Res 52-84 RESOLUTION NO. 52-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, VACATING AND ABANDONING THE EAST SIX FEET OF A TWELVE FOOT UTILITY EASEMENT WITHIN LOT 26, BLOCK 8, PLAT NO. 1, CHATELAINE SUBDIVISION, AS RECORDED IN PLAT BOOK 29, PAGES 94 AND 95 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA. WHEREAS, Earl Shelton and Kate P. Shelton, his wife, are the fee-simple owners of Lot 26, Block 8, Plat No. 1, Chatelaine Subdivision, as recorded in Plat Book 29, Pages 94 and 95 of the Public Records of Palm Beach County, Florida; and, WHEREAS, Earl Shelton and Kate P. Shelton, his wife, have made application for abandonment of the east six feet of a twelve foot utility easement within Lot 26, Block 8, Plat No. 1, Chatelaine Subdivision, as recorded in Plat Book 29, Pages 94 and 95 of the Public Records of Palm Beach County, Florida; and, WHEREAS, the City Council of the City of Delray Beach, Florida, deems it to be in the best interests of the City of Delray Beach to vacate and abandon the above-described parcel of land, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That pursuant to Chapter 166 of the Florida Statutes, it is hereby determined to vacate and abandon the following described real property: The east six feet of Lot 26=, less that part lying north of a line 85.00 feet north of and parallel with the south line of said Lot 26, Block 8, Plat No. 1, CHATELAINE, Delray Beach, Palm Beach County, Florida, according to the Plat thereof recorded in Plat Book 29, Pages 94 and 95 of the Public Records of Palm Beach County, Florida. PASSED AND ADOPTED in regular session on this the 10th day of July , 1984. ATTEST: City Clerk
