AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF DELRAY BEACH, FLORIDA, AMENDING TITLE III,
"ADMINISTRATION", CHAPTER 36, "FINANCE; CITY
PROPERTY TRANSACTIONS", SECTION 36.04,
"ACQUISITION OF REAL PROPERTY", OF THE CODE OF
ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA,
TO PROVIDE THAT THE PUBLICATION OF THE TERMS AND
CONDITIONS OF THE PURCHASE OF PROPERTY SHALL NOT
BE NECESSARY IN THE EVENT THE CITY HAS
AUTHORIZED THE USE OF ITS EMINENT DOMAIN POWERS;
PROVIDING A SAVING CLAUSE; PROVIDING A GENERAL
REPEALER CLAUSE; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Title III, "Administration", Chapter
36, "Finance; City Property Transactions", Section 36.04,
"Acquisition of Real Property", of the Code of Ordinances of the
City of Delray Beach, Florida, be, and the same is hereby amended
to read as follows:
Sec. 36.04 ACQUISITION OF REAL PROPERTY
Whenever, in the opinion of the City Commission,
it would be in the best interest of the City to
purchase certain real property which would be required
for
municipal purposes, the Commission is authorized
and empowered to make that purchase at the price and
upon the terms and conditions it deems to be in the
best interest of the city. ~~//~f~//~

city has authorized the use of its eminent domain
owers for the ~urchase of real ~ropert~, a notice o~
nat purchase, setting forth the terms and conditions
of any purchase of real property, shall be first
published once a week for at least two weeks in a
newspaper of general circulation published in the city
before adoption by the Commission of a resolution
authorizing the purchase of the property at the price
and on the terms and conditions set forth therein.
Section 2. That should any section or provision of
this ordinance or any portion thereof, any paragraph, sentence or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the validity or the
remainder hereof as a whole or part thereof other than the part
declared to be invalid.
Section 3. That all ordinances or parts of ordinances
which are in conflict herewith are hereby repealed.
Section 4. That this ordinance shall become effective
immediately upon passage on second and final reading.
PASSED AND ADOPTED in regular session on second and
final reading on this the 12th day of Februar~ 1991.
