. RESOLUTION OF THE' CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AUTHORIZING PURSUANT TO THE CHARTER OF
T~E CITY OF DELRAY BEACH THE EXCHANGE OF REAL PROPERTY
OWNED BY THE CITY OF DELRAY BEACH LOCATED IN SECTION 18,
TOWNSHIP 46 SOUTH, RANGE 43 EAST.
WHEREAS, the City of Delray Beach, Florida is the owner of a
tract of land in Section 18, Township 46 South, Range 43 East, Palm Beach
County, Florida, being more particularly described as follows:
A parcel of land in the W½ of the SW~ of Section 18,
Township 46 South, Range 43 East, Palm Beach County,
Florida, more particularly described as follows:
Commencing at the Southeast corner of the West % of the
Southwest ~ of Section 18, Township 46 South, Range 43
East, run N 00°03'46"W, along the East line of the said
West %, a distance of 900.43 feet to the point of curva-
ture of a curve concave to the Southwest, having a radius
of 310.00 feet and a central angle of 43°34'19'', said
point also being the point of beginning; thence norther-
ly, along the arc of said curve, a distance of 235.75
feet to the point of reverse curvature of a curve concave
to the Northeast, having a radius of' 440.00 feet and a
central angle of 43°34'19"; thence Northerly, along the
arc of said curve, a ~istance of 334.61 feet to the point
of tangency; thence N 00°03'46"W, a distance of 54.92
feet; thence N 84°13'35"E, a distance of 80.40 feet;
thence S 00"03'46"E, a distance of 62.92 feet to the
point of curvature of a curve concave to the Northeast,
having a radius of 360.00 feet and a central angle of
43"34'19"; thence Southerly, along the arc of said curve
a distance of 273.77 feet to the point of reverse curva-
ture of a curve concave to the southwest, having a radius
of 390.00 feet and a central angle of 06~12'55"; thence
Southerly, along the arc of said curve, a distance of
42.31 feet to a point of said curve; thence S 00~03'46"E,
a distance of 236.64 feet to the point of beginning,
containing 0.86 acres more or less; and,
WNEREAS, Namil Corporation is the owner of Lots 2, 3 and 4,
Golfview Estates Subdivision as recorded in Plat Book 24, Page 50 of the
Public Records of Palm Beach County, Florida; and,
WHEREAS, City Council has previously discussed and is of the
opinion that it would be in the best interest of the City to exchange the
above referenced real property owned by the City for the above referenced
real property owned by Namil Corporation, upon the terms and conditions
set forth in this resolution. Such property to be exchanged on an equal
basis with neither party paying any additional consideration. Closing
costs will be paid as follows: (a) On the property being transferred by
the City, it shall provide an owners title insurance policy, at its ex-
pense, and pay the documentary stamps on the deed of conveyance. The City
will pay the recording fee for the deed received from Namil Corporation;
(b) As to the property being transferred by Namil Corporation, it shall
provide an owners title insurance policy, at its expense, and pay the
documentary stamps on the deed of conveyance. Both parties will pay the
recording fee for the deed it is receiving from the other party.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council of the City of Delray Beach
does hereby authorize the exchange by standard form general warranty deed
of the above-described real property located in the City of Delray Beach.
