A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH,
FLORIDA, PURSUANT TO THE CHARTER OF THE CITY OF DELRAY
BEACH, AND SECTION 2-7(b) OF THE CODE OF ORDINANCES OF THE
CITY OF DELRAY BEACH, FLORIDA, AUTHORIZING THE EXCHANGE OF
REAL PROPERTY OWNED BY THE CITY OF DELRAY BEACH LOCATED IN
SECTION 8, TOWNSHIP ~6 SOUTH, RANGE ~3 EAST.
WHEREAS, the City of Delray Beach, Florida, is the owner of a parcel of property which is
a portion of the Northwest one-quarter (NW~) of Section 8, Township && South, Range ~3 East, Delray
Beach, Palm Beach County, Florida, being more particularly described as follows:
COMMENCING AT THE NORTHWEST CORNER OF SAID SECTION
THENCE S.00°~3~21~E., ON AN iASSUMED BEARING, ALONG THE WEST
LINE OF SAID SECTION 8, A DISTANCE OF 1361.61 FEET; THENCE
S.89°Z~8~5~E., A DISTANCE OF 250.39 FEET TO THE POINT OF BEGINNING

SAID LANDS SITUATE, LYING AND BEING IN PALM BEACH COUNTY,
FLORIDA AND CONTAINING 5.838 ACRES, MORE OR LESS; and,
WHEREAS, the City Council of the City of Delray Beach has previously discussed and is of
the opinion that it would be in the best interest of the City to exchange the above-referenced real
property owned by the City for the above-referenced real property owned by the SheU Oil Corporation,
upon the terms and conditions set forth in this Resolution. Such property to be exchanged on an equal
basis with neither party paying any additional consideration. However, the City shall require Shell Oil
Corporation to convey an easement deed to the City of Delray Beach simultaneously with this
exchange of property. The easement shall grant the City the use of and access to the property as is
necessary for the maintenance of existing water and sewer lines and facilities. Closing costs will be
paid as follows: Documentary stamps or other transfer taxes to be paid one-half by each party.
Survey costs and owners title insurance policy to be paid by the owner(s) of the property to be given in
the exchange; and recording fees to be paid by each party respectively.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council of the City of Delray Beach, Florida does hereby
