12-91 ORDINANCE NO. 12-91 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 4, "ZONING REGULATIONS", ARTICLE 4.3, "DISTRICT REGULATIONS, GENERAL PROVISIONS", SECTION 4.3.4, "BASE DISTRICT DEVELOPMENT STANDARDS", SUBSECTION 4.3.4(H), "SETBACKS", OF THE LAND DEVELOPMENT REGULATIONS OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY ENACTING SUB-SUBSECTION 4.3.4(H) (4), "STRUCTURES ALLOWED IN SETBACKS", PARAGRAPHS (k), (1), (m), (n), TO PROVIDE ADDITIONAL STRUCTURES WHICH ARE ALLOWED IN SETBACK AREAS; BY AMENDING SUB-SUBSECTION 4.3.4(H) (5), "SETBACKS FOR SCREEN PORCHES, SCREEN ENCLOSURES, AND ACCESSORY STRUCTURES IN REAR YARDS", BY DESIGNATING PARAGRAPH (e) AS PARAGRAPH (f) AND BY ENACTING A NEW PARAGRAPH 4.3.4(H) (5) (e); TO PROVIDE FOR AN EXTENSION OF SCREENED ENCLOSURES IN ZERO LOT LINE DEVELOPMENTS INTO THE INTERIOR SIDE SETBACK; BY ENACTING A NEW SUB-SUBSECTION 4.3.4(H) (7), "REDUCTION ALONG CUL-DE-SACS", TO PROVIDE FOR REDUCTION OF THE FRONT BUILDING SETBACK WHEN AT LEAST FIFTY PERCENT (50%) OF THE FRONTAGE OF A LOT IS LOCATED ON A CUL-DE-SAC; PROVIDING A SAVING CLAUSE; PROVIDING A REPEALER CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 4, "Zoning Regulations", Article 4.3, "District Regulations, General Provisions", Section 4.3.4, "Base District Development Standards", Subsection 4.3.4(H), "Setbacks", Sub-subsection 4.3.4(H) (4), "Structures Allowed In Setbacks", of the Land Development Regulations of the City of Delray Beach, Florida, be, and the same is hereby amended by enacting new paragraphs (k), (1), (m) and (n) to read as follows: (k) Steps and platforms for the principal buildinq but not to exceed three (3) feet in height'. (1) Trellises which may extend to no more than five (5) feet from the side of the p~in~$p~l ~p.~ldin9 or extend more than two (2) feet from the front or rear o~ the principal building. (m) Boat sli~s, whether attached or deta.che~,' which shall not be built closer than ten (10) feet from any abutting prop~t~ line, and which shalL'not occupy more than twenty percent (20%) of the t6ta% lot area. (D) Canopies, marquees, and covered walkway~ mgy extend within front and side setback areas commercial zone districts. Section 2. That Chapter 4, "Zoning Regulations", Article 4.3, ~District Regulations, General Provisions", Section 4.3.4, "Base District Development Standards", Subsection 4.3.4(H), "Setbacks", Sub-subsection 4.3.4(H) (5), "Setbacks for screen porches, screen enclosures, and accessory structures in rear yards", of the Land Development Regulations of the City of Delray Beach, Florida, be, and the same is hereby amended to read as follows: 4~KJ~ (5) Setbacks for screen porches, screen ~ enclosures, and accessory structures in rear y~ds: PR~IDING,~, ~II /~ /~ /f~lZ~Wd ~ Setbacks for screen ~o~ches, screen enclosures and accessory structures in rear yards shall comply with the followinq r.equirement: (e) In zero lot line developmeDts only, screened enclosures may extend into the interior side setbac~ a~eas, and shall not be pla~e~ less than five (5) feet from the property .~ine, or exceed 35% of the net livin~ area exclusive of ~ar~e.s, balconies, decks, porches, and co~on areas such as corridors. (~ ~) ~y conflicts between this subsection (5), and the regulations as set forth in individual residential zoning districts shall be governed by the provisions of this subsection. Section 3. That Chapter 4, "Zoning Regulations", ~ticle 4.3, "District Regulations, General Provisions", Section 4.3.4, "Base District Development Standards", Subsection 4.3.4 (H) , "Setbacks", Sub-subsection 4.3.4 (H) , "Setbacks for screen porches, screen enclosures, and accessory structures in rear yards", of the Land Development Regulations of the City of Delray Beach, Florida, be, and the same is hereby amended by enacting a new paragraph (7) to read as follows: (7) Reduction.a~on.~ cul-de-sacs: When at least fifty percent (50%) of the frontaqe of a lot is located on a cul-de-sac, the front ~uilding setbabk may' be reduced by five (5) fe6t. Section 4. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 5. That all ordinances or parts of ordinances which are in conflict herewith are hereby repealed. Section 6. That this ordinance shall become effective ten (10) days after its passage on second and final reading.
