Res 47-84 RESOLUTION NO. 47-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, FINDING THE NECESSITY FOR AND APPROVING AN EXPANSION OF THE GEOGRAPHIC AREA WITHIN THE CITY LIMITS OF THE CITY OF DELRAY BEACH, FLORIDA, AS AN ENTERPRISE ZONE; REPEALING RESOLUTION NO. }9-84 WHICH PREVIDUSLY DESIGNATED THE ENTERPRISE ZONE; PROVIDING FOR APPLICATION FOR SUCH EXPANDED ENTERPRISE ZONE. WHEREAS, the City Council of the City of Delray Beach, Florida, has determined the need for the benefits of the "Tax Credits for New Jobs", as set forth in Section 220.181, Florida Statutes; and, WHEREAS, it is required by the Rules of the Department of reran and Community Affairs, Division of Local Resource Management, Chapter 93-15, that such benefits can only be accrued upon designation of an area(s) as enterprise zone(s) in accordance with Chapter 290, Florida Statutes; and, WHEREAS, the City Council of the City of Delray Beach, Florida, by Resolution No. ~-83, has previously designated an area within the City limits of the City of Delray 8each, Florida, as such an enterprise zone; and, WHEREAS, the City Council of the City of Delray Beach, Florida, did subsequently adopt Resolution No. )9-84, which sets forth expanded boundaries for said enterprise zone, and that the City Council ~s now wish to clarify the boundaries of the expanded enterprise zone repealing Resolution No. ~9-84 and enacting this Resolution in its ad; and, WHEREAS, the area to be found within the following boundaries eing a revised expansion of the originally designated boundaries of the enterprise zone) (generally being on the north by Northwest Fourth Street and Lake Ida Road, on the east by Swinton Avenue, on the west by Congress Avenue, and on the south by Audubon Boulevard), and more particularly described as follows: On the north, beginning at the intersection of N.W. 4th Street and Swinton Avenue, thence run westerly along N.W. 4th Street and Lake Ida Road to Depot Road; thence run southwesterly along Depot Road to the LWDD Canal No. L-}2; thence run westerly along LWDD Canal No. L-52 to the LWDD Canal No. E-~; thence run southerly along LWDD Canal No. E-4 to a point where the southern boundary line of Congress Rark South subdivision intersects with LWDD Canal No. E-4; thence run easterly along the southern boundary line of Congress Rark South subdivision to Congress Avenue; thence run southerly along Congress Avenue to Linton Boulevard; thence run westerly along Linton Boulevard to LWDD Canal No. thence run southerly along LWDD Canal No. E-4 to Germantown Road; thence run easterly along Germantown Road to a point where the ea'~tern right-of-way line of 1-95 intersects Germantown Road; thence run southerly along the eastern right-of-way line of I-~5 to the LWDD Canal No. L-57; thence run easterly along the LWDD Canal No. L-57 to a point on the east Section line of Section 30, Township 46 South, Range 43 East; thence southerly along said Section line to a point at the intersection of the westerly projection of the north right-of-way of Audubon Boulevard; thence run easterly along said projection line to the north right-of-way line of said Audubon Boulevard; thence continue easteriy along Audubon Boulevard to Dotterel Road; thence run northeasteriy aiong Dotterei Road to LindeIi Boulevard; thence run northwesterly along Lindell Boulevard to Germantown Road; thence run southwesteriy along Germantown Road to a point where the eastern right-of-way line of 1-95 intersects Germantown Road; thence run northerly aiong the eastern right-of-way iine of 1-95 to Linton BouIevard; thence run easterIy along Linton Boulevard to Germantown Road; thence run northeasterly along Germantown Road to S.W. loth Street; thence run easterly along S.W. lOth Street to Swinton Avenue; thence run northerly along Swinton Avenue to point of beginning, is characterized as the real area in which there are such substantial slum, deteriorated or deteriorating structures, high density population and overcrowded conditions, high unemployment, a predominance of inadequate and deteriorating streets, and generai unsafe conditions for the residents of the area; and, WHEREAS, the City Councii of the City of Delray Beach, FIorida, wishes to assist in providing the necessary means to assist the City's residents and the private sector in creating the proper economic and sociaI environment to induce the investment of private resources in productive business enterprises in this area and to heip provide jobs for residents of this area; and WHEREAS, the City Council of the City of Deiray Beach, Fiorida, find such conditions existing, wishes to adopt this Resoiution and make appropriate appiication to expand the boundaries of the enterprise zone. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section i. That Resoiution No. 39-84 be, and the same is hereby repealed. Section 2. That the expanded area defined above is found to meet the criteria and factors set forth in Chapter 290, Fiorida Statutes, and as such, is found to be an enterprise zone. Section 3. That rehabilitation and redeveiopment activities are necessary in the interest of the pubiic safety and welfare of the residents of the City of Delray Beach, Fiorida. Section 4. That the City administration is hereby authorized and directed to make proper appIication to expand the boundaries of the City's enterprise zone in accordance with this ResoIution.
