A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF
COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES
171.062, TO REZONE LAND ANNEXED TO THE CITY OF DELRAY
BEACH FROM THE COUNTY ZONING CLASSIFICATION CG-GENERAL
COMMERCIAL, IN PART, AND RM-RESIDENTIAL MEDIUM DENSITY,
IN PART, TO THE CITY'S ZONING CLASSIFICATION SAD (SPECIAL
ACTIVITIES DISTRICT).
WHEREAS, the City of Delray Beach received a request for anneXa-
tion from Russell C. Chase, as agent, for Frank J. Keller and Ruth E.
Keller, his wife, the fee-simple owners of the property described below as
Parcel 1; Elvin D. Dorwart and Beryl M. Dorwart, his wife, the fee-simple
owners of the pr,'~perty described below as Parcel 2; Henry Wish, the fee-
simple owner of the property described below as Parcel 3; Ruth F. Wish,
the fee-simple owner of the property described below as Parcel 4 and John
M. Ghent and Marianne M. Ghent, his wife, the fee-simple owners of the
property described below as Parcel 5:
PARCEL 1.
The northerly seventy-five (75) feet of Lots 40, 41, 42,
43 and 44, Block 32 and all of Lots 45 and 46, Block 32,
Del-Raton Park Subdivision, according to the Plat thereof
as recorded in Plat Book 14, Page 10 of the Public Rec-
ords of Palm Beach County, Florida.
PARCEL 2.
The south fifty (50) feet of Lots 40, 41, 42, 43 and 44,
Block 32, Del-Raton Park Subdivision, according to the
Plat thereof as recorded in Plat Book 14, Page 10 of the
Public Records of ~alm Beach County, Florida, less the
right-of-way for U.S. Highway No. 1.
PA~EL 3.
Lots 47 and 48, Block 32, Del-Raton Park Subdivision,
according to the Plat thereof as recorded in Plat Book
14, Page 10 of the Public Records of Palm Beach County,
Florida.
PARCEL 4.
Lots 49 and 50, Block 32, Del-Raton Park Subdivision,
according to the Plat thereof as recorded in Plat Book
14, Page 10 of the Public Records of Palm Beach County,
Florida.
PARCEL 5.
Lots 51, 52, 53 and 54, Block 32, Del-Raton Park Subdivi-
sion, according to the Plat thereof recorded in Plat Book
14, Page 10 of the Public Records of Palm Beach County,
Florida.
The subject property is located at the southeast corner
of the intersection of Avenue "L" and South Federal
Highway.
The above-described parcels contain a 0.986 acre parcel
of land, more or less; and,
WHEREAS, the City Council has considered this annexation request,
approved annexation of the subject parcel and did so by adoption of Ordi-
nance No. 82-84; and,
WHEREAS, in order for these parcels to be zoned to the City
Zoning classification of SAD (Special Activities) District subsequent to
its annexation, it is necessary under Chapter 171.062 of the Florida
Statutes for the City to request permission from the Board of County
Commissioners of Palm Beach County, Florida, for the change in zoning of
these parcels which are currently zoned CG-General Commercial, in part,
and RM (Residential Medium Density) in part; and,
WHEREAS, the proposed zoning for the subject property is consis-
tent with the City's currently existing Land Use Plan designation; and,
WHEREAS~ the City Council has detezmined that the subject prop-
erty is compatible with Palm Beach County's Comprehensive Plan, and the
proposed uses and designations are compatible with existing patterns in
the immediate vicinity of the annexed property,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE C~T~ OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council hereby requests a waiver from
the Board of County Commissioners of Palm Beach County to immediately
rezone the property described above from CG-General Commercial, in part,
and RM (Residential Medium Density) in part, to SAD (Special Activities)
District which would not result in an increase in the density for such
land.
Section 2. That a certified copy of this resolution is being
sent to each member of the Board of County Commissioners, the County
Administrator and the Director of Planning, Zoning and Building.
PASSED AND ADOPTED in regular session on this the 9th day of
October , 1984.
