Res 06-83 RESOLUTION NO. 6-83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ACCEPTING ALL THE STREETS INSTALLED IN FAIRCREST HEIGHTS, AS RECORDED IN PLAT BOOK 42, PAGES 68 AND 69 of the PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, AS OPERATIONAL; PROVIDING THAT THIS RESOLUTION SHALL NOT DISCHARGE THE DEVELOPER FROM STRICT PERFORMANCE; PROVIDING FOR MAINTENANCE FOR AND REPAIRS BY THE DEVELOPER FOR ONE YEAR. WHEREAS, James D. Carlton, Inc., Consulting Engineers and Land Surveyors for the above mentioned project have certified all streets and storm drains as shown on their approved plans for said project have been com- pleted and ready for use by the public; and, WHEREAS, the said streets and storm drains were inspected and approved by the City of Delray Beach Engineering Department. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That all streets, and related facilities have been installed in Faircrest Heights, as recorded in Plat Book 42, Pages 68 and 69 of the Public Records of Palm Beach County, Florida, and are hereby accepted by the City of Delray Beach as being operational, and shall become effective upon'the date of passage and adoption of this resolution. Section 2. That nothing contained herein shall be construed as discharging the Developer, Chrisdon Builders and Realty Corporation, from strict performance of this Corporation's contractual obligations and duties, and that this Corporation's bond (escrow account) shall remain in effect in all respects until released in accordance with this Corporation's agreement with the City. Section 3. That the Developer, Chrisdon Builders and Realty Cor- poration, shall be responsible for maihtenance and repairs of all the streets installed in Faircrest Heights as recorded in Plat Book 42, Pages 68 and 69 of the Public Records of Palm Beach County, Florida, for a period of one year after acceptance of this resolution by the City of Delray Beach Council.
