Res 56-84 RESOLUTION NO. 56-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES 171.062, TO REZONE LAND ANNEXED TO THE CITY OF DELRAY BEACH FROM THE COUNTY ZONING CLASSIFICATION RH (RESIDEN- TIAL HIGH DENSITY) TO THE CITYtS ZONING CLASSIFICATION SAD (SPECIAL ACTIVITIES DISTRICT). WHEREAS, the City of Delray Beach received a request for annexa- tion from Robert D. Chapin, representative for Walter J. Hatcher and Joyce B. Hatcher, his wife, the fee-simple owners of the property described below as Parcel Ii Utiel Development Corp., S.A., the fee-simple owner of the property described below as Parcel 2 and Ellis Chingos, the fee-simple owner of the property described below as Parcel 3= PARCEL 1. The North half (N½) of Northeast quarter (NEt) of North- east quarter (NE%) of Northwest quarter (NW%) (less three acres lying within Lake Worth Drainage District) Section 29, Township 46 South, Range 43 East, as per plat re- corded in the office of the Clerk of the Circuit Court of Palm Beach County, Florida. LESS= The North 53 feet of the North ½ of the NEt of the NEt of the NW% of Section 29, Township 46 South, Range 43 East, Palm Beach County, Florida. LESS 3 acres lying within the Lake Worth Drainage District. and The North 53 feet of the NW% of the NW% of the NEt of Section 29, Township 46 South, Range 43 East, Palm Beach County, Florida, lying outside of the Lake Worth Drainage District Boundary. Less road rights-of-way. PARCEL f. The NW% of the NW% of the NE% of Section 29, Township 46 South, Range 43 East, Palm Beach County, Florida, lying outside of the Lake Worth Drainage District boundary. LESS rights-of-way for S.W. 12th Street. PARCEL 3. Lots 7, 8, 9 and 10 (Less the North 28 feet thereof) and Lots 15,'16, 17 and 18, all in Block 1, WEST EL BE, according to the Flat thereof recorded in Plat Book 15, Page 22, of the Public Records of Palm Beach County, Florida, and Lots i thru 6, all inclusive, and Lots 11 and 12 less the North 28 feet thereof for road right of way; Lots 13 and 14, and Lots 19 thru 24, all inclusive, in BLOCK 1; ALSO, Lots 1 thru 24, all inclusive, in BLOCK 5; and Lots 1 thru 12, all inclusive, in BLOCK 6; of WEST EL BE ADDI- TION, as shown in Plat Book 15, Page 22 of the Public Records of Palm Beach County, Florida; being a part of Section 29, Township 46 South, Range 43 East, Palm Beach County. The subject property is located on the south side of Linton Boulevard between S.W. 4th Avenue and S.W. 10th Avenue. The above-described parcels contain an 18 acre parcel of land, more or less; and, WHEREAS, the City Council has considered this annexation request, approved annexation of the subject parcel and did so by adoption of Ordi- mance No. 53-84; and, WHEREAS, in order for these parcels to be zoned to the City Zoning classification of SAD (Special Activities) District subsequent to its annexation, it is necessary under Chapter 171.062 of the Florida Statutes for the City to request permission from the Board of County Commissioners of Palm Beach County, Florida, for the change in zoning of these parcels which are currently zoned RH (Residential High Density); and, WHEREAS, the proposed zoning for the subject property is con- sistent with the City's currently existing Land Use Plan designation; and, WHEREAS, the City Council has determined that the subject prop- erty is compatible with Palm Beach County's Comprehensive Plan, and the proposed uses and designations are compatible with existing patterns in the immediate vicinity of the annexed property, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests a waiver from the Board of County Commissioners of Palm Beach County to immediately rezone the property described above from RH (Residential High Density) to SAD (Special Activities) District which would not result in an increase in the density for such land. Section 2. That a certified copy of this resolution is being sent to each mlember of the Board of County .Commissioners, the County Administrator and the Director of Planning, Zoning and Building.
