fourth Street and Lake Ida Road, on the east by the
Florida East Coast Railway right-of-way, on the west by Congress Avenue, and on the
south by Linton Boulevard), and more particularly described as follows:
On the north, beginning at the intersection of the F.E.C. Railroad
and N.E. 4th Street, thence run westerly along N.E. 4th Street
and Lake Ida Road to the Seaboard Air Line Railroad; thence run
northerly along the Seaboard Air Line Railroad to LWDD Canal No.
L-30; thence run westerly along LWDD Canal No. L-30 to Congress
Avenue; thence run southerly along Congress Avenue to LWDD
Canal No. E-4; thence run southerly along LWDD Canal No. E-4 to
a point where the southern boundary line of Congress Park South
subdivision intersects with LWDD Canal No. E-4; thence run
easterly along the southern boundary line of Congress Park South
subdivision to Congress Avenue; thence run southerly along
Congress Avenue to Linton Boulevard; thence run westerly along
Linton Boulevard to LWDD Canal No. E-4; thence run southerly
along LWDD Canal No. E-4 to Germantown Road; thence run
easterly along Germantown Road to a point where the eastern
boundary line of The Environment I subdivision intersects with
Germantown Road; thence run southerly along the eastern boundary
line of The Environment I subdivision to LWDD Canal No. L-37;
thence run easterly along LWDD Canal No. L-37 to point where the
eastern boundary line of Sabal Pine South Phase II subdivision
intersects the LWDD Canal No. L-37; thence follow the eastern and
southern boundary lines of Sabal Pine South Phase II subdivision to
S.W. 29th Street; thence run southeasterly and then easterly along
S.W. 29th Street to Congress Avenue; thence run southerly along
Congress Avenue to SFWD Canal No. C-15; thence run easterly
along SFWD Canal No. C-15 to a point where the eastern
right-of-way line of 1-95 intersects SFWD Canal No. C-15; thence
run northerly along the eastern right-of-way line of 1-95 to
Audubon Boulevard; thence run easterly along Audubon Boulevard
to Dotterel Road; thence run northeasterly along Dotterel Road to
Lindell Boulevard; thence run northwesterly along Lindell Boulevard
to S.W. 10th Avenue; thence run northeasterly along S.W. 10th
Avenue to Linton Boulevard; thence run westerly along Linton
Boulevard to Germantown Road; thence run northeasterly along
Germantown Road to S.W. 10th Street; thence run easterly along
S.W. 10th Street to the F.E.C. Railroad; thence run northerly
along the F.E.C. Railroad to point of beginning,
are characterized as the real area in which there are such substantial slum, deterio-
rated or deteriorating structures, high density population and overcrowded condition,
high unemployment, a predominance of inadequate and deteriorating streets, and general
unsafe conditions for the residents of the area; and,
WHEREAS, the City Council of the City of Delray Beach, Florida, wishes to
assist in providing the necessary means to assist the City's residents and the private
sector in creating the proper economic and social environment to induce the investment
of private resources in productive business enterprises in this area and to help provide
jobs for residents of this area; and,
WHEREAS, the City Council of the City of Delray Beach, Florida, find such
conditions existing, wishes to adopt this Resolution and make appropriate application to
expand the boundaries of the enterprise zone.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the expanded area defined above is found to meet the
criteria and factors set forth in Chapter 290, Florida Statutes, and as such, is found to
be an enterprise zone.
Section 2. That rehabilitation and redevelopment activities are necessary in
the interest of the public safety and welfare of the residents of the City of Delray
Beach, Florida.
Section 3. That the City administration is hereby authorized and directed to
make proper application to expand the boundaries of the City's enterprise zone in
accordance with this Resolution.
PASSED AND ADOPTED in regular session on this the 8~:1~ day of
