Res 28-82 RESOLUTION NO. 28-82 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING RESOLUTION NO. 92-81 BY AMENDING SECTION 2 TO ADD NEW SUBSECTION PROVIDING FOR TERMS OF MEMBERS; RATIFICATION BY CITY COUNCIL; REMOVAL; AND BY ADDING A NEW SECTION /~ SETTING FORTH THE DUTIES, POWERS, AUTHORITY, AND FUNCTIONS OF THE DELRAY BEACH HUMAN RELATIONS COMMITTEE. WHEREAS, the City Council of the City of Deiray Beach, Florida, did, by Resolution No. 92-81, establish the Delray Beach Human Relations Committee to act as a "sounding board" for the hearing of citizens' complaints and grievances~ and, WHEREAS, said Resolution No. 92-81 did not specifically set forth the duties, powers, authority, and functions of said Delray Beach Human Relations Committee; and, WHEREAS, the City Council of the City of Delray Beach, Florida, desires to specify such duties, powers, authority, and functions of the Delray Beach Human Relations Committee; and, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, A5 FOLLOWS: Section 1. That Resolution No. 92-81 be, and the same is hereby amended by amending Section 2 of said Resolution to read as follows: Section 2. (a) That said "Delray Human Relations Committee" shall be composed of responsible, law abiding citizens, consisting of a membership not to exceed twelve (12) persons to be chosen as follows= Three (3) selections to be made by the President of the South Palm Beach County Chapter of the NAACPi Three (3) selections to be made by the President of the local Nacarima Club, Inc.; Three (3) selections to be made by the Mayor of the City of Delray Beach, Florida; and Three (3) selections to be made by the President of the City of Delray Beach Chamber of Commerce. (b) That the members of said Delray Beach Human Relations Committee shall serve two (2)),ears staggered terms. The initial selections for said Committee shall serve the followinl~ terms which shall run from March 15~ 19l)2: the selections by the Mayor of the City of Delray Beach and by the President of the local Nacarima Club shall serve for one (1)),ear~ and the selections by the President of the South County Chapter of the NAACP and by the President of the City of Delray Beach Chamber of Commerce shall serve for two (2) years. (c) If a vacancy occurs on said Committee~ said vacancy shall be filled by selection by the person who selects members for each ~roup (e.B. selections of 'the Mayor~ etc.)~ and said selectl'on shall be for the unexpired term of the membership vacated.' (d) The City Council shall have the authority to approve and ratify all selections to membership on the committee~ and t. he City Council shall have the authority with or without cause to remove an), member of the Committee from said position whenever a maiority of the. City Council votes for such a removal. (e) Members of said Committee ma)' be reselected for an additional term, but in no case may a member of said Committee serve more than three (3) consecutive terms. Section 2. That Resolution No. 92-81 be, and the same is hereby amended to add a new Section 4 to read as follows: Section 4. That said Committee's duties, powers, authority, and functions are as follows: (a) That the Delray Beach Human Relations Committee shaJJ act only in an advisory capacity to the City Council and its actions and decisions shall not be binding on the City, the City Council, or the City Administration. (b) The Delray Beach Human Relations Committee shall act as a sounding board for grievances or complaints by citizens of, or persons who own or operate businesses within, the City of Delray Beach, Florida. (c) The Delray Beach Human Relations Committee shall consider only those matters 1) of a broad, City-wide concern, and 2) since the Committee is advisory to the City Council only, over which the City Council may have iurisdiction or have authority to act. (d) That the Delray Beach Human Relations Committee shall act as a mediator of disputes or grievances, and as such, said Committee shall have no independent investigative authority nor the power to compel the attendance of witnesses by subpoena. (e) That the Delray Beach Human Relations Committee shall not consider any matter which involves a grievance or dispute between employers and employees, including those involving the City and its employees; nor shall the Committee specifically consider any matters which are in litigation or are under review by any other governmental agency, board or commission. (f) That the Delray Beach Human Relations Committee shall hold meetings on a regular basis, which meetings shall be open to the public. Minutes shall be kept of all such meetings, and any special meetings. Copies of said minutes, and any other reports, shall be transmitted to the City Council and City Manager within thirty {30) days of such meeting. (§) That the Delray Beach Human Relations Committee is encouraged to sponsor or suggest activities within the community which will serve to promote harmony and communication between all of the residents and citizens of the City of Deiray Beach, Florida. {h) That members of the Delray Beach Human Relations Committee shall serve without compensation. (i) That the Delray Beach Human Relations Committee shall adopt bylaws which shall set forth the process for selection of presiding officers and procedures for the conduct of meetings within the §uidelines set forth above.
