Res 77-83 RESOLUTION NO. 77-83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA ENDORSING THE EFFORTS OF THE CITY OF BOCA RATON, FLORIDA, WHO, BY ORDINANCE HAVE PROHIBITED AND DECLARED TO BE A PUBLIC NUISANCE THE BLOWING OR ACTIVATING OF ANY HORN OR WHISTLE FROM A RAILROAD TRAIN AFTER 7:00 P.M. AND BEFORE 7:00 A.M. ON ANY DAY WITHIN THE CITY OF BOCA RATON; REQUESTING EXPANDED USE OF "STROBE" LIGHTS ON ALL RAILROAD TRAINS; PROVIDING FOR FURNISHING COPIES OF THIS RESOLUTION. WHEREAS, the City of Boca Raton, Florida, has recently enacted an ordinance which, in general, prohibits and declares to be a public nuisance the blowing or activating of any horn or whistle from a railroad train after 7:00 p.m. and before 7:00 a.m. on any day within the City of Boca Raton where certain adequate crossing guards and warnings are provided; and, WHEREAS, the City Council of the City of Delray Beach, Florida, does also hereby recognize that such unnecessary blowing or activating of railroad train whistles or horns seriously affects the health, welfare, comfort and repose of all citizens along the highly populated area of the Gold Coast; and, WHEREAS, the City Council of the City of Delray Beach, Florida, does hereby wish to express its support for and endorsement of the actions taken by the City of Boca Raton in seeking to remedy and restrict this serious noise pollution problem; and, WHEREAS, the City Council of the City of Delray Beach, Florida, also wishes to request, due to the number of persons in the area who may have impaired hearing and with the high use of automobile air conditioning in Florida, making daytime use of such train horns/whistles to be possibly ineffective as a warning device, that the railroads expand the use of "strobe" lights on all railroad trains as an alternative and/or additional safety device. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council of the City of Delray Beach, Florida, does hereby express its support for and endorsement of the actions of the City of Boca Raton, Florida, in enacting and attempting to enforce an ordinance which, in general, will prohibit and declare to be a public nuisance the blowing or activating of any horn or whistle from a railroad train after 7:00 p.m. and before 7:00 a.m. on any day within the City of Boca Raton where certain adequate crossing guards and warnings are provided; and does hereby request such support from other local governments in and along the Gold Coast of Florida. Section 2. That the City Council of the City of Delray Beach, Florida, does hereby request that the railroads expand the use of "strobe" lights on all railroad trains passing through the area, as an alternative and/or additional safety device, to warn persons of the trains' approach. Section 3. That the City Clerk of the City of Delray Beach, Florida is hereby authorized and directed to furnish copies of this Resolution to the Mayor of the City of Boca Raton, the Mayors and City Clerks of all other local governments along the Gold Coast, the railroad companies operating within our jurisdiction, and to all other appropriate public agencies and officials in the State of Florida and in the federal government.
