A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, REQUESTING PERMISSION FROM THE BOARD OF
COUNTY COMMISSIONERS, PURSUANT TO FLORIDA STATUTES
171.044 TO ANNEX LANDS INTO THE MUNICIPAL LIMITS OF THE
CITY OF DELRAY BEACH, FLORIDA.
WHEREAS, the City of Delray Beach, Florida, has received an
annexation request from Samuel P. Fisher, as President and Sylvia L.
Fisher, his w~fe, as Secretary, for Eighth Street Market, Inc., for the
following described property:
Lot 1, less the South 8 feet; all of Lot 2; the West
Half (W½) of Lot 10, less the South 10 feet; and the
West Half (W½) of Lot 11, Block 4, SOPHIA FREY SUBDI-
VISION, according to the Plat thereof on file in the
Office of the Clerk of the Circuit Court in and for
Palm Beach County, Florida, in Plat Book 4, Page 37;
and,
WHEREAS, there is an alley currently located in the County
bounding Lots 1 and 2 and W½ of Lots 10 and 11, Block 4, SOPHIA FREY
SUBDIVISION; and,
WHEREAS, the property owner has requested that this be annexed
along with the other property described above; and,
WHEREAS, upon annexation the property owner would petition the
City of Delray Beach to abandon the aforementioned alley to consolidate
the parcels described in the first whereas clause above into one develop-
ment parcel; and,
WHEREAS, Florida Statutes 171.044 requires the permission of a
property owner for voluntary annexation; and,
WHEREAS, Palm Beach County is the owner of the above described
alley,
-NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council of the City of Delray Beach
hereby requests permission from Palm Beach County to annex the following
described property:
The 16 foot alley bounding Lots 1, 2 and W½ of Lots 10
and 11, Block 4, SOPHIA FREY SUBDIVISION, according to
the Plat thereof on file in the Office of the Clerk of
the Circuit Court in and for Palm Beach County,
Florida, in Plat Book 4, Page 37.
Section 2. That a certified copy of this resolution is being
sent to each member of the Board of County Commissioners, the County
Administrator and the Director of Planning, Zoning and Building.
PASSED AND ADOPTED in regular session on this the 26th day of
May, 1981.
