Res 70-83 RESOLUTION NO. 70-83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, EXPRESSING THE APPRECIATION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH TO PALM BEACH COUNTY COMMISSIONER DOROTHY WILKEN, EXPRESSING A DESIRE TO ENTER INTO AN INTERLOCAL GOVERNMENTAL AGREEMENT PURSUANT TO FLORIDA STATUTES SECTION 163.3171 (1), AND DIRECTING THAT STAFF LEVEL MEETINGS CONTINUE. WHEREAS, the City of Delray Beach has a reserve annexation area consisting of portions of unincorporated Palm Beach County; and, WHEREAS, it is contemplated that these unincorporated properties will eventually be annexed into the City of Delray Beach; and, WHEREAS, fundamental principals of planning dictate that development and use should occur pursuant to a comprehensive plan and in a consistent, uniform manner; and, WHEREAS, there are conflicting provisions between the City and County codes and plans; and, WHEREAS, the Local Government Comprehensive Planning Act of 1975 provides for interlocal governmental agreements whereby municipalities can exercise agreed upon jurisdiction over unincorporated areas; and, WHEREAS, municipal jurisdiction over the development and use of those unincorporated areas which are contemplated to be annexed into the municipal limits of the City of Delray Beach is in the public interest for the general welfare of the citizens of Palm Beach County and the citizens of City of Delray Beach. NOW, THEREFORE, BE IT, AND THE SAME IS HEREBY, RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. The City Council of the City of Delray Beach expresses its sincere appreciation and thanks to Commissioner Wilken for her active support toward entering into interlocal governmental agreements so as to allow municipal control over the development and use of the reserve annexation of municipalities. Section 2. The City Council of the City of Delray Beach expresses its support of, and urgent desire for, such an interlocal governmental agreement. Section 3. The City Council of the City of Delray Beach directs the staff to continue such meetings as are necessary to expeditiously effect such an agreement, should Palm Beach County desire.
