Res 16-82 RESOLUTION NO. 16-82 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ACCEPTING ALL THE STREETS INSTALLED IN McEWEN LUMBER SUBDIVISION, AS RECORDED IN PLAT BOOK 38, PAGE 143 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, AS OPERATIONAL; PROVIDING THAT THIS RESOLUTION SHALL NOT DISCHARGE THE DEVELOPER FROM STRICT PERFOR- MANCE; PROVIDING FOR MAINTENANCE FOR AND REPAIRS BY THE DEVELOPER FOR ONE YEAR. WHEREAS, O'Brien, Suiter and O'Brien, Inc., Consulting Engineers and Land Surveyors for the above mentioned project have certified all streets as shown on their approved plans for said project have been completed and ready for use by the public; and, WHEREAS, the said streets were inspected and approved by the City of Delray Beach Engineering Department. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That all streets and related facilities have been installed in McEwen Lumber Subdivision, as recorded in Plat Book 38, Page 143 of the Public Records of Palm Beach County, Florida, and are hereby accepted by the City of Delray Beach as being operational, and shall become effective upon the date of passage and adoption of this resolution. Section 2. That nothing contained herein shall be construed as discharging the Developer, McEwen Lumber Company, from strict performance of this Company's contractual obligations and duties, and that this Company's bond (escrow account) shall remain in effect in all respects until released in accordance with this Corporation's agreement with the City. Section 3. That the Developer, McEwen Lumber Company, shall be responsible for maintenance and repairs of all the streets installed in McEwen Lumber Subdivision as recorded in Plat Book 38, Page 143 of the Public Records of Palm Beach County, Florida, for a period of one year after acceptance of this resolution by the City of Delray Beach Council.
