A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, REVERSING THE ADMINISTRATIVE
DETERMINATION BASED UPON THE CURRENT LANGUAGE SET
FORTH IN SECTION 13-12 OF THE CODE OF ORDINANCES
THAT A NUISANCE EXISTS IN VIOLATION OF SECTION 13-12
AND SECTION 13-13 OF THE CODE OF ORDINANCES IN
REGARD TO THE ALEXANDER S. EASSA PROPERTY LOCATED AT
1101 WEST ATLANTIC AVENUE AND 1127 WEST ATLANTIC
AVENUE; THE VIOLATION BEING AN ACCUMULATION OF
BOTTLES, TRASH AND LITTER ON THE PROPERTY.
WHEREAS, the City administration notified the owner of
the property, Alexander S. Eassa, that a violation of Section 13-12
and Section 13-13 of the Code of Ordinances was occurring on this
property; and,
WHEREAS, such violation was in the nature of an accumu-
lation of bottles, trash and litter; and,
WHEREAS, the property owner requested a hearing before
the City Council; and,
WHEREAS, the City Council upon hearing the evidence of
the administration and the property owner hereby enters its deci-
sion,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the administrative determination based
upon the current language set forth in Section 13-12 of the Code of
Ordinances that a nuisance exists in violation of Section 13-12 and
Section 13-13 of the Code of Ordinances in regard to the Alexander
S. Eassa property located at 1101 W. Atlantic Avenue and 1127 W.
Atlantic Avenue; the violation being an accumulation of bottles,
trash and litter is hereby reversed.
PASSED AND ADOPTED in regular session on this the 23rd
day of March , 1982.
