Res 80-83 RESOLUTION NO. 80-83 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES 171.062, TO REZONE LAND ANNEXED TO THE CITY OF DELRAY BEACH FROM THE COUNTY ZONING dLASSIFICATION RS (RESIDEN- TIAL SINGLE FAMILY), IN PART, AND CG (GENERAL COMMERCIAL) TO A DEPTH OF 150 FEET ON THE WESTERN BOUNDARY, TO THE CITY'S ZONING CLASSIFICATION SAD (SPECIAL ACTIVITIES) DISTRICT. WHEREAS, the City of Delray Beach received a request for annexa- tion from David Posnack and Julius A. Rosenthal, the fee-simple owners, as tenants in common, of the following described property: A Portion of the Plat of DEL-RATON PARK, Palm Beach County, Florida, according to the Plat thereof recorded in Plat Book 14, Page 10, of the Public Records of Palm Beach County, Florida, said portion being bounded as follows: On the North by the centerline of Avenue J; on the East by the West right of way line of Florida Boulevard; on the South by the North right of way line of Avenue L; and on the West by the East right of way line of U.S. Highway No. 1, said right of way line being 38 feet East of and parallel with the West line of Blocks 29 and 30 of the said plat of DEL-~ATO~ PARK. Also known as: All of Blocks 29, 30, 31 and 33 of DEL- RATON PARK according to the Plat thereof recorded in Plat Book 14, Page 10, Public Records of Palm Beach County, ~ Florida. The subject property is located north of Avenue "L" between Florida Boulevard and South Federal Highway. The above-described parcel contains a 15.39 acre parcel of land, more or less; and, WHEREAS, the City Council has considered this annexation request, approved annexation of the subject parcel and did so by adoption of Ordi- nance No. 63-83; and, WHEREAS, in order for this parcel to be zoned to the City zoning classification of SAD (Special Activities) District subsequent to its annexation, it is necessary under Chapter 171.062 of the Florida Statutes for the City to request permission from the Board of County Commissioners of Palm Beach County, Florida, for the change in zoning of this parcel which is currently zoned RS (Residential Single Family), in part, and CG (General Commercial) to a depth of 150 feet on the western boundary; and, WHEREAS, the proposed zoning for the subject property is consis- tent with the City's Comprehensive Land Use Plan; and, WHEREAS, the City Council has .determined that the subject prop- erty is compatible with Palm-Beach County's Comprehensive Plan, and the proposed uses and designations are compatible with existing patterns in the immediate vicinity of the annexed property, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council hereby requests a waiver from the Board of County Commissioners of Palm Beach County to immediately rezone the property described above from RS (Residential Single Family), in part, and CG (General Commercial) to a depth of 150 feet on the western boundary, to SAD (Special Activities) District which would result in an increase in the density for such land Section 2. That a certified copy of this-resolution is being sent to each member of the Board of County Commissioners, the County Administrator and the Director of Planning, Zoning and Building.
